I. INTRODUCTION
The Marina Coast Water District (District) is requesting proposals from qualified
consulting firms to provide professional engineering, hydrogeologic, and regulatory
services for the District's Sand Tank Indirect Potable Reuse (IPR) Project. The selected
Consultant will prepare a Basis of Design Report (BODR), Title 22 Engineering Report,
coordinate with applicable regulatory agencies, prepare the Report of Waste
Discharge, and provide related permitting support necessary to advance the Project
toward subsequent design and implementation.
The Consultant shall perform the tasks specified in this RFP and is encouraged to
identify additions or modifications that would enhance or clarify the work. Any proposed
modifications shall be clearly identified in the proposal.
II. BACKGROUND
The District is undertaking an IPR Project at the Sand Tank Site, identified as the
recommended alternative in the District's IPR Feasibility Report (EKI, 2022). The
Project is anticipated to utilize advanced-treated water from Monterey One Water's
Advanced Water Purification Facility. The proposed Project has a design flow of
approximately 1.37 mgd. The work under this RFP is intended to establish the technical
basis for permitting and subsequent design and to support DDW and RWQCB
regulatory review.
Other program elements, including CEQA documentation, stakeholder coordination,
funding and financing, supply strategy and negotiations, legal services, detailed
design, and construction, may be performed separately by the District, other
consultants, or project partners.
III. SCOPE OF SERVICES
The District is seeking a qualified Consultant to provide professional engineering and
regulatory services necessary to advance the Sand Tank Indirect Potable Reuse (IPR)
Project through basis of design and applicable regulatory review and permitting.
The scope is generally organized around the three primary work areas described
below. The District expects proposing firms to use their experience with indirect potable
reuse, groundwater replenishment, and applicable regulatory requirements to develop
and recommend an appropriate approach, scope, and sequence of work necessary to
successfully complete the Project.
Proposers should identify any additional studies, analyses, coordination, or supporting
work they believe will be necessary to complete the requested services.

1. Basis of Design Report
Prepare a Basis of Design Report (BODR) sufficient to establish the technical basis for
subsequent design, regulatory review, and implementation of the Sand Tank IPR
Project.
The Consultant should review available District and project information, identify
significant information or data gaps, and perform the engineering and technical
evaluations necessary to develop the BODR.
The BODR should address, as appropriate, the proposed project configuration and
facilities, existing infrastructure, design criteria, hydraulic considerations, facility
alternatives and recommended configuration, operational considerations, regulatory
requirements affecting design, planning-level project costs, implementation schedule,
and other technical considerations necessary to advance the Project into subsequent
design.
The Consultant should identify any additional investigations or information that may be
required to support subsequent design or regulatory approval.
2. Regulatory Permitting and Agency Coordination
Provide regulatory coordination and permitting support necessary to advance the
Project through the applicable regulatory review process.
The Consultant shall coordinate, as appropriate, with the State Water Resources
Control Board Division of Drinking Water (DDW), Regional Water Quality Control Board
(RWQCB), and other applicable regulatory agencies.
The work should include early coordination with regulatory agencies to confirm the
anticipated regulatory pathway, technical information requirements, and major
regulatory considerations affecting the Project.
The Consultant shall support the technical information necessary to assist District
coordination with Monterey County, the U.S. Army/BRAC Cleanup Program, and other
applicable agencies regarding the proposed injection well and any associated
monitoring or test wells. The District will lead coordination with Monterey County and
the U.S. Army/BRAC Cleanup Program, with the Consultant providing technical
support, presentations, analyses, and responses to agency comments as necessary.
Agency input shall be incorporated into the BODR, Title 22 Engineering Report,
permitting strategy, and subsequent project recommendations, as appropriate.
The proposed Sand Tank IPR Project is located on the former Fort Ord and may be
subject to groundwater well construction restrictions, land-use controls, and

