NOTICE TO CONTRACTORS

Sealed proposals will be received by the Public Works Director of the County of Merced, 345 W. 7th Street, Merced, CA 95341, until 2:15 PM Standard Pacific Time on Thursday, July 16, 2026, for:

JOB ORDER CONTRACT (JOC) – B LICENSE

This Advertisement for bids is for the award of up to three (3) separate Job Order Contracts (JOCs) and the work includes repair, alteration, modernization, maintenance, rehabilitation, and demolition work performed on buildings, offices, facilities, structures, infrastructure, or other real property. A JOC is a competitively bid, Unit Price, indefinite quantity contract that is awarded to a Prime Contractor. Once awarded, work is accomplished through the issuance of individual Job Orders. Job Order Contracts awarded under this solicitation will each have a Maximum Contract Value of six million four hundred two thousand six hundred six dollars ($6,402,606). The County has no obligation to give the Contractor the opportunity to perform Job Orders in excess of the Minimum Contract Value. The County reserves the right to issue Job Orders totaling less than the Maximum Contract Value. Each contract will be for a term of twelve (12) months. Selected Contractors will enter into the Agreement for Special Services contained in these Specifications.

Bids will be evaluated and the low bid shall be determined per the bid Adjustment Factors.

Drawings, Specifications, and other Documents are on file at the office of the Public Works Director, 345 West 7th Street, Merced, CA, and at other designated locations, where copies may be examined free of charge.

A non-mandatory virtual pre-bid meeting will take place on Wednesday, July 1, 2026 at 10:00 A.M at the Public Works Department.

The purpose of the Pre-Bid Meeting is to go over key dates, requirements for the solicitation, discuss the Job Order Contract (JOC) concept and discuss JOC from a Contractor’s perspective. The County strongly encourages a responsible managing officer from the Contractor’s office to attend this meeting.

Questions from interested prospective bidders will only be accepted by the County in writing via written correspondence or via Internet electronic mail (preferred) to Cynthia Guillen, at the Department of Public Works offices located at 345 W. 7th Street, Merced, California 95341-6041 or at For security reasons, you must enable JavaScript to view this E-mail address. respectively. Neither the County nor its representative will be responsible for any oral instructions. No interpretations will be issued later than three (3) working days prior to the bid date so that all inquiries can be answered in writing and distributed to all bidders on the plan-holders list in the form of

addenda to the contract in ample time before the bid opening date. The cutoff for questions from interested prospective bidders is Wednesday, July 8, 2026, at 3:00 P.M.

Bidders shall furnish an initial Payment Bond in the amount of two hundred fifty thousand dollars and no cents ($250,000.00) and an initial Performance Bond in the amount of two hundred fifty thousand dollars and no cents ($250,000.00).

Bids, in order to receive consideration, shall be made and submitted in accordance with the requirements and conditions set forth in the Bid Book and in the aforesaid Drawings, Specifications and other Documents. Neither partial nor contingent Bids will be considered.

The Bid of any Contractor who has previously violated the terms of the Federal Labor Laws, and who has not been cleared of such violations, will be deemed non-responsive. Also, any Sub-Contractor under him under the same circumstance will not be accepted for this project.

The Contractor shall possess the following licenses and requirements:

Class B - Contractors license is required at the time this contract is awarded.

The County selected The Gordian Group’s (Gordian) Job Order Contracting (JOC) Solution for their JOC program. The Gordian JOC Solution™ includes Gordian’s proprietary JOC Information Management System (“JOC IMS”), construction cost data, and Construction Task Catalog® which shall be used by the Contractor solely for the purpose of fulfilling its obligations under this Contract, including the preparation and submission of Job Order Proposals, Price Proposals, subcontractor lists, and other requirements specified by the County. The Contractor shall be required to execute Gordian’s General Terms of Use and pay a 1% JOC System License Fee to obtain access to the Gordian JOC Solution™. The JOC System License Fee applies to all Job Orders issued to the Contractor under the terms of this Contract.

Pursuant to the provisions set forth in Sections 1770 to 1781, inclusive, and Sections 1810 to 1817, inclusive, of the Labor Code of the State of California, and local laws thereto applicable, the Board of Supervisors of Merced County, in the manner required by law, has ascertained the general prevailing Rate of Wages and also the hourly rates for Saturday, Sunday, Holiday and overtime work, in the locality where this work is to be performed, for each craft, classification and type of Workman or Mechanic needed to perform the work of this project, has adopted, by Resolution No. 79-38, and has published this wage scale in accordance with Sections 1773 and 1773.2 of the said Labor Code, which scale will become a part of the Contract. A copy of this wage scale may also be obtained from the Office of Department of Public Works or at the following Web Site: www.dir.ca.gov/dlsr .

Bidders are hereby notified that pursuant to SB854 (Stat. 2014, Chapter 28):

No contractor or subcontractor may be listed on a bid proposal for a public works project unless registered with the Department of Industrial Relations pursuant to Labor Code section 1725.5 [with limited exceptions from this requirement for bid purposes only under Labor Code section 1771.1(a)].

No contractor or subcontractor may be awarded a contract for public work on a public works project unless registered with the Department of Industrial Relations pursuant to Labor Code section 1725.5.

This project is subject to compliance monitoring and enforcement by the Department of Industrial Relations.

It shall be mandatory upon the Contractor to whom the Contract is awarded, and upon all Sub-Contractors under him, to ascertain and pay not less than the latest general prevailing rate of wages and to pay not less than the general prevailing hourly rates for Saturday, Sunday, Holiday and overtime work for each Workman or Mechanic employed in the execution of the work of this project.

Contractors may substitute an Escrow Agreement for performance retention in accordance with the State of California Public Contract Code Section 22300.

Bid Security in the amount of twenty five thousand dollars ($25,000) shall accompany the Bid, in accordance with the provisions set forth in the Instructions to Bidders.

The Public Works Director reserves the right to reject any or all bids, and to waive any informalities or irregularities in any Bid or in the Bidding.
