Project Description: General Notice
Borough of Elizabethtown (Owner) is requesting Bids for the construction of the following Project:
S. Poplar St Sewer Improvements Project 000598.0461
Sealed bids for the S Poplar St Sewer Improvements Project will be received and opened publicly at PennBid on Thursday, March 13, 2025 at 10:00AM local time.
The Project includes the following Work:
The Work generally includes, but is not limited to, approximately 175 L.F. of 8-inch sanitary sewer main, five (5) sanitary sewer spot repairs, approximately 160 L.F. of 6-inch sanitary sewer laterals, 7 storm sewer inlet top and boxes, 193 L.F. of- 8-inch, 12-inch, and 15-inch diameter storm sewer pipe, 30 L.F. of 36-inch storm sewer pipe, and all associated materials, equipment, labor, and necessary apparatuses as contemplated by the Contract Documents. The Project Site is located in the Borough of Elizabethtown.

Bidding Documents may be downloaded from the designated website. The designated website will be updated periodically with addenda, lists of registered plan holders, reports, and other information relevant to submitting a Bid for the Project. All official notifications, addenda, and other Bidding Documents will be offered only through the designated website. Neither Owner nor Engineer will be responsible for Bidding Documents, including addenda, if any, obtained from sources other than the designated website.
Pre-bid Conference
A pre-bid conference for the Project will be held on February 20, 2025 at 10:00AM at Elizabethtown Borough Building, 600 South Hanover Street, Elizabethtown, PA 17022. Attendance at the pre-bid conference is encouraged but not required.
Instructions to Bidders.
Bid security in the form a Certified Check or Bid Bond shall be furnished with the bid in an amount not less than 10%.
All questions about the meaning or intent of the Bidding Documents are to be submitted via PennBID in accordance with the Instructions to Bidders. Telephone inquiries are unacceptable.

P.L. 117-58, Infrastructure Investment and Jobs (IIJA) Act, 2021 (Act), includes a “Build America, Buy America (BABA)” requirement in Sections 70911 through 70917 that requires use of iron, steel, manufactured products, and construction materials that are produced in the United States for projects for the construction, alteration, maintenance, or repair of a public water and sewer systems or treatment works.
Statutory Requirements.
Bidders must comply with all State antibid-rigging regulations pertaining to work associated with this project, and will be required to submit an executed non-collusion affidavit with the bid.
Bidders should refer to provisions of federal and state statutes, rules and regulations dealing with the prevention of environmental pollution and preservation of public natural resources that affect the project, pursuant to Act No. 247 of the General Assembly of the Commonwealth of Pennsylvania, approved October 26, 1972.
This Project falls under The Commonwealth of Pennsylvania enacted Act 127 of 2012, known as the Public Works Employment Verification Act (‘the Act’) which requires all public work contractors and subcontractors to utilize the Federal Government’s E-Verify system to ensure that all employees performing work on public work projects are authorized to work in the United States. All Bidders are required to submit a Public Works Employment Verification Form as a precondition for the Contract Award.
The estimated cost for this project is greater than Twenty-five Thousand Dollars ($25,000) and the Davis Bacon Act shall apply.
All bids shall be irrevocable for 60 days after the bid opening date unless award is delayed by a required approval of another government agency, the sale of bonds, or the award of a grant or grants, in which case this Bid shall remain subject to acceptance for 120 days after the bid opening date as provided by the Act of November 26, 1978 (P.L. 1309, No. 317), as amended by the Act of December 12, 1994 (P.L. 1042, No. 142).
All bidders are hereby notified that in regard to any contract pursuant to this advertisement, businesses will be afforded full opportunity to submit bids in response to this notice and will not be subjected to discrimination on the basis of gender, race, color, creed, sex, age, physical disability or national origin in consideration for an award. Similarly the successful bidder shall in no manner discriminate against or intimidate any employee involved in the manufacture of supplies, the performance of work, or any other activity required under the contract on account of gender, race, creed or color.
Notice is hereby given to bidders that construction of this project is being funded in part, by a federal grant provided to Lancaster County from the U.S. Dept. of Housing and Urban Development and is subject to the Davis Bacon Act of March 3, 1931, as amended. Wages must be paid by contractors according to the U.S. Department’s Wage Decision included in the specifications. All bidders must also comply with the requirements of Section 3 of the Housing and Urban Development Act of 1968; the Executive Order of 11246 or any other order which prohibits discrimination in employment. All bidders are advised that an executed Attachment B from the Section 3 Action Plan included in the specifications must be submitted or the bid will be rejected as non-responsive.
Qualified Minority and Women Owned Businesses (MBE/WBE) are encouraged to respond to the Invitation to Bid.
The Borough of Elizabethtown reserves the right to waive any defects, errors, omissions, mistakes, informalities, to accept any bid or combination of bids that are deemed to be in the best interest of the Borough of Elizabethtown, and to reject any or all proposals.
