SECTION 01 - INTRODUCTION
A. INTRODUCTION
Pursuant to Education Code section 17250.10 et seq. the Baldwin Park Unified School
District Board of Education has approved the use of design-build construction delivery
method to perform comprehensive evaluations and assessments of its existing facilities and
equipment to determine if: any noncompliant plumbing fixtures and appliances that fail to
meet water efficiency standards need replacement; and if there is any other work that is
eligible for funding under the California Schools Healthy Air, Plumbing, and Efficiency
Program (CalSHAPE) Agreement No. 22R3PA1472 program that can be performed by the
District (collectively, “Assessment Plan”). The Assessment Plan shall be performed in
accordance and in compliance with all applicable funding guidelines under AB-841 and the
CalSHAPE program. Based on the Contractor’s Assessment Plan, it shall prepare a
detailed implementation plan of all required work that is eligible for CalSHAPE funding
(“Implementation Work”) for the District’s review and written approval. Once the District has
agreed to the Contractor’s scope of the Implementation Work, the Contractor shall provide
and furnish any and all labor, materials, tools, equipment, and utility and transportation
services necessary to perform complete the approved Implementation Work in a
workmanlike manner. All services and related work to prepare the Assessment Plan and
perform the Implementation Work shall be referred to collectively as the “Project.”
The Baldwin Park Unified School District (“District”) has established a procedure to
prequalify design-build entities using this Request for Qualifications (RFQ) in order to
prequalify, or develop a shortlist of, design-build entities in accordance with Education Code
section 17250.25 (b) whose proposals shall be evaluated for final selection under a separate
Request for Proposal (RFP) process. The documents required pursuant to this RFQ must
be completed by the “design-build entity” and all applicable members of the “design-build
team” (as these terms are defined in Education Code section 17250.15), verified under oath.
All required information and documents to be submitted in accordance with this RFQ shall
be the design-build entity’s Statement of Qualifications (“SOQ”). Design-build entities must
submit a complete SOQ containing all information and documents requested for review and
consideration by the District.
The District will award a contract to the design-build entity that provides the “best
value” (as defined in Education Code section 17250.15) to the District using the criteria set
forth in this RFQ and a subsequent RFP to be issued by the District. Once a design-build
entity is successfully prequalified and shortlisted in accordance with this RFQ, it will be invited
to submit a proposal to the District in response to a RFP that will be issued by the District for
the Project. The District reserves its right to conduct interviews with the design-build entities
that provide the highest best value as determined by the District.
Pursuant to Education Code section 17250.25, procurement of a design-build entity
will follow two (2) phases:
1. Prequalification: Use this RFQ to create a shortlist of design-build entities for
the RFP. Only those short-listed design-build entities will receive invitations to
submit a response to the RFP documents.

2. Selection of Design-Build Entity: Use of a RFP describing the Project for a
competitive procurement by the District to select the design-build entity.
a. The numerical score from this RFQ will not carry over to the RFP scoring
criteria.
b. The RFP selection will use a “best value” approach for the selection of
the design-build entity.
All documents provided in response to this RFQ that are not otherwise a public record
under the California Public Records Act (Chapter 3.5 (commencing with Section 6250) of
Division 7 of Title 1 of the Government Code) shall not be open to public inspection.
B. REQUEST FOR STATEMENT OF QUALIFICATIONS FROM DESIGN-BUILD
ENTITIES
Notice is hereby given that the Baldwin Park Unified School District (“District”) requires
all design-build entities wishing to submit a proposal for the Project must be prequalified by the
District prior to submitting a proposal. It is mandatory that all design-build entities who desire to
submit a proposal fully complete the prequalification questionnaire in Attachment “A”, provide all
materials requested herein, and be approved by the District to be on the final prequalified list. No
proposal will be accepted from a design-build entity that has failed to comply with these
requirements and be listed on the District’s final prequalified list.
Answers to all questions contained in this RFQ, with accompanying notes and
supplemental information, are required. The District will use these documents as the basis of
rating each design-build entity. The District reserves the right to check other sources available.
The District’s decision will be based on objective evaluation criteria as set forth in this RFQ. The
District reserves the right to adjust, increase, limit, suspend or rescind any scoring in this RFQ
based on subsequently learned information.
Each SOQ must be signed under penalty of perjury in the manner designated on the forms
included in this RFQ by members of the design-build team as noted. If any information provided
by a design-build entity becomes inaccurate, the design-build entity or any member of the design-
build team must immediately notify the District and provide updated accurate information in
writing, under penalty of perjury. RFQ documents can be found at the District website at:

The District reserves the right to waive minor irregularities and omissions in the information
contained in any submitted SOQ, the prequalification process, and to make all final
determinations.

materials are not provided, or where a SOQ is not timely or fully submitted to the District by the
deadline.
C. DISTRICT NOT RESPONSIBLE FOR PREPARATION COSTS
All costs incurred in the preparation, submission and/or presentation of design-build
entities responding to this RFQ or any subsequent request for proposal including, but not limited,
to proposal materials, travel expenses to attend any pre-conferences, presentations, interviews,
and negotiation sessions, shall be the sole responsibility of the design-build entity and will not be
reimbursed by the District. The District shall not pay for any costs incurred as a result of termination
of this RFQ. By submitting a SOQ, the design-build entity agrees and acknowledges that it will not
be entitled to any payment or costs for any work or services without entering into a written design-
build contract approved and ratified by the District’s governing Board of Education.

estimates and are subject to change in the District’s sole discretion.
