The vendor will be held to the requirements of F.O.B. Destination as set
forth in the Commonwealth of Pennsylvania Terms and Conditions. The
vendor may quote shipping costs, but it must be listed on a separate
line item in the quote. The awarded vendor will be paid for the total line
items on the quote.

Please include delivery lead-time with your quote submission. The federal homeland
security grant funding being used for this project expires soon and requires delivery no
later than August 30, 2026.
Substitutions Allowable:
Substitution with an approved equal item is allowable.
Any reference to a particular manufacturer’s product either by trade name or by limited
description is solely for the purpose of more clearly indicating the minimum standard of
quality required.
The term “approved equal” is defined as meaning any other make which, in the sole
opinion of the purchaser and the end recipient/subject matter expert (SME), is of such
character, quality, and performance equivalence as to meet the standard of quality of
products other than the referenced product shall:
a) furnish complete identification in its quote of the product it is offering by
trade name, brand and/or model number;
b) furnish descriptive literature and data with respect to the substitute product it
proposes to furnish; and
c) indicate any known specifications deviations from the referenced product.
If an item or part number has been discontinued, please notate in your response and/or
provide the manufacturer’s replacement part/part number. If there is not a
replacement part, you may submit a quote without that item(s).
NDAA
If substituting from the original equipment requested, please provide certification that
the product(s) you are quoting are compliant with the rules/regulations of the National
Defense Authorization Act.
The prohibition regarding certain telecommunications and video surveillance services or
equipment is mandated by section 889 of the John S. McCain National Defense
Authorization Act for Fiscal Year 2019(FY 2019 NDAA), Pub.L. No. 115-232 (2018).
Per section 889(f)(2)-(3) of the FY 2019 NDAA, covered telecommunications equipment
or services means:
1. Telecommunications equipment produced by Huawei Technologies Company or ZTE
Corporation, (or any subsidiary or affiliate of such entities);

2. For the purpose of public safety, security of Government facilities, physical security
surveillance of critical infrastructure, and other national security purposes, video
surveillance and telecommunications equipment produced by Hytera Communications
Corporation, Hangzhou Hikvision Digital Technology Company, or Dahua Technology
Company (or any subsidiary or affiliate of such entities);
3. Telecommunications or video surveillance services provided by such entities or using
such equipment; or
4. Telecommunications or video surveillance equipment or services produced or
provided by an entity that the Secretary of Defense, in consultation with the Director of
National Intelligence or the Director of the Federal Bureau of Investigation, reasonably
believes to be an entity owned or controlled by, or otherwise connected to, the People’s
Republic of China.
