Description:

The County of Lake is inviting sealed proposals for the Clover Creek Diversion Channel Habitat Enhancement Project. The Lake County Watershed Protection District is seeking a qualified contractor to perform vegetation removal, sediment removal, and associated channel maintenance within the Clover Creek Diversion Channel near Upper Lake, California. This work is part of the Clover Creek Hitch Habitat Restoration Project that was outlined in a Habitat Mitigation and Monitoring Plan (HMMP) prepared by Caltrans to fulfill compensatory mitigation requirements for Caltrans’ Blue Lakes Safety Project along Highway 20 in Lake County. This restoration project is intended to improve habitat for State-listed threatened Clear Lake hitch and provide broader ecological benefits within the Clover Creek–Middle Creek watershed. The anticipated budget for this project is approximately $125,000.

The Clover Creek Diversion Channel is a perennial waterway bounded by levees that drains to Middle Creek, Rodman Slough, and ultimately, Clear Lake. The diversion channel was completed in 1966 as part of the larger Middle Creek Flood Control Project and diverts most water during peak flow times away from the historic Clover Creek channel in order to provide flood protection for the town of Upper Lake. The HMMP identifies accumulated sediment and vegetation overgrowth as existing impairments to the channel within the project area. Sediment accumulation has raised channel bottom elevations, contributed to flooding risk, and reduced native-species habitat, while invasive vegetation, such as Himalayan blackberry and poison hemlock, has become established throughout portions of the riparian corridor.

The project will be managed by the Lake County Watershed Protection District, hereinafter referred to as the ‘District'. Tribal cultural resources monitoring will be conducted during ground-disturbing activities associated with project work.

The District will recruit, following local purchasing policy requirements, a qualified company or firm to lead and facilitate the project. The selected company or firm will work closely with District staff to temporarily divert flows within the Clover Creek Diversion Channel, remove vegetation, and excavate accumulated excess sediment from the channel.  Work will occur along an approximately 0.9-mile stretch of the Clover Creek Diversion Channel upstream of its confluence with Middle Creek, as shown in Figure 1. Final limits will be established by the County in the field.

Proposals should be submitted in accordance with the requirements of this solicitation, which are contained herein.

Clover Creek Diversion Channel Habitat Enhancement Project
1. INTRODUCTION
The County of Lake is inviting sealed proposals for the Clover Creek Diversion Channel Habitat
Enhancement Project. The Lake County Watershed Protection District is seeking a qualified
contractor to perform vegetation removal, sediment removal, and associated channel maintenance
within the Clover Creek Diversion Channel near Upper Lake, California. This work is part of the Clover
Creek Hitch Habitat Restoration Project that was outlined in a Habitat Mitigation and Monitoring Plan
(HMMP) prepared by Caltrans to fulfill compensatory mitigation requirements for Caltrans' Blue
Lakes Safety Project along Highway 20 in Lake County. This restoration project is intended to improve
habitat for State-listed threatened Clear Lake hitch and provide broader ecological benefits within
the Clover Creek-Middle Creek watershed. The anticipated budget for this project is approximately
$125,000.
The Clover Creek Diversion Channel is a perennial waterway bounded by levees that drains to Middle
Creek, Rodman Slough, and ultimately, Clear Lake. The diversion channel was completed in 1966 as
part of the larger Middle Creek Flood Control Project and diverts most water during peak flow times
away from the historic Clover Creek channel in order to provide flood protection for the town of
Upper Lake. The HMMP identifies accumulated sediment and vegetation overgrowth as existing
impairments to the channel within the project area. Sediment accumulation has raised channel
bottom elevations, contributed to flooding risk, and reduced native-species habitat, while invasive
vegetation, such as Himalayan blackberry and poison hemlock, has become established throughout
portions of the riparian corridor.
The project will be managed by the Lake County Watershed Protection District, hereinafter referred
to as the 'District'. Tribal cultural resources monitoring will be conducted during ground-disturbing
activities associated with project work.
The District will recruit, following local purchasing policy requirements, a qualified company or firm
to lead and facilitate the project. The selected company or firm will work closely with District staff to
temporarily divert flows within the Clover Creek Diversion Channel, remove vegetation, and excavate
accumulated excess sediment from the channel. Work will occur along an approximately 0.9-mile
stretch of the Clover Creek Diversion Channel upstream of its confluence with Middle Creek, as
shown in Figure 1. Final limits will be established by the County in the field.
Proposals should be submitted in accordance with the requirements of this solicitation, which are
contained herein.

