NOTICE OF LAND AVAILABLE FOR LEASE

City-Owned Property — Approximately 50.3 Acres

The City of Mineral Wells, Texas (the “City”) is accepting written proposals from persons or entities interested in leasing approximately 50.3 acres of City-owned real property located in Palo Pinto County, Texas (the “Property”).

Property Description

The Property consists of two adjoining tracts situated in the James Dimpkins Survey, Abstract 161, in Palo Pinto County, Texas, and is described in City records as follows:

TRACT ONE

BEING 49.4 acres of land out of the James Kimpkins 640 acre survey, Abstract 161, Patent 625, Volume 2 in Palo Pinto County, Texas described by metes and bounds as follows:

BEGINNING 347 varas North of the Southeast corner of the James Dimpkins Survey at a concrete monument for the Southeast Corner of the 49.5 acre tract of land;

THENCE with the East Line of the Dimpkins Survey North 581 varas to concrete monument for corner;

THENCE West 482 varas to concrete monument for corner;

THENCE South 581 varas to concrete monument for corner;

THENCE East 482 varas to the place of beginning.

TRACT TWO

BEING all that certain lot, tract or parcel of land lying and being situated in the County of Palo Pinto and the State of Texas and being a part of the James Dimpkins Survey of 640 acres, Abstract 161, Patent 624, Volume 2 and described by metes and bounds as follows:

BEGINNING at the Southwest Corner of a 39.5 acre tract deeded by Mattie Adkins to J. G. Shires out of said Dimpkins Survey by Deed recorded in Volume 201, Page 380 of the Deed Records of Palo Pinto County, Texas and the Northeast Corner of a 34.5 acre tract out of said survey in the name of Laura Blocker;

THENCE North with the West Line of the J. G. Shires 39.5 acre tract 30 feet to corner;

THENCE West 1170 feet to corner in the East Line of the right-of-way in the Mineral Wells Progress Road;

THENCE South with the East Line of said road 30 feet to corner in the North Line of the Laura Blocker 34.5 acre tract;

THENCE East with the North Line of said Blocker tract 1170 feet to the place of beginning.

Property Information and Proposed Use

The Property was historically used as a dump/landfill site and is offered for lease in its present “AS IS, WHERE IS” condition, with all faults. Any proposed use must comply with applicable laws, regulations, deed restrictions, easements, environmental requirements, and land-use limitations. Prospective lessees should conduct their own due diligence before submitting a proposal.

The City will consider proposals that identify a responsible and lawful use of the Property.  The City makes no representation or warranty regarding access, utilities, development potential, environmental condition, or suitability for any particular purpose.

Proposal Requirements

Proposals should include, at a minimum, the following information:

  • Name, address, telephone number, and email address of the proposer;
  • Description of the proposed use of the Property, including the anticipated commencement date and operating plan;
  • Requested lease term and any requested renewal options;
  • Proposed annual rent and payment schedule; and
  • Proposed responsibility for maintenance, security, insurance, taxes, utilities, and regulatory compliance.
Evaluation and Lease Conditions

The City may evaluate proposals based on the above identified proposal requirements.

Any lease will be subject to approval by the City Council, negotiation and execution of a written lease agreement, confirmation of appropriate insurance, completion of any due diligence required by the City, and compliance with all applicable laws. Unless otherwise approved in the final lease, the selected lessee will be responsible for all costs associated with its proposed use, due diligence, improvements, permits, utilities, operation, maintenance, and restoration of the Property.

The City reserves the right to reject any or all proposals; waive informalities or minor irregularities; request clarification or additional information; negotiate with one or more proposers; modify or discontinue the leasing process; and retain the Property. No proposal will create a binding obligation unless and until the City Council approves a lease and the lease is executed by all authorized parties.
