Scope of Services
1.0        PURPOSE

A.        This document shall serve to provide interested parties with specific information as to the Procedures for Selection of multiple Engineering Firms where the method of compensation is a Negotiated Fee on a Guaranteed Maximum Price. Pursuant to Chapter 1013, Florida Statutes, the Florida Consultant’s Competitive Negotiation Act, Section 287.055 Florida Statutes, and Rule 6A-2.0010, Florida Administrative Code, the School District of Osceola County, Florida will consider the contracting with multiple firms to provide civil engineering services on an as-needed basis as outlined in the Scope of Services.
B.        In determining whether a firm is qualified, the School District of Osceola County, Florida shall consider such factors as supporting office location(s), experience and past performance, proposed project staff and functions, project approach, scheduling methodology, and references.
2.0        SCOPE OF SERVICES
DESCRIPTION OF SERVICES

The Consultant shall perform the services described herein, and other required professional services on an “as needed” basis, as designated, authorized, and assigned by School Board, and School Board agrees to compensate Consultant for such services in accordance with this Contract. Anticipated services may include, but not be limited to the following:
1.        Review and comment on Educational Specifications, and/or District Design Standards, design submittals, and construction documents prepared by other consultants.

2.        Review, inspect, and report on specific areas of construction when requested.

3.        Provide support with school site analysis, educational specification preparation, construction project budgeting, etc.

4.        To investigate, identify, analyze and make recommendations with costs for specific school facility problems or needs assigned on a project-by-project basis.

5.        Provide technical support by the use of other consultants when specialized areas of expertise are needed.

6.        Provide technical support in Civil Engineering matters to the Facilities Division and Maintenance Department.

7.        Archeological Studies or site evaluations.

8.        Geotechnical field exploration services.

9.        Preparation and coordination of submittals that may be required for local governmental approval of educational facilities.

10.        Street, site, parking, and athletic lighting design.

11.        Structural design (bridges, etc.).

12.        Signalization design or other traffic engineering services not specifically stated.

13.        Planning, design, or permitting off-site improvements.

14.        Plan review or permit application.

15.        Permit modifications due to School District requested plant revisions.

16.        Services required by additional governmental regulations that might be put into effect after the date of this agreement.

17.        Observation of water and sanitary sewer construction.

18.        Project Coordination- Coordinate efforts with the School Board’s Representative and Contractor, as required by the scope of each assigned project.

19.        Meetings and Coordination- Meeting attendance by the Project Engineer or appointed representative, as required by the School Board Representative.

20.        Site Civil Engineering- Prepare complete plans including, grading and horizontal control, drainage, utility and appropriate details for the School District of Osceola County, Florida site improvements.

21.        Provide required detailed design and calculations for storm water permitting through Federal, State and Local Governments.

22.        Attendance at fire hydrant testing.

23.        Attendance at Development Review Committee (DRC) and other local governmental meetings, as necessary.

24.        Environmental Services may be required to include phase I & II environmental assessments, wetlands delineation, and surveys for threatened and/or endangered species, permit and remediation/mitigation/relocation fees.

25.        Final site design will include on-site improvements and may require off-site improvements based on project requirements.

26.        Traffic Impact Analysis- Projects may require an additional Traffic Impact Analysis of intersections during the peak a.m. and p.m. hours.

27.        Landscape and Irrigation Design- Prepare landscape plans for submittal to Osceola County Technical Review for Development Preliminary Review. Incorporate applicable review comments and submit the landscape and irrigation design with the Final Site Development Package as required.

28.        Perform Construction Administration to include shop drawing review and answers to Requests for Information.

29.        Attend pre-development and pre-construction conference and inspections, as required by permitting and local governmental agencies

30.        Attend on-site construction coordination meetings with Contractor and the School Board Representative.

31.        Provide field review assessments at intervals appropriate to the progress of construction in sufficient frequencies to allow the engineer to document construction activities as required, or as directed by the School Board Representative.

32.        Revise construction plans to reflect record data based upon information provided by the site contractors and surveyors.

33.        Prepare utility clearance for use documents.

34.        Certify completion of construction based on Engineer’s information, knowledge and belief resulting from the Scope of Services.

35.        Provide cost reviews for change orders to ensure costs/credits submitted by Contractor for changes are fair and reasonable and using the correct quantities associated with the changes in scope.

36.        Review the Contractor’s application for payment; certify the amounts due the Construction Contractor; and sign each Application for Payment indicating their approval of the amount to be paid.

37.        Provide professional surveying services to prepare topographic, tree, ALTA/ACSM boundary, and other land surveys and legal descriptions. This may be a sub-contracted service.

38.        Other Civil Engineering Services as may be required by the scope of each project.

1.        Would the SDOC remove the requirement for the consultant to provide services in the best interest of the SDOC, as shown in section 7.1.5 of the draft contract? In accepting a fiduciary duty, an individual or entity enters a commitment to act in the best interests of a beneficiary and this goes against an engineer’s ethical obligation to provide services to the best interest of the public’s safety.

2.        As currently worded in Section 7.1.8 of the draft contract, the SDOC is asking the consultant to assume the highest professional standards in performing its work. While Kimley-Horn is committed to serving its clients, we are only required to do so in accordance with the professional standard of care, which is the degree of care and skill ordinarily exercised by consultants performing the same or similar services in the same locality at the time the services are provided. The relationship currently described in the proposal exceeds the Standard of Care to be provided by Design Professionals. Would the SDOC modify this language to comply with the foregoing language?

3.        The indemnification language in sections 7.2 and 7.3 of the draft agreement is in violation of Florida Statute 725.08 and we believe it is void and unenforceable. Would the SDOC modify this language to make it compliant? Suggested language per Florida Statute 725.08: “The design professional shall indemnify and hold harmless the agency, and its officers and employees, from liabilities, damages, losses, and costs, including, but not limited to, reasonable attorneys` fees, to the extent caused by the negligence, recklessness, or intentionally wrongful conduct of the design professional and other persons employed or utilized by the design professional in the performance of the contract.”

4.        In the RFP package, section 3.11-Performance and Payment Bonds, the SDOC is requiring the consultant to obtain performance payment bonds for projects in excess of $200,000 and liquidated damages will be assessed if the bonds are not acquired. Would the SDOC please remove this section? These types of bonds are not applicable to the services of design professionals.

5.        In section 3.12 of the RFP – Federal Grants Terms and Conditions, the SDOC is requiring the consultant to adhere to Federal terms should Federal Grants fund a project. Would the SDOC please provide a copy of those terms for review?

Given that this is an on-call contract with a range of tasks and unpredictable project scopes, is it acceptable to leave the dollar value and percentage of the contract blank on Attachment E? We remain fully committed to meeting or exceeding the 10% participation goal. 8/15/2025 9:39:37 AM