requirements associated with ongoing environmental remediation activities. The
Consultant shall evaluate applicable constraints and develop the technical information
necessary to support regulatory review and facilitate coordination with affected
agencies. Recommendations shall identify potential permitting challenges, data gaps,
and measures necessary to advance the project through design, regulatory approval,
and implementation.
The Consultant shall prepare and support the regulatory applications and
documentation necessary for the Project, including the Report of Waste Discharge and
supporting information required for RWQCB review.
The Consultant shall support the District through agency review, including responding
to comments and identifying regulatory or permit conditions that may affect subsequent
project design, operation, or monitoring.
3. Title 22 Engineering Report
Prepare the Title 22 Engineering Report and supporting technical documentation
necessary for regulatory review and approval of the proposed IPR Project.
The Consultant shall determine and perform the analyses necessary to satisfy
applicable Title 22 requirements and DDW and RWQCB review.
The work is anticipated to include evaluation and documentation of groundwater and
hydrogeologic conditions, retention-time considerations, monitoring requirements, log-
removal value requirements, source and advanced-treated water information,
proposed groundwater replenishment facilities, and other technical information
required by the regulatory agencies.
The Consultant shall coordinate development of the Title 22 Engineering Report with
the BODR and permitting activities so that the documents are technically consistent
and can support subsequent project design.
The Consultant shall prepare appropriate draft and final documents and provide
support during District and regulatory agency review.
Consultant's Proposed Approach
The descriptions above are intended to identify the District's primary objectives and
anticipated work products and are not intended to prescribe the Consultant's specific
methodology.
Proposers shall provide a detailed proposed scope of work identifying the tasks,
technical analyses, regulatory coordination, meetings, deliverables, schedule,

assumptions, and level of effort they recommend to successfully complete the BODR,
Title 22 Engineering Report, and regulatory permitting services.
Proposers should clearly identify:
* Additional work they believe is necessary to satisfy regulatory requirements or
successfully complete the Project.
* Significant data or information needs.
* Recommended regulatory coordination and agency meetings.
* Anticipated technical studies or analyses.
* Assumptions used in developing the proposed scope and fee.
* Work that is specifically excluded from the proposal or recommended for a
subsequent phase.
Unless otherwise proposed and authorized by the District, CEQA documentation,
detailed design and construction documents, new monitoring well installation, test
borings, aquifer pump testing, and implementation of tracer studies are not anticipated
to be included in the base scope of services.
IV. PROJECT ASSUMPTIONS AND EXCLUSIONS
* The Sand Tank Site and general project concept have been identified by the
District; site selection and feasibility-level screening of alternative sites are not
included.
* Source recycled water will be advanced-treated water supplied by Monterey One
Water; design of new treatment processes at the AWPF is not included.
* Water supply contracting, negotiations, and related legal efforts are outside this
scope.
* New field investigations, including test borings, monitoring well installation, aquifer
pump testing, or tracer study implementation, are not included in the base scope
and would require separate District authorization.
* CEQA documentation is not included in the base scope.
* Detailed design and construction documents are not included in the base scope.
* The District will provide reasonably available existing data, reports, GIS information,
plans, and staff availability.
V. SERVICES TO BE PROVIDED BY MCWD
* Furnish reasonably available records, reports, studies, water quality and
groundwater information, GIS data, plans, agreements, and other relevant project
information.
* Provide available information regarding District facilities, the Sand Tank Site, prior
IPR planning, and coordination with Monterey One Water.

