NOTICE is hereby given that sealed bids will be received by the Township Clerk of the Township of Millburn, in the County of Essex on October 27, 2026 at 11:00 AM, local prevailing time, and opened immediately thereafter for the:

Collection, Removal, and Disposal of Residential and Municipal Solid Waste 2027-2031

Bid Forms, Specifications, Terms and Conditions are on file with the Business Administrator’s Office of the Township of Millburn, 22 East Willow Street, Millburn, New Jersey 07041 and may be obtained between the hours of 8:30 AM and 4:30 PM, local prevailing time, Monday through Friday, holidays excluded. Notice of revisions or addenda to advertisements or bid documents relating to bids will be published on the Township of Millburn’s website at https://twp.millburn.nj.us/bids.aspx , no later than seven (7) days, Saturdays, Sundays and holidays excepted, prior to the date for acceptance of bids. Any requests for information or clarification must be received in writing via email by September 23, 2026 at 4:30 PM, local prevailing time. Bids to be considered must be submitted on the Township of Millburn Bid Proposal Form, and must be accompanied by a certified check, cashier’s check or bid bond in an amount equal to ten percent (10%) of the total bid, but not in excess of $20,000.00 (Bid Bond). Each bid must also be accompanied by a Consent of Surety by a surety company authorized to do business in the State of New Jersey and approved by the Township Committee, to the effect that it will furnish the bonds required by the specifications.

Bidders must also be registered with and approved by the NJ State Department of Environmental Protection (DEP) with the requisite Solid Waste Transporter License (A901) and the Certificate of Public Convenience and Necessity.

Bids must be made on Bid Proposal Forms to be furnished in the manner designated therein and required in the Specifications and must be enclosed in a sealed envelope bearing 1.) the name and address of the bidder and 2.) the bid title “COLLECTION, REMOVAL, AND DISPOSAL OF RESIDENTIAL AND MUNICIPAL SOLID WASTE 2027-2031” written on the outside, addressed to the Township Clerk, 22 East Willow Street, Millburn, New Jersey 07041. Sealed bid submissions shall contain: one (1) original printed bid proposal, two (2) printed copy bid proposals, and one (1) electronic copy provided on a flash drive.

All bid security, except the security of the three apparent lowest responsible bidders, shall be returned, unless otherwise requested by the bidder, within ten (10) days after the opening of the bids, Sundays and holidays excepted, and the bids of such bidders shall be considered withdrawn. Within three (3) days, Sundays and holidays excepted, after the awarding and signing of the contract and the approval of the Contractor’s Performance Bond, the bid security of the remaining unsuccessful bidders will be returned to them. The bid security of the successful bidder will be returned by mail within twenty-four hours after satisfactory delivery of the contract. If the successful bidder fails to make satisfactory delivery of the executed contract in the time stated hereafter, the bid security shall be forfeited by giving twenty-four hours’ notice in writing that the contract has not been delivered.

The successful bidder shall be required to furnish a Performance Material and Labor Bond in the amount of one hundred (100%) percent of said bid to cover all provisions on the specifications.

The bid bond will insure that if the contract is awarded, the bidder will enter into a contract with the Township and will furnish any other required security or insurance. Failure by the contractor to sign the contract or furnish a Performance, Material and Labor Bond shall be sufficient cause for annulment of the award. It is understood that the Bid Bond shall be forfeited to the Township of Millburn, New Jersey, as liquidated damages and not as penalty.

The Contractor shall not assign, transfer, convey, sublet or otherwise dispose of this contract or any part thereof to anyone without written, prior consent of the Township of Millburn, New Jersey.

If you, as the bidder, cannot meet our specifications please list any and all deviations on a separate sheet of paper and attach it to the bid proposal. Failure to do so may result in our rejecting your bid.

Bidders are required to comply with the requirements of P.L. 1975, c. 127.
