ADVERTISEMENT FOR BIDS
The Selectmen for the Town of New Canaan, Connecticut, will receive sealed
bids for "The Hauling and Disposing of Municipal Solid Waste which is
generated at the Town of New Canaan Transfer Station" until 10:00 a.m.
Local Time on Thursday, June 18th, 2026 at the Department of Public Works
Office, Town Hall, 77 Main Street, New Canaan, CT, 06840, at which time and
place all bids will be publicly opened and read aloud.
Contract documents are available at the Department of Public Works Office,
TOWN OF NEW CANAAN, Town Hall, 77 Main Street, New Canaan,
Connecticut 06840.
E-Mail bid requests and specific questions may be addressed to Don Smith,
Transfer Station Superintendent, at don.smith@newcanaanct.gov.
No bidder may withdraw his bid within 90 days after the actual date of the bid
opening.
The Town reserves the right to reject any and all bids or any part thereof, to waive
defects in the same, or to accept any proposal or any part thereof deemed to be in
the best interest of the Town of New Canaan, Connecticut.
All bidders are requested to note that the award of this Contract is subject to the
following conditions and contingencies:
1) The approval of such governmental agencies as may be required by
law.
2) The appropriation of adequate funds by the proper agencies.

REQUEST FOR PROPOSAL
For the
HAULING AND/OR DISPOSING
OF THE FOLLOWING MATERIALS
Municipal Solid Waste
1.0 GENERAL INFORMATION
1.1 INTRODUCTION
This Request for Proposals (RFP) was prepared to solicit proposals from
qualified responsible contractors to provide for disposal of the Town of New
Canaan's waste as listed above.
1.2 ISSUING OFFICE
This RFP is being issued by the Department of Public Works of the Town of
New Canaan hereinafter referred to as the "Town".

INCURRING COST
The Town will not be held responsible for any cost incurred by the Contractor for
work performed in preparation and production of a proposal or for any work
performed prior to the signing of a contract.
1.5 REJECTION OF PROPOSALS AND RIGHT TO NEGOTIATE PRICE.
After review of all factors, including terms and conditions, qualifications and
price, the Town reserves the right to accept or reject any and all bids or any part
thereof, or waive defects in the same, or accept any proposal or combination of
proposals deemed to be in the best interest of the Town. The Town also reserves
the right to enter into negotiations with the Contractors or the Contractor it
believes have submitted the most favorable proposal.
1.6 ADDENDA TO RFP
Amendments to this RFP may be necessary prior to the closing date and will be
furnished by mail to all prospective Contractors. Failure to acknowledge receipt
of amendments in accordance with the instructions contained in the amendment
may result in the proposal not being considered. For this purpose, prospective
Contractors are those firms who have been given or sent a copy of this RFP and
who have expressed, in writing, an interest in obtaining all amendments.
1.7 SUBMISSION OF PROPOSALS
An original, executed of this proposal shall be returned in a sealed envelope and
shall be labeled "Bid Proposal for the Hauling and Disposal of Waste Materials
for the Town of New Canaan "to the attention of:

E.S.T., June 18, 2026. And at 10:00 am, at which time and place all bids will be
publically opened and read aloud.

1.8 PROPRIETARY INFORMATION
The Town will not accept proposals containing proprietary or any other
information that the proposer does not want to have made public. Contractor will
observe that any proposal submitted to the Town may be subject to public review.
1.9 INDEPENDENT PROJECT COST DETERMINATION
By submission of an offer, the Contractor certifies, that in connection with his
procurement:
The costs in the offer have been arrived at independently, without consultation,
communication, or agreement, for the purpose of restricting competition, as to
any matter relating to such prices with any other Contractor or competitor.
The Contractor agrees that the prices quoted in the proposal will not change for a
period of ninety (90) days after the receipt date at the Department of Public
Works of the proposal;
Unless otherwise required by law, the costs which have been quoted in the
proposal have not been knowingly disclosed by Contractor and will not
knowingly be disclosed by the Contractor prior to award, directly or indirectly to
any other Contractor or to any competitor and;
No attempt has been made or will be made by the Contractor to induce any other
person or firm to submit or not to submit a proposal for the purpose of restrictive
competition.
No elected or appointed officials or employees of the Town shall benefit
financially or materially from any contract, which may result from this
procurement.