* Provide staff support, review Consultant deliverables, and assist with coordination
meetings as appropriate.
VI. SERVICES TO BE PROVIDED BY CONSULTANT
* Review existing project documents and develop familiarity with the Project.
* Attend kickoff, progress, technical, and regulatory coordination meetings as
necessary.
* Coordinate with DDW, RWQCB, District staff, and other project participants as
appropriate.
* Conduct analyses required by the Scope of Services and prepare draft and final
deliverables.
* Address and document District and agency comments.
* Provide final deliverables electronically in searchable PDF and editable native
formats where applicable.
* Provide a detailed project schedule.
VII. PROPOSAL SUBMITTAL
* Approach to the Project and Project Understanding.
* Firm and project team experience with similar IPR, groundwater replenishment,
BODR, Title 22, DDW, and RWQCB permitting work.
* Qualifications and resumes of key personnel.
* Recent references for similar projects.
* Proposed scope of work, including recommended additions, modifications,
assumptions, or exclusions.
* Proposed project schedule.
* Separate cost proposal identifying costs by task.
* Fee schedule for additional services.
* Required Professional Services Agreement and insurance information.
VIII. AGREEMENT
The successful proposer will be required to execute the District's Professional Services
Agreement and meet applicable insurance and indemnity requirements. The District
reserves the right not to award the contract if mutually acceptable terms cannot be
reached.
The attached Agreement includes complete insurance and indemnity requirements.
Consultant shall maintain in effect throughout the term of the Agreement a policy or
policies of insurance with the minimum limits of liability listed in the Professional
Services Agreement (Appendix B of the Agreement). Evidence of Insurance must be
received prior to Agreement implementation.

IX. SCHEDULE
Proposing firms must be able and willing to commit the necessary resources to
complete the work. Final solicitation dates will be inserted by the District prior to

XI. SELECTION OF CONSULTANT
District management staff will review proposals uniformly. Selection will be based on
qualifications and experience, understanding of the Project, technical and regulatory
approach, relevant IPR and groundwater replenishment experience, DDW and
RWQCB permitting experience, proposed schedule, and overall ability to successfully
complete the work. The District reserves the right to interview some, all, or none of the
proposing firms and to request clarification or additional information.
XII. GENERAL INFORMATION
1. Proposers are encouraged to review this RFP carefully in its entirety prior to
preparation of its proposal. DISTRICT reserves the right to verify all information
submitted in a proposal.

2. Waiver of Irregularities. DISTRICT reserves the right to waive any informalities or
irregularities in this RFP process, or in any proposal.
3. Addenda. DISTRICT reserves the right to revise the RFP documents. Any changes to
the requirements will be made by written addenda to this RFP. Failure to acknowledge
all posted addenda may cause a proposal to be deemed non-responsive to this RFP and
be rejected without further evaluation.
4. No Commitment to Award. Issuance of this RFP and receipt of proposals does not
commit DISTRICT to award a contract. DISTRICT expressly reserves the right to
postpone the RFP process for its own convenience, to accept or reject any or all
proposals received in response to this RFP, to award all or a portion of the proposed
scope of work, or to cancel all or part of this RFP.
5. Amendments to Proposals. No amendment, addendum or modification will be
accepted after the deadline stated herein for receiving proposals. Proposer may modify
or amend its proposal only if DISTRICT receives the amendment prior to the deadline
stated herein for receiving proposals.
6. Non-Responsive Proposals. A proposal may be considered non-responsive if
conditional, incomplete, or if it contains alterations of form, additions not called for, or
other irregularities that may constitute a material change to the proposal.
7. Late Proposals. DISTRICT will not be responsible for proposals that are delinquent,
lost, or incorrectly submitted.
8. Costs for Preparing. DISTRICT will not compensate any proposer for the cost of
preparing any proposal, and all materials submitted with a proposal shall become the
property of the DISTRICT. The District may retain all proposals submitted and may use
any idea in a proposal regardless of whether that proposal is selected.
9. Alternative Proposals. Only one final proposal is to be submitted by each proposer.
Multiple proposals will result in rejection of all proposals submitted by the proposer.
10. Public Documents. All proposals shall be available for public inspection at the
conclusion of the selection process.
11. No Exceptions. Submission of a proposal constitutes acceptance by proposer of
the conditions contained in this RFP and the Agreement, should proposer be selected.

