REQUEST FOR PROPOSALS (RFP)
FOR THE OPERATION OF THE
CITY OF MARIETTA'S AQUATIC CENTER
1. INTRODUCTION
The City of Marietta is seeking to obtain a qualified service provider to operate the City of
Marietta Family Aquatic Center for the 2026 pool season. The successful "Provider" shall be
required to do all things necessary to open, operate and staff the aquatic center with
qualified staff. The Provider shall have the option to extend the contract, upon the same
terms and conditions, for one (1) additional pool season, to-wit: the 2027 pool season upon
acceptance and the express written agreement of the City of Marietta.
2. GENERAL OVERVIEW AND PROVISIONS
The following sections describe the basic rules governing the Request for Proposal (RFP)
process.
2.1. PURPOSE OF THIS REQUEST FOR PROPOSAL
The purpose of this Request for Proposal is to seek proposals that meet the specifications
listed in Section 4 (aquatic management) of this RFP. It is the City of Marietta's intention to
select the proposal which best meets its anticipated needs at the lowest cost. All proposals
will be evaluated in accordance with the Criteria listed in Section 3, Paragraph 3.10 of this
RFP.
2.2. SCOPE OF THE RFP
This RFP is not an offer to purchase, but a request to receive proposals to operate the City of
Marietta's Aquatic Center. It contains instructions for proposal responses and requirements
that must be met for eligibility. The City of Marietta reserves the right to accept or reject any
or all proposals.
Although the aquatic management provider must submit a proposal for the entire RFP, the
City of Marietta reserves the right to accept or reject any part or segment of the total
proposal. Providers may be excluded from further considerations for failure to fully comply
with the specifications of this RFP. It is each Provider's responsibility to read the entire RFP and
submit completed RFP responses by the required dates indicated in Section 2, Paragraph 2.4
of this Document.
2.3. LAWS
2.3.1. All laws of the United States and the State of Ohio, and the Codified Ordinances of the
City of Marietta in so far as they apply, are made a part hereof.
2.3.2. This RFP, and any subsequent contract as a result of this RFP, will be governed by and
construed in accordance with the Laws of the State of Ohio.
2.3.3. The Provider must provide a disclosure of any pending or threatened court actions
and/or claims against the Provider, parent company or subsidiaries. This information will not
necessarily be cause for rejection of the proposal; however, withholding the information may
be cause to reject the proposal

2.4. PROJECT SCHEDULE
The City of Marietta anticipates adhering to the following RFP schedule. This schedule may
be modified by the City of Marietta, at its sole discretion. The City of Marietta will attempt to
inform Providers of any changes in the schedule.

3. THE RFP PROCESS
This section provides particular instructions for various steps in the RFP process. All Providers
should pay particular attention to paragraphs 3.4.4.5 Operations Plan, 3.8 Evaluation Criteria,
and Section 4, the Specifications. All Providers must provide an operational plan explaining
how they will provide the services set out in the Specifications. This plan will be judged
according to the Evaluation Criteria stated in Section 3, Paragraph 3.8.
3.1. PROVIDER RESPONSIBILITIES
All Providers are responsible for being thoroughly familiar with all provisions of this RFP, any
subsequent addenda, the facilities involved and the specifications contained herein. The
failure of the Provider to do the foregoing does not relieve the Provider from any obligation
with respect to the proposal submitted.
3.2. PROVIDER INQUIRIES

3.3. SUBMITTING PROPOSALS
3.3.1. All proposals must be complete, including cost information and signatures by a
Provider's representative authorized to bind the firm, corporation or partnership or other
business entity. Any proposal to offer an alternative to meet the requirements must be noted
and explained as to how the alternative offered will meet the intent of the RFP. Any proposal
which is incomplete, conditional, contingent, obscure, or which contains irregularities of any
kind, may be rejected. Proposals not received by the specific date and time will be rejected.
3.3.2. No person, firm or corporation shall be allowed to make or file more than one (1)
proposal for the same work, unless alternate proposals are called for. A person, firm or
corporation who has submitted a sub proposal to a Provider, or who has quoted prices on
materials to a Provider, may submit a sub proposal or quote prices to other Providers.
3.3.3. In submitting a proposal, the Provider affirms that the proposal is genuine and not
collusive or a sham and that the Provider is not financially interested in, or otherwise affiliated
in a business way with any other Provider on the same contract.
3.3.4. In submitting a proposal, the Provider affirms that all statements contained in the
proposal are true and accurate.
3.4. PREPARATION OF PROPOSAL
The preparation of a proposal must not deviate from the noted requirements and should
provide clear and concise information to satisfy the requirements.
3.4.1. Proposal Cost - Costs incurred developing proposals are to be entirely borne by the
Providers and will not be reimbursed under any circumstances. All supporting documentation
and manuals submitted with this proposal will become the property of the City of Marietta.
All proposals and associated documents are public record.
3.4.2. Number of Copies - One (1) signed original proposal must be received in the office of
the Mayor of the City of Marietta, 301 Putnam Street, Marietta, Ohio, 45750 up to the hour of
11:00 A.M. on April 7,2026.