1.10 AVAILABILITY OF FUNDS
The contract award under this RFP is contingent upon such other Town boards
and agencies as may be required by law and the availability of funds to the
Department of Public Works for this project. In the event that funds are not
available, for any reason, any contract resulting from this RFP will become void
and of no force and effect.
1.11 TERMINATION FOR DEFAULT OR FOR THE CONVENIENCE OF
THE TOWN OF NEW CANAAN.
The Town may terminate performance under any contract resulting from this
RFP whenever the Town shall determine that termination is in the best interest of
the Town of New Canaan.
Termination will be effected by delivery to the contractor of a notice to terminate,
stating the date upon which the termination becomes effective.
Landfill or incinerator fee increases due to new or increased state or local taxes
may be grounds for termination of the contract by the Town unless all
appropriate Town boards and agencies consent to the increase.
1.12 AMBIGUITY IN THE REQUEST FOR PROPOSAL (RFP)
Prior to submitting a proposal, the contractor is responsible to bring to the
Town's attention any ambiguity in this RFP. Not to do so shall result in the
contractor forfeiting any claim for adjustment based on such ambiguity as should
have been noted by a prudent contractor.
1.13 OWNERSHIP INFORMATION
The Town shall have unlimited rights to use, disclose or duplicate for any
purpose whatsoever all information developed, derived, documented or furnished
by the Contractor under any contract resulting from this RFP.
1.14 CONTRACT AGREEMENT
The selected Contractor, if any, will be required to negotiate and sign a formal
written contract agreement with the Town.

1.15 INSURANCE REQUIREMENTS
The selected Contractor, (if any) will be required to deliver an insurance
certificate in amounts, companies, and terms acceptable to the Director of Public
Works of the Town and as further detailed in Section III, attached hereto.
1.16 PERFORMANCE BOND
The selected Contractor shall, prior to the signing of the contract, furnish the
Town with an executed Performance, Maintenance and Payment Bond issued by
a surety company authorized to do business in the State of Connecticut which is
acceptable to the Director of Public Works and which will be in force for the
duration of the contract for an amount equal to 1 year (estimated) value of the
contract.
1.17 PAYMENT OF INVOICES
Normally, if invoices are submitted in a timely fashion, the contractor shall be
paid every month. Invoices are subject to acceptance and approval by the Town
of New Canaan in accordance with certifications made by the Department of
Public Works on the basis of consistency with the contract and verification of the
weights.
1.18 INFORMATION ON CONTRACTOR' BACKGROUND
The Contractor shall include with his proposal the following information:
Lists of equipment available for this work along with descriptions
including age, condition, etc.
List of clients for whom similar services have been provided.
The names, addresses and phone numbers of at least three persons who are
familiar with services provided by your company to serve as references.

1.19 CONTRACTOR AFFILIATES
During contract negotiations, the preliminarily selected firm shall submit in
writing, names of all persons, concerns, institutions, or subcontractors that are to
be affiliated with the project in supplying equipment, services, financing, or that
in any other manner have an interest in the performance of this contract. During
the term of the contract, the contractor shall secure written permission and
promptly notify the Town of any changes, additions or deletions in said list of
names submitted prior to the award.
1.20 SUB-CONTRACTING OR TRANSFER OF CONTRACT AFTER
CONTRACT SIGNING
No portion of the total awarded contract shall be sub-contracted or transferred to
any other company or individual by the contractor without the prior written
approval by the Town of New Canaan. The Town reserves the right to
disapprove of such sub-contracting or transfer if, for any reason, it feels that it is
in the Town's best interest to do so.
1.21 CONSEQUENCES OF NON-PERFORMANCE
Severe consequences can result if material is not removed at the proper rate.
These consequences include emergency health conditions and jeopardy to the
efficient performance of the entire waste removal and disposal process. The
Town will be very closely scrutinizing proposals for the contractor's "fail - safe"
and backup systems.
The Town shall attempt to promptly notify the contractor, in writing, of any non-
performance activity on the part of the contractor. The contractor shall be
required to immediately comply with the request of the Town. If the contractor
fails to comply immediately, the Town has the right to terminate the contract and
collect the performance bond and/or claim damages and proceed with other legal
action against the contractor. Failure of the Town to give such notice, in a
specific instance, shall not compromise or diminish the Town's rights to give
such notice in the future.

