The Subject contract proposal contains the following addendum:
1- The completion date on page G-2 has changed. Replace page G-2 in the
proposal with the attached.
2- Add the attached Impact Attenuator Units, Type TL-3 Special Provision.
3- The bid form has been edited. Replace with the attached revised bid form.
4- The plan set has been edited. The old plan set on the NCDOT letting site has
been replaced with a revised plan set.

Before any construction material or manufactured product is eligible for payment, the Contractor
shall submit a certification from the manufacturer or supplier confirming compliance with the
BABA Act and applicable regulations. A separate certification is required for each shipment or
delivery and must clearly identify the items covered, linked to the associated bill of lading, invoice,
or packing list.
The Contractor shall ensure that certifications from the manufacturer or supplier are obtained and
submitted to the Engineer for all construction materials and manufactured products permanently
incorporated into the work. Compliance with BABA requirements is the responsibility of the
manufacturer or supplier. The Engineer will retain documentation for audit or inspection purposes.

The date of availability for this contract is April 6, 2026, except that work in jurisdictional waters
and wetlands shall not begin until a meeting between the DOT, Regulatory Agencies, and the
Contractor is held as stipulated in the permits contained elsewhere in this proposal. This delay in
availability has been considered in determining the contract time for this project.
The completion date for this contract is December 24, 2027.
Except where otherwise provided by the contract, observation periods required by the contract will
not be a part of the work to be completed by the completion date and/or intermediate contract times
stated in the contract. The acceptable completion of the observation periods that extend beyond
the final completion date shall be a part of the work covered by the performance and payment
bonds.
The liquidated damages for this contract are Two Hundred Dollars ($ 200.00) per calendar day.
These liquidated damages will not be cumulative with any liquidated damages which may become
chargeable under Intermediate Contract Time Number 1.

Except for that work required under the Project Special Provisions entitled Planting, Reforestation
and/or Permanent Vegetation Establishment, included elsewhere in this proposal, the Contractor
will be required to complete all work included in this contract and shall place and maintain traffic
on same.
The date of availability for this intermediate contract time is April 6, 2026.
The completion date for this intermediate contract time is June 25, 2027.
The liquidated damages for this intermediate contract time are One Thousand Six Hundred
Dollars ($ 1,600.00) per calendar day.
Upon apparent completion of all the work required to be completed by this intermediate date, a
final inspection will be held in accordance with Article 105-17 and upon acceptance, the
ADDENDUM #1 ISSUED: 02/12/2026
IMPACT ATTENUATOR UNITS, TYPE TL-3___:

Description
SP8 R75
Furnish and install impact attenuator units and any components necessary to connect the impact
attenuator units in accordance with the manufacturer’s requirement, the details in the plans and at
locations shown in the plans.
Materials
Furnish attenuator units listed on the NCDOT APL. Units shall not be modified by the
manufacturer and installer once approved and on the NCDOT APL.
Prior to installation the Contractor shall submit to the Engineer certified working drawings and
assembling instructions from the manufacturer for each impact attenuator unit in accordance with
Article 105-2 of the Standard Specifications.
Construction Methods
Perform installation in accordance with the plans and details and assembling instructions furnished
by the manufacturer.
Measurement and Payment
Impact Attenuator Unit, Type TL-3 will be measured and paid at the contract unit price per each.
Such prices and payment will be full compensation for all work covered by this provision
including, but not limited to, furnishing, installing and all incidentals necessary to complete the
work.