2. SCOPE OF SERVICES
The selected company or contractor will develop and perform a series of tasks to support the Clover
Creek Diversion Channel Habitat Enhancement Project. The scope of services shall include, at a
minimum, the following components listed hereafter, each integral to the successful execution of
the Project. It is anticipated that completion of tasks will require one month or less. As-built design
documents for the Clover Creek Diversion Channel will be made available upon request.
Task 1 - Mobilization, Site Preparation, and Access
The Contractor shall mobilize all labor, equipment, materials, temporary facilities, and erosion and
sediment control measures necessary to complete the work. The Contractor shall coordinate access,
staging, equipment movement, and work limits with the District prior to beginning work. Equipment
and operations shall be confined to approved access routes, staging areas, and work limits to
minimize disturbance to levees and adjacent properties. Under direction provided by District, the
Contractor shall comply with all applicable environmental permits1, avoidance and minimization
measures, cultural-resource requirements.
1 Acquisition and completion of all necessary environmental and regulatory permits are responsibility of
District, not contractor.

Task 2 - Temporary Water Diversion and Cofferdam
Prior to vegetation or sediment removal within wetted portions of the Clover Creek Diversion
Channel, the Contractor shall furnish, install, maintain, and subsequently remove a temporary
cofferdam and associated water-control measures sufficient to isolate the active work area.
When possible, the temporary diversion system shall redirect flow from the Clover Creek Diversion
Channel into historic Clover Creek for the duration of in-channel work. The Contractor shall be
responsible for maintaining continuous and controlled conveyance of streamflow, preventing
uncontrolled releases into the active work area, minimizing turbidity and erosion, and maintaining
the diversion system throughout construction.
The Contractor shall provide all pumps, piping, temporary barriers, erosion protection, energy
dissipation, and other incidental materials necessary to safely establish and maintain the diversion.
Upon completion of in-channel work, the Contractor shall remove temporary diversion facilities and
restore affected areas to a stable condition.
Task 3 - Invasive Vegetation Removal
The Contractor shall remove all vegetation within the limits identified by the District. Removal
methods may include hand cutting, mechanical removal, grubbing, or other District-approved
methods appropriate to site conditions. Removed vegetation, roots, seeds, and other biomass
capable of propagating shall be collected and transported to an approved disposal location or
otherwise managed as directed by the District. Equipment shall be cleaned before entering and
leaving the project area as necessary to prevent the introduction or spread of invasive species.
Task 4 - Sediment Removal and Channel Restoration
Following establishment of the temporary water diversion and completion of vegetation clearing
necessary for access, the Contractor shall excavate accumulated sediment from designated portions
of the Clover Creek Diversion Channel. The work is intended to lower areas of elevated channel bed,
improve channel conveyance, reduce sediment-related flooding, and enhance aquatic and riparian
habitat consistent with the HMMP.
The Contractor shall excavate only within limits and to elevations established by the District and
shall avoid unnecessary disturbance to existing channel banks, levees, and habitat features outside
the project area. Excavated material shall be retained by the contractor and loaded, transported,
stockpiled, sorted, reused, or disposed of at location(s) approved by the District.
Because sediment removal constitutes ground-disturbing activity within an area of cultural
sensitivity, the District and the Contractor will coordinate excavation with required monitoring of
tribal cultural resources (TCRs).
Task 5 - Demobilization and Site Restoration
Upon completion of sediment and vegetation removal, the Contractor shall remove the cofferdam,
temporary diversion facilities, construction debris, excess materials, temporary erosion-control
measures no longer required, and equipment from the project area. Streamflow shall be returned
to the Clover Creek Diversion Channel in a controlled manner and only after authorization from the
District.