The contractor will be required to notify the Town immediately of any event or
happening, which could jeopardize its ability to perform. In such a situation, the
contractor will specifically inform the Town of all preparations it is taking to
avoid or minimize the potential consequences of such jeopardy. Failure to make
such prompt notification may be deemed to constitute non-performance of
contract.
Should the contractor, at any time, refuse or neglect to supply properly skilled
workmen, vehicles, equipment, etc., suitable and necessary for the execution of
this proposal, and of the proper type and quantity, or shall become insolvent or be
declared bankrupt, the Town shall be able to hire another contractor to continue
to perform the necessary work. The Town shall be at liberty, immediately in an
emergency or, if not an emergency, three days after service of a written notice of
the Town's intention to terminate this agreement and for the purpose of
completing any unfinished work undertaken by the Contractor and to provide the
equipment, and pay such expenses caused by such refusal, neglect, failure,
insolvency, or bankruptcy, to deduct the expense incurred therefore from any
money then due or to become due to the contractor under this contract.
1.22 CONTRACT PERIOD
The intended contract period will be for three years term starting July 1, 2026
and ending June 30th 2029.
1.23 BID SECURITY
A bid security in the amount of ten percent (10%) of the bid proposal amount for
the first year of the proposed contract shall accompany each bid. It shall be in the
form of a certified check or a bid bond made payable to the Town of New
Canaan, New Canaan, CT. Bid Bonds shall be executed on AIA Document A310
issued by a surety company licensed in the State of Connecticut. Such surety
shall be posted with the bid proposal, thereby agreeing that the posted value is to
be forfeited to the Town by the bidder if the Contractor refuses to undertake a
contract for services upon acceptance of the proposal by the Town.

SECTION II - SCOPE OF SERVICES
The Town of New Canaan is seeking proposals from qualified and experienced
firms for providing the services described herein.
2.0 Municipal Solid Waste (MSW)
The Town will load the MSW into 100-yard trailers supplied by the contractor,
and the contractor will be responsible for providing the disposal site and an
alternate back-up site for the safe hauling of the MSW to those sites.

2.1 General Contractor responsibilities relative to MSW
a) Provide a yard horse and all labor, equipment, containers and vehicles
required to receive and haul the Town's MSW to the contractor's
disposal site on a daily basis and continuous basis and provide for
cleaning, maintenance, repair and insure of same. Transfer Station
hours presently are from 7:30 am to 3:00pm Monday through Friday
and 7:30 am to 2:00pm on Saturdays. All hauling must be done within
this time period.
b) Provide properly licensed disposal facility along with a back-up site
capable of accepting MSW at all times, during the terms of this
contract.
c) Secure all necessary and required permits for the hauling and disposal
activities.
d) Assure that the equipment, containers, and the vehicles they provide
can be accommodated at the Transfer Station without structural changes
to the facility.
e) Provide a list of all equipment containers and vehicles available for use
on this project including make, model, year and type.
f) Contractor will invoice the Town monthly. Such billings are to reflect
the combined per ton hauling and disposal costs Weight tickets are to
be handed in daily.
g) It is the responsibility of the contractor to provide an empty 100-yard
trailer in place, available for loading at all times. These trailers must be
equipped with covers, which can be safely operated.
