Description

The U.S. Immigration and Custom Enforcement (ICE), Office of Acquisition Managment (OAQ), Investigations & Operations Support Division, Irving, Texas 75063 publishes this notice of intent to award a sole source contract for informational purposes only. This proposed action is for the acquisition of a Lumen Laser Induced Breakdown Spectrometer on behalf of the Forensic Document Laboratory to add further capabilities to a previously acquired laser ablation inductively coupled plasma mass spectrometer.



The Government intends to solicit and negotiate with only one source under the authority of FAR 13.106-1(b)(1), “Contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available”, resulting in a Firm-Fixed-Price contract. The Contracting Officer has determined that only one source is reasonably available.



The proposed procurement will be a Sole Source under North American Industry Classification Systems (NAICS) Code 334516 – Analytical Laboratory Instrument Manufacturing and the business size standard in number of employees is 1,000.



The proposed source is Elemental Scientific Lasers, LLC. A decision by the Government not to compete this proposed contract regardless of responses that may be received to this notice is solely within the discretion of the Government. This notice of intent is not a request for competitive quotations. However, all responsible sources may submit a capability statement, proposal, quotation, or exception to the intent to purchase on a sole source basis, which shall be considered by the Government if received by 9:00 AM EDT on 12 Aug 2025.



To comply with FAR 5.207(c)(15), the reason for lack of competition is as follows: The proposed vendor, Elemental Scientific Lasers, LLC, is the only known source capable of meeting the Government’s requirements, for this Lumen Laser Induced Breakdown Spectrometer to add additional capability to an exisitng laser ablation inductively coupled plasma mass spectrometer. Both the customer and contracting personnel have utilized subject matter experts but were unable to find other sources able to meet this requirement.
