NOTICE OF INTENT TO SOLE SOURCE

THIS IS A NOTICE OF INTENT TO AWARD A SOLE SOURCE ORDER AND NOT A REQUEST FOR QUOTATIONS.



This contract action is for the acquisition of supplies/equipment for which the Government intends to solicit and negotiate with only one source under the authority of Federal Acquisition Regulation (FAR) Subpart 13.106-1(b). The National Cancer Institute (NCI) intends to award a single source purchase order to Leica Microsystems, Deerfield, IL, for the acquisition of preventive service maintenance for the government owned Leica SP8 WLL2 TAN Laser Scanning Confocal Microscope with Falcon (Decal # 01963841, ID# 81-920).



The National Cancer Institute (NCI) needs to obtain the annual preventative service maintenance agreement for a clinical instrument (Leica SP8 WLL2 TAN Laser Scanning Confocal Microscope with Falcon). The instrument’s service shall consist of a thorough cleaning, calibration, adjusting, inspection, and testing of all equipment in accordance with the manufacturer’s latest established service procedures. All equipment shall be operationally tested through at least one (1) complete operating cycle at the end of the preventive maintenance inspection to ensure optimum and efficient performance. Software Service and updates are required as part of the contract and should include original equipment manufacturer (OEM) parts, proprietary software updates and include a guaranteed on-site response. Technicians must be technically certified to work on Leica equipment.



The anticipated period of performance will be :



Base Year: 03/01/2026 – 02/28/2027



Option Year 1: 03/01/2027 – 02/28/2028



Option Year 2: 03/01/ 2028 – 02/28/2029





The applicable North American Industry Classification System (NAICS) code for this acquisition is 811210 – Electronic and Precision Equipment Repair and Maintenance and a size standard of $34M.



NCI will solicit and negotiate directly with Leica Microsystems and no solicitation will be issued. This procurement is being conducted as a sole source acquisition due to the proprietary nature of Leica's confocal microscope system and associated software. The service requirements necessitate manufacturer certification, factory-trained technicians certified specifically by Leica, and access to proprietary software updates that are exclusively available through Leica or their authorized representatives. Only the original equipment manufacturer and their certified partners possess the technical expertise, proprietary tools, and authorized access to software updates required to maintain this specialized equipment.



NCI will negotiate directly with Leica Microsystems, and no solicitation will be issued. Award is subject to approval of the Sole Source Justification.



This notice of intent is not a request for competitive proposals. However, interested parties who believe they can meet the requirement may submit a statement of capabilities within 7 days from the date of publication. The statement must be submitted in writing and contain sufficient detail to demonstrate the party's ability to provide:




  • Manufacturer certification to service the Leica confocal microscope

  • Leica-certified technicians authorized to service the equipment

  • A service plan including proprietary software updates

  • Manufacturer OEM parts



Information received will be considered solely to determine whether to conduct a competitive procurement. The decision not to compete this action based on responses is at the Government's discretion. If no qualifying responses are received within 7 days, an award will be made to Leica Microsystems.



Sonnet 4.5. This procurement is to be processed using Simplified Acquisition Procedures.
