1. Contracting Activity: Department of Veterans Affairs, Network Contracting Office 06, located at 100 Emancipation Drive, Hampton, VA 23997-9900, in support of the Durham VA Medical Center for the Garner VA Medical Clinic located at 2700 Benson Road Garner, NC 27529. The purchase request number for this requirement is 558-26-1-2003-0023.

2. Description of Action: The Durham VAMC has a requirement for the Aesculap sterile container system for the Garner VA Medical Clinic. The Aesculap sterile container system is a reusable, rigid container solution for packing, transporting and sterilizing surgical instruments, acting as a durable barrier to maintain sterility, and has modular baskets and filters for efficient processing and organization. The Durham VAMC seeks to award a one-time purchase for the Aesculap sterile container system in a firm-fixed price, FSS, task order for this requirement.

3. Description of Supplies or Services: The Aesculap sterile container system is a reusable, rigid container for packing, transporting, and sterilizing surgical instruments, acting as a durable barrier to maintain sterility and organization. The Aesculap sterile container system is durable suitable for repeated use in clinical environments. It is made from corrosion resistant materials compatible with standard sterilization methods. It’s ergonomic design allows for clinical staff safety and efficiency when sterilizing surgical instruments. The Aesculap sterile container system can be ordered in different size containers, colored labels and instrument stingers. The Aesculap sterile container system is compliant with FDA medical device requirements where applicable and in alignment with VA standards for sterile containers. The estimated value of the proposed action is $ 53,733.62.

4. Authority: Order Against FSS: Authority of the Multiple Award Schedule Program, Title III of the Federal Property and Administrative Services Act of 1949 (41 USC 251, et seq.); Title 40 USC 501, Services for Executive Agencies; and Section 803 of the National Defense Authorization Act of 2002 (PL 107-107) and implemented by FAR 8.405-6.

5. Rationale/explanation to support cited authority: The Aescualp sterile container system is manufactured by the original equipment manufacturer for Aesculap INC. a large business, and sole distributor is Trillamed LLC. Trillamed is the only source capable of providing the Aesculap sterile container system and there are no other comparable sterile container systems that are compatible with the systems currently used at the Durham VAMC. The Aesculap sterile container system is durable, offers multiple colors for lids and tray name tags, and has a warranty which other sterile container systems do not have. Using the Aesculap sterile container system will standardize sterilization uses across the Durham VAMC, Greenville CBOC, and Garner CBOC making it easier to transport and sterilize medical instruments used at all facilities.

6. Note that this determination satisfies the requirements of FAR 8.405-6. The requirement to perpare a wirtten justification IAW FAR 6.303 does not apply to Federal Supply Schedules.
