Manchester Water Works, acting through its Board of Water Commissioners and in accordance with the
provisions of Manchester NH Code of Ordinances Chapter 39: Procurement Code, inclusive, seeks
Statements of Qualifications for services related to
2026 Trench Milling and Paving, and
Pavement Milling and Overlay
Sealed Statement of Qualifications will be received until 2:00pm prevailing time on Tuesday, February 10,
2026. Late submissions will not be accepted.
Interested companies may obtain copies of the Requests for Qualifications (RFQ) documents from the city
website: www.manchesternh.gov/bids
Questions regarding this request should be expressed in writing and directed to Jim Lavacchia, Distribution

The Board of Water Commissioners reserves the right to waive any irregularities, reject any or all proposals,
and to accept the proposal that appears to be in the best interest of Manchester Water Works. Failure to
submit all information called for may be sufficient grounds for disqualification.

REQUEST FOR QUALIFICATIONS
INVITATION AND INSTRUCTION TO INTERESTED FIRMS:
1.1 Manchester Water Works is now accepting Statements of Qualifications (SOQ)
for Trench milling & Paving and Pavement Milling & Overlay services related
to 2026 Construction Project Pavement Restoration.
MWW estimates 2,500 square yards of trench milling, binder and top pavement
restoration, 500 square yards of extra depth milling & binder, and 1,000 square
yards of bituminous concrete mill with 1-1/2” overlay pavement restoration on
several construction sites throughout the Greater Manchester NH Area may be
required during the 2026 construction season. The contractor shall supply all
labor, equipment and materials to satisfactorily restore all paving per
Manchester Water Works, Manchester Highway Department or each Town’s
Highway Department’s Specifications as appropriate.
This project is scheduled for a bid opening March 3, 2026, with anticipated
project start in April 2026 and continues with temporary paving from
November 2026 through April 2027.
Statements of Qualifications submitted for evaluation by interested firms shall be evaluated according
to the following criteria: a) Qualifications: b) Ability of professional personnel; c) Past record and
experience: d) Performance data on file; e) Willingness to meet time and budget requirements f)
equipment inventory, and g) Workload. Cost of the proposed project shall not be a factor in the
evaluation of firms. A separate Request for Proposal/Bid will be sent to those firms chosen in this
Invitation as step two in the process where cost will be the deciding factor.
1.2 Sealed Statement of Qualifications will be received at the Manchester Water Works office, 281
Lincoln Street, Manchester, New Hampshire, before or at 2 pm prevailing time Tuesday, February 10,
2026. Statement of Qualifications received after time and date set will be unopened.

and clearly marked

1.3 Questions and inquiries on the specifications of this RFQ shall be directed to: Jim

submitted by 4 PM Friday January 30, 2026.
1.4 Any information provided is not official unless reduced to writing by Manchester Water Works. Any
unauthorized contact with any other City of Manchester, or Manchester Water Works official or
employee in connection with this Request for Qualifications (RFQ) is prohibited and shall be cause for

disqualification of the Contractor. No questions or inquiries will be allowed beyond the pre-proposal
conference (if one is scheduled) date.
1.5 Careful attention must be paid to all requested items contained in this Request for Qualifications (RFQ).
Interested firms are invited to submit their Statements in accordance with the requirements of this RFQ.
Please read the entire package before submitting. Interested firms shall make the necessary entry in all
blanks provided for the responses.
1.6 The entire set of documents constitutes the RFQ. The Contractor must respond in total and in the same
numerical order in which the RFQ was issued. Contractor’s notes, exceptions, and comments may be
rendered on an attachment, provided the same format of this RFQ text is followed. All notes, exceptions
and comments shall be made in ink or be typewritten. Mistakes may be crossed out and corrections
typed or written in ink adjacent thereto and must be initialed in ink by the person signing the RFQ.
1.7 By submitting a Statement of Qualification, the Contractor acknowledges and agrees to be bound by
the terms and conditions of the solicitation. This RFQ document including all terms, conditions and
specifications contained herein shall become the basis of contract upon award by Manchester Water
Works. It is further agreed between the parties that any change of the contractual agreement must be
formalized by issuance of a written modification from Manchester Water Works.
1.8 Sealed Statements of Qualifications will be accepted in accordance with the instructions detailed. The
Contractor shall file all documents necessary to support its qualifications and include them in the
submittal. Interested firms shall be responsible for the actual delivery of SOQ’s during business hours
to the address indicated. It shall not be sufficient to show that the qualifications were mailed in time
to be received before the scheduled closing time for receipt of SOQ’s.

GENERAL PROVISIONS:
2.1 Each Statement of Qualification shall comply with all Federal, State & Local regulations concerning
Road Construction and Paving Services
The Contractor agrees to comply with all Manchester Water Works statutes, rules, and regulations
governing safe and healthful working conditions, including the Occupational Health and Safety Act
of 1970, 29 W.S.C. 650 et.seq., as amended. The Contractor also agrees to notify Manchester Water
Works in writing immediately upon detection of any unsafe and/or unhealthful working condition
at the job site. Submitting firm agrees to indemnify, defend and hold harmless Manchester Water
Works from all penalties, fines, or other expenses arising out of the alleged violation of said laws.
2.2 Failure to submit ALL forms and information required in this RFQ may be grounds for
disqualification.
2.3 Liability: Manchester Water Works is not responsible for any cost incurred in the preparation of this
RFQ.
2.4 Bribery Clause: By his/her signature, the Contractor certifies that no employee of his/hers, any affiliate
or Sub-Contractor, has bribed or attempted to bribe an officer or employee of Manchester Water
Works.
2.5 Ambiguity, Conflict or other Errors in the RFQ: If a Contractor discovers any ambiguity, conflict,
discrepancy, omission or other error in the RFQ, they shall immediately notify Manchester Water
Works of such error in writing and request modification or clarification of the document.
2.6 Cancellation: If the services to be performed hereunder by the Contractor are not performed in an
acceptable manner, Manchester Water Works may cancel this contract for cause by providing written
notice to the Contractor, giving at least thirty (30) days notice of the proposed cancellation and the
reason for same. During that time period, the Contractor may seek to bring the performance of service
here under to a level that is acceptable to Manchester Water Works, and Manchester Water Works
may rescind the cancellation if such action is in Manchester Water Works best interest.
A. Termination for Cause:
(1) Manchester Water Works may terminate a contract because of the Contractor’s failure to
perform its contractual duties.
(2) If a Contractor is determined to be in default, Manchester Water Works shall notify the
Contractor of the determination in writing, and may include a specified date by which the
Contractor shall cure the identified deficiencies. Manchester Water Works may proceed
with termination if the Contractor fails to cure the deficiencies within the specified time.
(3) A default in performance by a Contractor for which a contract may be terminated shall
include, but shall not be limited to:
(a) Failure to perform the contract according to its terms, conditions and specifications;
(b) Failure to make delivery within the time specified or according to a delivery schedule
fixed by the contract;
(c) The filing of bankruptcy petition by or against the Contractor; or
(d) Actions that endanger the health, safety or welfare of Manchester Water Works and its
customers.