The submission date/time is stated in Section 3, Paragraph 3.4.2 of this Document. Any
proposal received after that will be considered late and may be rejected. A proposal can
be withdrawn at any time until the deadline time, at which time the proposal will be
considered firm.
3.4.4. Proposal Format - Proposals must be formatted in accordance with this section. Any
Proposal submitted in a format other than that specified herein may not be considered for
contract award. If for any reason the proposal is incomplete or questions are unanswered,
the proposal may be rejected. Proposals will be considered incomplete if they do not bear
the signature of an agent of the Provider who is in a position to bind the Provider to a
contract. The proposal must include all costs associated with providing the services and/or
equipment identified in this RFP. The proposal shall consist of a transmittal letter.
3.4.4.1 Letter of Transmittal - Each proposal must include a letter of transmittal that includes
the signature of an authorized representative of the Provider and also includes the names of
individuals authorized to negotiate with the City of Marietta.
3.4.4.2 Section Two-Executive Summary - The Executive Summary should be a succinct
document which describes the major features of the proposal, including specific costs and
services. The Executive Summary should not exceed three (3) pages in length.
3.4.4.3 Section Three-Background - This Section should supply the name, address, telephone
and fax numbers of the company or individual submitting the proposal. Include the name of
the person who can be contacted and is authorized to answer questions regarding the
proposal.
3.4.4.4 Section Four-Ownership Information - This Section should identify how the company is
owned, the year the company was established and the former name(s) of the firm, if
applicable. Also, identify the state in which the company is incorporated, if applicable.
3.4.4.5 Section Five-Operations Plan - This Plan must identify the nature of the services being
proposed.
3.5. QUESTIONS & INTERVIEWS DURING SELECTION PERIOD
If questions arise regarding clarification of a proposal during the proposal evaluation process,
the City of Marietta will contact the designated Provider's representative. All expenses
incurred to answer these questions will be the responsibility of the Provider.
3.5.1. Interviews - The City of Marietta reserves the right to interview Provider during the
proposal evaluation process, the City of Marietta will contact the designated Provider's
representative. All expenses incurred to answer these questions will be the responsibility of
the Provider.
3.6. AWARDING OF CONTRACT
3.6.1. A contract will be awarded by the City of Marietta on the basis of the Lowest and Best
standard. The City of Marietta reserves the right, in its discretion, to accept the lowest and
best proposal that may or may not necessarily be the lowest proposal.

The criteria for awarding a contract are outlined in Section 3, Paragraph 3.10 of this
document. The schedule for awarding the Contract is outlined in Section 2, Paragraph 2.4 of
this Document.
3.6.2. Investigations - The City of Marietta may make all investigations as it deems necessary
to determine the ability of the Provider to provide the goods or services required by this RFP.
The Provider shall furnish to the City of Marietta all such information and data for this purpose
as the City of Marietta may request. The City of Marietta reserves the right in determining the
lowest and best proposal, the degree to which the evidence submitted by, or investigations
of, such Provider satisfies the City of Marietta that such Provider is properly qualified to
perform the obligations required by this RFP.
3.6.3. All proposals shall be irrevocable for a period of thirty (30) days after opening, and if
the Provider is accepted, the Provider shall, within the thirty (30) days after receiving the
notice of acceptance of said proposal, enter into a contract in writing for the said material,
supplies or services required. A Provider who fails to execute a contract within thirty (30) days
of notification will be responsible for paying all damages and expenses accruing to the City
of Marietta by reason of the failure or refusal of the Provider to enter into the contract.
3.6.4. No proposal shall be considered as accepted nor any obligation assumed hereunder
by the City of Marietta, until such time as the City of Marietta may issue and deliver written
notice, addressed to the successful Provider at the address given on the proposal, of
acceptance of the proposal or award of a contract.
3.7. IDENTIFICATION OF RFP TERMS
City of Marietta reserves the right to waive any informality or other matters which, in City of
Marietta's opinion, do not effect the competitiveness of the proposal. However, a failure to
comply with the terms of the RFP may be considered by the City of Marietta in determining
whether to accept a proposal.
3.8. EVALUATION CRITERIA
The purpose of this RFP is to indicate certain minimum requirements. It is intended that the
City of Marietta will select the proposal which BEST meets its anticipated needs at the lowest
cost. In making the award of any contract, the City of Marietta's evaluation of the lowest
and best will include, but will not be limited to, the following criteria:
3.8.1. Overall responsiveness, viability and completeness of the proposal as well as the
likelihood that, in the City of Marietta's discretion, the proposal BEST meets or exceeds the
City of Marietta's specifications.
3.8.2. Provider's demonstrated experience with similar operations and references.
3.8.3. Proposal cost in relation to services provided.
3.8.4. Provider's financial ability to provide the requested services.
3.8.5. Provider's litigation and claim history whether from the operation of an aquatic center
or other operations of the Provider.