THIS AGREEMENT, made and entered into this ______________________, by and
between Marina Coast Water District, 920 2nd Avenue, Suite A, Marina, CA, 93933,
hereinafter called "DISTRICT", and ______________________, with its principal offices
at __________________________________________ hereinafter called the
"CONSULTANT":
WHEREAS, the DISTRICT, desires to receive the professional services related to
[PROJECT NAME, BRIEF DESCRIPTION AND PHASE OF WORK AUTHORIZED
BY THE INITIAL AGREEMENT, E.G, DETAILED DESIGN] with a scope generally
defined by DISTRICT's Request for Proposal presented in Appendix A; and
WHEREAS, DISTRICT is desirous of engaging the services of said CONSULTANT to
perform or furnish said services.
WHEREAS, CONSULTANT has available and offers to provide personnel and facilities
necessary to accomplish said services in a timely manner.
NOW, THEREFORE, said DISTRICT and said CONSULTANT, for the considerations
hereinafter set forth, mutually agree as follows:
ARTICLE I - PROFESSIONAL ENGAGEMENT
DISTRICT hereby engages NAME OF CONSULTANT as an independent contractor, to
perform or furnish the services hereinafter more particularly described in Appendix A,
commencing on the date of this Agreement.
CONSULTANT hereby agrees to perform or furnish as an independent contractor
professional engineering [OR THE TYPE OF SERVICES, E.G., CEQA COMPLIANCE]
and related services as set forth herein. CONSULTANT may retain qualified
subconsultants to assist in the performance of professional services. DISTRICT shall be
notified prior to CONSULTANT sub-contracting such services and sufficient time shall be
provided to allow DISTRICT to review the subconsultant's qualification. Should
DISTRICT, based upon reasonable cause, not accept any such subcontractor or
subconsultant for use on the Project, DISTRICT shall so notify CONSULTANT within
five (5) days following DISTRICT's receipt of such notice from CONSULTANT, and

CONSULTANT shall not subcontract with any such subcontractor or subconsultant for the
Project. DISTRICT shall have the right at any time to revoke its acceptance (whether given
affirmatively or by its failure to object within said five (5) day period) of any subcontractor
or subconsultant on the basis of reasonable cause, in which case CONSULTANT shall
submit an acceptable substitute and a Task Order equitably adjusting CONSULTANT's
compensation will be issued. No acceptance of any subcontractor or subconsultant shall
waive: (1) DISTRICT's right not to accept defective services performed or furnished for
CONSULTANT by said subcontractor or subconsultant; or (2) any other right or remedy
DISTRICT has under this Agreement, including but not limited to its rights to suspend or
terminate services under this Agreement.
CONSULTANT is an independent contractor and is not and shall not be deemed to be an
employee, agent, servant, partner or joint venturer of DISTRICT. CONSULTANT shall
have the exclusive supervision, direction and control of all employees, subconsultants,
subcontractors, suppliers, materials, equipment and facilities employed, contracted with or
used by, CONSULTANT in performing or furnishing services under this Agreement.
ARTICLE II - SCOPE OF SERVICES
The scope of services performed or furnished by CONSULTANT under the terms of this
Agreement is defined in Appendix A and in the executed Amendment(s) pursuant hereto
which will authorize CONSULTANT to perform specific engineering [OR OTHER
TYPES OF SERVICES] services related to the project. Unless modified in writing by both
parties through a Amendment, duties of CONSULTANT shall not be construed to exceed
those services specifically established in Appendix A. (NOTE: ANY ADDITIONAL
ENGINEERING FEES ASSOCIATED WITH SERVICES NOT INCLUDED IN
APPENDIX A MUST BE DEFINED AND AGREED TO BY DISTRICT IN WRITING
PRIOR TO INITIATION OF THESE SERVICES.)
ARTICLE III - GENERAL PROVISIONS
A. The CONSULTANT hereby represents that all work described herein shall be
performed only by persons under the supervision of a person who is currently licensed to
perform such work and that to the best of its professional ability, all work shall be
performed in accordance with applicable Federal, State, and local laws and regulations.
B. The CONSULTANT shall not discriminate in employment practices, in the performance
of the terms of this Agreement, either directly or indirectly, on the grounds of race, color,
religion, sex, age, or national origin, and shall take affirmative steps to ensure that
applicants are employed and employees are treated during employment without regard to
race, color, religion, sex, age or national origin.
A. The General Manager of the DISTRICT shall forward an executed copy of this
Agreement to the CONSULTANT within ten (10) days of execution of this Agreement
by the DISTRICT.