Clover Creek Diversion Channel Habitat Enhancement Project
All areas disturbed by construction access, staging, vegetation removal, sediment handling, and
temporary water diversion shall be stabilized and restored as directed by the District. The Contractor
shall leave the project area in a clean, stable condition suitable for subsequent native revegetation,
maintenance, and habitat monitoring activities required under the HMMP.

5.3 A Consultant Selection Board may be convened to review, discuss and rank the proposals,
using the following criteria:
A. Criteria
a. Candidate's technical competence and ability to meet the requirements of the Scope of Services
in a timely fashion.
b. Candidate's past record of performance, including control of costs and quality of work.
c. Candidate's familiarity with the problems applicable to the project.
5.4 Prior to final selection, a short list of qualified and responsive Consultants may be requested
to participate in an interview. The purpose of the interview will be to provide an opportunity for
each Consultant to present their qualifications and proposals in person and/or to answer any
questions that County staff may have regarding the Consultant's submittals. If interviews are to
be held, the time and place of the interview will be arranged after the short list is completed.
Typically, a minimum of three (3) proposals will be selected for the Short List; however, the
County may, at its option, choose to interview more or less than three (3) qualified Consultants
or select consultants based solely on evaluating written proposals.
5.5 If an agreement cannot be reached with the top ranked Consultant(s), the County will then
contact the next highest ranked firm and attempt to negotiate a contract scope of work and fee.

of Disability Employment Policy.
6. PROTEST PROCEDURE
The County of Lake will follow the Appeal Procedure in their Consultant Selection Policy as
follows:
6.1 Appeal Procedure:
Any party with a direct financial interest who is aggrieved by any alleged material irregularity in
connection with the intended RFP award, may file a protest with the Purchasing Agent or
Assistant Purchasing Agent, where such protest is based on alleged violations of Federal, State,
or local law or ordinance, or alleged material irregularity in either the County's RFP invitation or
in the proposal to which an award is intended. Generally, non-material irregularities in a RFP
response are those that substantially conform to the RFP requirements and do not affect the RFP
price, time or conditions in such a way as to affect the amount of the RFP or provide a competitive

advantage or benefit not allowed to other bidders. Material irregularities in a RFP invitation
provide a competitive advantage or benefit to one (1) bidder that is not enjoyed by other bidders.
The Purchasing Agent or Assistant Purchasing Agent may determine whether an alleged
irregularity exists and whether it is material or non-material and shall have the authority to waive
non-material irregularities. A RFP protest must:
(a)Be written,
(b)State the specific alleged violation of law or alleged material irregularity,
(c)Request a determination of the appeal,
(d)Provide a telephone number and email address at which the appellant can be contacted,
(e)Be filed no later than seven (7) days after the date of the Notice of Intent to Award Letter
and/or formal Bid Opening (holidays excepted). Any protest filed after this time will not be
considered.
6.2 The party filing the appeal ("appellant") must concurrently transmit a copy of all appeal
documents and any attachments to all other parties with a direct financial interest which may be
adversely affected by the determination of the appeal.
6.3 Within seventy-two (72) hours of receipt of appeal, the Purchasing Agent or Assistant
Purchasing Agent shall provide written notification to the appellant of the determination. A
determination under this procedure shall be final except that the Purchasing Agent's decision
may be appealed to the County Administrative Officer in writing within forty-eight (48) hours
from the Purchasing Agent's or Assistant Purchasing Agent's notification to appellant.

By your submission of a proposal, you agree to be bound by the following conditions:
7.1 To the fullest extent allowed by law, RFP's will not be public record until discussion and
negotiations with Respondent have been completed, as such premature disclosure would

pages with a stamped annotation such as: "CONFIDENTIAL-PROPRIETARY TRADE SECRETS, DO NOT
DISCLOSE", and further, provide written notification to the County of its request to keep said