3.8.6. Any other factors considered relevant by the City of Marietta and demonstrated by the
proposal or investigation by the City of Marietta.
3.9. BONDS
Successful Provider will demonstrate ability to obtain adequate performance bonding for the
operation of the Marietta Aquatic Center under the terms of the final management
agreement.
3.10. CONSIDERATION
The consideration to be paid by the City of Marietta for the services set out in the
specifications will be included in appendix A. subject to such negotiation by the Provider and
as the City may deem appropriate. (Page 17).
4. SPECIFICATIONS
4.1. OPERATIONS OFAQUATIC CENTER
4.1.1. Duties and Responsibilities
Start-up - operator is to specify what steps will be taken in preparing the facility. Duties will
include, but not limited to: cleaning all aquatic features and cleaning of the bathhouses,
including scrubbing all floors with appropriate cleaners, washing down walls, cleaning all
toilets, sinks, shower stalls, mirrors, hand dryers, sanitary dispensers, toilet paper dispensers.
Duties will also include the daily management of the facilities during "Regular Hours of
Operation" and during "Additional Hours of Operation". Furthermore, duties will include the
supervision of facility, including providing instruction for the safe and proper use of all aquatic
equipment and apparatus to patrons. Additionally, duties will require providing instruction
concerning cleanliness and safety of facility area and equipment to patrons. Also the
Provider shall be required to implement rules, policies, and schedules. Furthermore, the
Provider shall maintain supervision of instructors. Additionally, the Provider shall develop
marketing incentive programs in cooperation with the City of Marietta to increase
membership and enhance participation. A brief daily report will be turned in the Safety
Service Director with the following: Previous day's attendance, previous day's repairs, repairs
that are needed, and any unusual incidents.
Chemicals - Operator shall be responsible for ordering and stocking an adequate quantity
of quality pool water sanitation chemicals for the entire pool season and facility each pool
season year. Operator shall also be responsible for ordering and adequately stocking all
cleaning supplies and equipment to operate the aquatic facility such as towels, brushes,
sponges, garbage bags, disinfectants and other janitorial items. Said pool water sanitation
chemicals and cleaning supplies and equipment shall be ordered in the name of the City of
Marietta. Said pool water sanitation chemicals and cleaning supplies and equipment shall
be supplied at the expense of The City of Marietta. The City of Marietta will specify the
company that will supply the pool water sanitation chemicals and cleaning supplies and
equipment for the Marietta Aquatic Center.
04.1.2. Operational dates and times for each pool season year
* Each "pool season year" shall commence fifteen (15) days prior to Memorial Day and
end fifteen (15) days after Labor Day.
* The Marietta Family Aquatic Center's "Regular Hours of Operation" shall be from 12:00
p.m. until 7:00 p.m. every day, except Thursday which will be 12 p.m. to 9 p.m..
* "Additional Hours of Operation". The City of Marietta Family Aquatic Center reserves
the right to extend hours beyond the regular business hours, as defined above, for
rentals and special events, which hours shall be covered by the staff of the Provider.
4.1.3. Times for Swimming Lessons/Special Events & Programs
Monday - Saturday, 8:00 am - 11:30 am
4.1.4. Recruiting and Training Personnel
a. All persons employed by the Successful Provider and the Successful Provider
itself must be licensed to do the work being performed in accordance with all federal
state and local laws or regulations. Successful Provider must be a licensed pool
operator (LPO).
b. The Successful Provider must explain the steps to be taken by the Successful
Provider as well as those licenses held by the Successful Provider to assure that only
properly qualified and certified persons perform services under the terms of this
contract.
c. In order to maximize the comfort and trust level of those persons using the pool,
Marietta residents will be actively recruited and appointed as employees of the
Successful Provider to the maximum extent possible. Additionally, steps will be taken
to insure that the opportunity for employment is made available to low and moderate
income people.
d. The Successful Provider shall employ only those who possess the required skills
and experience for each job classification.
e. A written, personnel policy shall be provided and approved by the Safety
Service Director of the City of Marietta. (Please submit policy/personnel manual.)
f. The Successful Provider's employees shall wear appropriate uniform apparel.
g. The Successful Provider must propose a procedure to resolve complaints
concerning the conduct of its employees by persons using the facility. The Safety
Service Director of the City of Marietta shall have authority to request that the
successful provider resolve any dispute which arises concerning employee conduct or
request that the Successful Provider remove an employee from his or her position at
the facility if a dispute is not adequately resolved to the satisfaction of the Safety
Service Director or their Designee.

