Bid Submission and Award Notification
The Owner intends to notify the selected firm in writing within ten (10) business days of the bid opening, provided an acceptable proposal is received. Bids submitted after the designated opening time will not be considered and will be returned unopened.
Cherokee Nation Businesses (CNB) aims to award the contract within thirty (30) days of the bid opening if a satisfactory bid is received. Winning bid(s) will be publicly posted. CNB reserves the right to issue a single award, multiple awards, or reject all bids.
All bids are subject to negotiation prior to award. Awards may be made without further discussion, so bidders should submit their most competitive offer in terms of price and technical merit. Any resulting contract will be governed by CNB’s Terms and Conditions.
Bid Requirements
Bids must include:
•        Hourly rate (if applicable)
•        Delivery schedule or completion timeline
•        Clear identification of any exceptions, substitutions, exclusions, additions, or qualifications
TERO Compliance
This procurement is subject to the regulations of the Cherokee Nation Tribal Employment Rights Office (TERO), which include:
•        A fee of 0.5% of the total contract award
•        Completion of a TERO Labor Agreement and payment of associated fees, if applicable
The awarded contract will be published on the Cherokee Nation’s procurement website. The contractor’s performance will be monitored, documented, and reported to the Cherokee Nation.
To receive TERO preferences under CNE’s procurement policies, TERO-certified bidders must submit a copy (front and back) of their TERO certificate with their bid. Failure to do so will result in disqualification from TERO preference consideration.
