INVITATION TO BID INSTRUCTIONS: Instructions, Terms and Conditions for Bidding (revised 01/29/26, attached) apply to this solicitation.

STANDARD TERMS AND CONDITIONS: The State of Ohio Standard Terms and Conditions (revised 03/31/25, attached) apply to this solicitation and will govern any resulting Contract.

BRAND NAME OR APPROVED EQUAL SPECIFICATIONS:
The products in this solicitation are being bid as BRAND NAME OR APPROVED EQUAL. For items designated “Brand Name or Approved Equal,” bidders offering alternate items must provide detailed written justification in their bid for each alternate item offered on how the item offered is equal to the item specified. Based on the written justification provided, the State will determine if the item offered is equal to the brand name item named and if to issue an “approved” determination for the item. The decision of the State in this regard shall be final.

EVALUATION: Bids will be evaluated in accordance with ORC 125.07. The State will multiply the bid prices by the estimated usage listed in the bid for all mandatory items only and then add each of the totals together to arrive at a total for evaluation purposes. Optional items, if offered, will not be considered in the evaluation or award determination.

CONTRACT AWARD: The contract will be awarded to the lowest responsive and responsible bidder based on the lowest lot total for mandatory items only. The low lot total will be determined by multiplying the unit prices by the estimated usage listed in the bid for mandatory items and then adding each of the totals together. Failure to bid all mandatory items may result in the bidder being deemed not responsive. Optional items will not affect the evaluation or award.