4.1.5. Contract Term
The term of this contract shall be for one (1) year, to-wit: the 2026 pool season, and the 2027
pool season if the contractor so chooses. [For purposes of definition, a "pool season year"
shall be considered to commence fifteen (15) days prior to Memorial Day each calendar
year; and to end fifteen (15) days after Labor Day each calendar year.] The Provider shall
have the option to extend the contract for one additional "pool season year", to-wit, the
2027 season, under the same terms and conditions as the initial contract, upon the express
written agreement of the City of Marietta and the Provider. If the Provider elects to extend
the contract for the one (1) additional pool season year, the Provider shall provide the City of
Marietta with written notice of the Provider's intent to exercise its option to extend the
contract for the 2027 season, no later than thirty (30) days after Labor Day 2026. Likewise, the
City of Marietta shall provide the Provider with notice of its acceptance of Provider's election
to extend the contract within thirty (30) days of the City of Marietta's receipt of Provider's
election to extend. If the City of Marietta does not provide notice of acceptance to the
Provider, then this contract shall be deemed terminated.
4.1.6. Daily duties in opening and closing the Aquatic Center
A daily schedule for cleaning, opening, and closing the aquatic center and grounds shall be
proposed by the Successful Provider. The Successful Provider shall remove on a regularly daily
scheduled basis, all trash, garbage and debris from all areas of the facility.
Successful Provider will be responsible for placing all trash, garbage and debris generated by
the Successful Provider's operation in a trash container provided. All offices; manager's,
lifeguard's, front desk, first aid or counter areas shall be kept, at all times, clean and neat in
appearance.
4.1.7. All Personnel shall be employees of the Successful Provider.
4.1.8. All money collected from the aquatic center's operations (membership, daily admission
and concessions) will be deposited to the City of Marietta within twenty-four (24) hours of
receipt by the Successful Provider. All money will be collected by the Successful provider
electronically on devices installed by the City. The Successful Provider will be compensated
for aquatic center operations solely by invoices paid by the City of Marietta under the terms
and conditions of the contract. Successful Provider will use a method devised by the City of
Marietta to keep track of daily attendance.
4.1.9. The Successful Provider shall have the responsibility for ensuring that high standards of
sanitation, cleanliness and safety exist at all times. The Successful Provider shall adhere to all
applicable City, County, State and Federal laws concerning sanitation, water quality,
cleanliness and safety. A representative of the Marietta Health Department will be an
authorized inspector of the Successful Provider's responsible area regarding the cleanliness
and safety of the overall operation. They will report the results of their inspection to the
Safety Service Director who will initiate the appropriate action. The Successful Provider will
provide the City with all policies they will use during operations. A brief daily report will be
turned in the Safety Service Director with the following: Previous day's attendance, previous
day's repairs, repairs that are needed, and any unusual incidents. Daily chemical
testing/recording will be maintained by the successful provider and made available on
request of the City of Marietta.

4.1.10. Number of personnel on duty/Manager on duty Successful Provider shall maintain a
work force of sufficient size to handle the contract, and meet the required minimum lifeguard
standards, including reserve personnel to fill vacancies during absences because of illness,
