I. NOTICE

Invitation to Bid
2026 Hot Mix Asphalt Contract
Sealed bids for 2026 Hot Mix Asphalt will be received by Jefferson County Public Works (JCPW) located at
290 N 4000 E, Rigby, Idaho 83442 until 8:00 am (local time), Monday, March 23, 2026, at which time the
bids will be publicly opened at 10:00 am.
The Invitation to Bid (ITB) seeks competitive bids from qualified Firms to provide Hot Mix Asphalt Concrete
(HMAC) material.
All questions or clarifications concerning this Invitation to Bid or the content and requirements of the Bid
and Contract Documents must be submitted and received in writing by 4:00 PM on Wednesday, March 18,
2026. Bidders shall submit all inquiries regarding this Bid via email at mcarter@co.jefferson.id.us. Please
note the deadline for submitting inquiries. All answers to inquiries will be posted on the Jefferson County
Public Works webpage. It is the responsibility of the bidder to check the website for answers to inquiries.
JCPW will respond to questions and clarification requests requiring an addendum via a Final Addendum
issued to all Bid Holders on or before 4:00 PM on Thursday, March 19, 2026.
JCPW has prepared the Contract Documents and copies may be obtained from the Jefferson County Public
Works Office at 290 N 4000 E, Rigby, Idaho 83442. Please contact the office at 208-745-9224 for mailed
copies.
The ENVELOPE containing your bid must be sealed, show the Invitation to Bid Number, the date and time
of opening, and your company name. The envelop should be addressed as follows:

JCPW reserves the right to reject all bids or reject any bid not conforming to the intent and purpose of the
Contract Documents whenever such action appears to be in the best interest of JCPW. Award of a contract
pursuant to this procurement may be delayed, without penalty, for up to sixty (60) calendar days after the
date of bid.

III. INSTRUCTIONS TO BIDDERS
1. MULTIPLE DOCUMENTS TO MAKE UP ENTIRE AGREEMENT
Sections I through V, taken together, shall make up the entire Agreement between the Jefferson County
Public Works (JCPW) and the successful Bidder. The Bidder should carefully read and understand all these
documents. By signing and submitting the proposal in the Bid Form, the successful bidder agrees to abide
by the terms and conditions of the entire Agreement.

2. TERMS AND CONDITIONS
This formal bid document and subsequent Purchase Order, along with the Jefferson County Standard
Contract Terms and Conditions, which are attached hereto as Exhibit A and incorporated herein by
reference, are to be considered the County's sole terms and conditions. Bids submitted with any additional
terms and conditions may not be considered.
3. BASIS OF AWARD
Bids will be evaluated and awarded separately with respect to each bid item. Bids will be separately
awarded to the qualified bidder(s) submitting the lowest aggregate price complying with the bidding
procedures and meeting the specifications for the hypothetical quantities for each bid item as set forth
below. Such quantities are hypothetical and will be used for evaluation purposes only, and the County
reserves the right to purchase greater or lesser quantities as it deems in its best interest, throughout the
term of the contract. The bids will be evaluated for compliance with the specifications furnished by the
County.
4. DOCUMENT INTERPRETATION
All Bidders submitting a Bid shall have thoroughly examined all the content contained in the Invitation to
Bid (ITB) Documents. Should there be any doubt as to any meaning or intent of any ITB statement or
provision, the Bidder should submit their inquiries in writing as prescribed in the ITB Legal Notice. Any
interpretation that may alter or change the ITB Documents will be in writing, in the form of an Addendum,
which will be furnished to all bidders receiving the ITB Documents. JCPW will not be responsible for any
other explanation or interpretation of the ITB Documents. Bidders shall acknowledge all Addenda on the
Submittal Form with their Bid Documents or be deemed nonresponsive.
5. BIDDER UNDERSTANDING
Each Bidder must adequately inspect the ITB Documents and make themselves thoroughly familiar with
the content of the ITB Documents. It shall be the Bidder's obligation to verify, to their complete satisfaction,
all information contained in the ITB Documents.
The submission of a Bid Document will constitute an incontrovertible representation by the Bidder that (1)
the Bidder has been given adequate opportunity to be acquainted with the ITB Documents; and (2) the
Bidder has resolved to their satisfaction any questions regarding any perceived conflicts, ambiguities,
errors, and discrepancies contained within the ITB Documents.
6. PREPARATION OF BID
Bidders must provide all information in the form and in the format required in the ITB Documents, and submit
their Bid Document(s) by the date and time specified. If samples or supporting documentation are required,
such samples or documentation must be submitted with the Bid Document. If Addenda have been issued
concerning the solicitation, Bidders must acknowledge all Addenda as instructed. Failure to acknowledge
all Addenda as instructed will be a basis for rejecting the submission as nonresponsive.
Bidders shall sign their Bid Document in the space(s) provided therefore. If the Bidder is a corporation, the
legal name of the corporation shall be entered together with the original signature of an agent authorized
to sign contracts on behalf of the corporation. If the Bidder is a partnership, the true name of the firm shall
be entered together with the original signature of the partner(s) authorized to sign contracts on behalf of
the partnership.
All blank spaces in the Bid Document must be filled in, preferably in black ink or typewritten. No changes
may be made in the phraseology of the forms nor may the Bidder add any phraseology conditioning the
acceptance of the award. In case of a discrepancy between unit prices and total price, unit prices shall
govern.
A Bid Document may be deemed unresponsive if it contains omissions, erasures, alterations, or additions
of any kind not initialed by the Bidder signatory, or items which fail to conform to the conditions of the ITB
Documents.
