| Specific Conditions for Procurement: |
1. Mandatory Experience Requirements
The Supplier must have the following experience in order to be considered for award of the Contract: 1. The Supplier must have completed (including testing and commissioning), and must have achieved Substantial Completion within the meaning of the Construction Act for three (3) projects within the last seven (7) years as General Contractor with scope of work as identified below, according to schedule requirements and having a minimum dollar value of $750,000.00 CAD for each project (excluding taxes). i. Two (2) projects must have been completed for a municipality or other government agency. ii. Two (2) projects must involve playground replacements and/or playground installations in new parks. iii. One (1) project must involve splash pad replacements and/or splash pad installations in new parks. iv. Taken together, the three (3) projects (a non-mandatory 4th project slot is also available in ARIBA Part 4 for Supplier to use if needed) must include all of the following components (but each individual project does not have to include all of the components): 1. Project involving compliance with third-party government conservation regulatory requirements such as Toronto Region Conservation Authority. 2. Working within/around existing mature tree canopy 3. Site servicing including coordination with municipal / government water service, such as Toronto Water (water and sewer) 4. Site furnishing installation. 5. Paved pathway construction including cast in place concrete, and asphalt. 6. Planting including trees, shrubs, perennials, sod, soil and mulch. Information for each project shall include, but is not limited to: a. Project description, i.e., location, size (sq.m), scope of work, project value and contract number. b. Current Owner Contact along with telephone or e-mail information. c. Consultant and contact information (if applicable). d. Project site supervisor/ foreman (name of individual and company). e. List of Sub-Contractors. f. Confirmation that work was performed by the same Legal Entity as the Bidder. If not, provide name of the affiliated/ related Entity that performed the work and its relationship to the Bidder. g. Confirmation that Bidder was the General Landscape Contractor for the project. 2. Project Experience / Comparable Projects 1. The Supplier must provide reference projects to confirm their experience and track record of success. 2. The City of Toronto will verify this requirement based on the project experience submitted in Section 1 – Mandatory Experience Requirements. 3. Failure to provide verifiable experience and/or references that cannot be reached using the information provided will result in the bid being declared non-compliant. 4. To demonstrate compliance with the experience requirements stated in Section 1 – Mandatory Experience Requirements, the Supplier must complete and submit Form C – Experience and Qualifications Form (Part 4). By submitting this form, the Supplier consents to the City and its Consultant contacting the listed references to verify the provided information. Failure to include all required information, including current contact details for project references, will render the bid non-compliant. 5. It is essential that the Work be performed by a Supplier who can demonstrate specific knowledge and experience in completing similar projects or services of comparable nature, size, and scope. 6. The Supplier is responsible for verifying the accuracy and validity of all Project Owner contact information prior to submission. Failure to do so may result in the bid being deemed non-compliant. 7. The contact information provided will be used to verify the Supplier’s experience in executing similar projects. 8. The City reserves the right to verify whether a Supplier is relying on the past experience of an Affiliated Person, including assessing the nature of the corporate relationship and its relevance to this project. If, at the City's sole discretion, it is determined that the Supplier is relying on an Affiliated Person's experience and that such experience cannot be demonstrated as relevant to this project, the bid will be declared non-compliant and will not be considered for award. 3. Mandatory Qualification Requirements 1. Current Certificate of Recognition (COR®) or equivalent OHS Certification Each Supplier shall acquire and upload a copy of a valid Certificate of Recognition (COR®) or Equivalent OHS Certification in the legal name of the Supplier or in the case of a joint Bid, for, and in the name of, each member of the Joint Bid Team. |
