TO THE CONTRACT DOCUMENTS FOR:
Roadway Crack Sealing 2026
Town of Middlebury, Vermont
Your attention is directed to the following changes in, additions to, or deletions from the Contract
Documents for the Town of Middlebury Roadway Crack Sealing 2026 project. This complete
Addendum, including attachments, shall be included within the Contract Documents and shall take
precedence in the case of any discrepancies.
BIDDER must acknowledge receipt of all ADDENDA on the BID or may be considered nonresponsive.
This Addendum consists of questions that the Town has received during the Bid Phase and at the Pre-Bid
meeting.

Question: Is this a one-year or two-year contract?
Answer: This is a one-year contract with a December 31, 2026 completion. The posting has
been updated to reflect this correction.

INVITATION TO BID
Competitive bids for 2026 Roadway Crack Sealing in the Town of Middlebury will be
received at the Department of Public Works Building, 1020 Route 7 South, Middlebury,
VT,05753. Bids will be opened and read aloud at the Department of Public Works on
May 26th , 2026, at 11 :00 am.
The Town of Middlebury, VT reserves the right to waive any informalities in,
reject any and all bids, to make a partial bid award, or to accept any bid
deemed to be in the best interest of the Town.
Information for Bidders, Specifications and Bid Forms may be obtained free of charge
at the Municipal Building at 77 Main Street, the Department of Public Works at 1020

PROJECT OVERVIEW
The Town of Middlebury seeks a quotation for annual roadway crack sealing. It is anticipated that the
Town will contract out one full week of roadway crack sealing each year, the actual number of days
contracted for service will be dependent upon quoted prices.
GENERAL SPECIFICATIONS
The Contractor shall take all reasonable precautions for the protection of property, personnel, other
workmen, and the general public during the execution of the contracted service.
The Contractor shall be liable for any and all damages occasioned by the contractor's neglect or that
of his agents during the performance of all contracted services. The bidder agrees to acquire and
maintain, at his/her own expense, General Liability, Automobile Liability and Workman's
Compensation Insurance naming the Town of Middlebury as an additional insured affording the
following minimum coverages:

Before commencement of work, the Bidder shall give the Town Manager a certificate from the
insuring companies indicating such policies have been issued and are in force, and that said
insurance companies agree to notify the Town Manager at least ten (10) days prior to the date of
termination of or change in said policies.
The Contractor shall conform to all applicable Federal, State, and Local Laws and Ordinances. All
crack sealing activities must conform to the latest version of the Vermont Agency of Transportation
Standard Specifications for Construction.

GENERAL SPECIFICATIONS - CONTINUED
No work shall be scheduled or undertaken on Sundays or legal holidays without prior approval of the
Director of Operations.
Prices are to remain firm during the contract period. The contract period will be for one
calendar year beginning upon contract execution and ending on December 31, 2026.
All work shall be done in a professional and workmanlike manner according to standard practices and
in accordance with conditions contained in these contract documents. All areas will be properly
maintained so that a good appearance is prevalent at all times.
Material and workmanship shall conform to the latest version of the "Vermont Agency of
Transportation Standard Specifications for Construction". The "Blow and Go" Method as described in
the specifications will be acceptable.
Provide a safe and secure worksite when working in the Right of Way, including vehicular &
pedestrian safety. Traffic control, including uniformed officers, flaggers, warning lights, barricades,
and warning signs shall be provided by the Contractor as necessary to perform work in a safe and
responsible manner. Unless otherwise specified, the roadway will be kept open to two-way traffic at
all times with only minor delays.
Contractor to provide all labor and materials - complete and in accordance with these specifications,
based on estimated quantities.
Contractor to provide a minimum one week notice to the Town before work starts.
