These notices shall satisfy two separate by related procedural requirements for activities to be undertaken by the below-named responsible entity.
REQUEST FOR RELEASE OF FUNDS
On November 18, 2024 Judge Doug Fields, Columbia County, 1 Courthouse Square, Magnolia, AR 71753, will submit a request to the Arkansas Economic Development Commission to release of ACEDP funds under Title I of the Housing and Community Development Act of 1974, as amended, to undertake the following project: Columbia County Youth Center.
FINDING OF NO SIGNIFICANT IMPACT
It has been determined that such request for release of funds will not constitute an action significantly affecting the quality of the human environment, and accordingly Columbia County is not required to prepare an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA).
An Environmental Review Record (ERR) for this project has been prepared by the above-named Grantee that documents the environmental review of the project and more fully sets forth the reasons why such statement is not required. This Environmental Review Record is on file at the Southwest Arkansas Planning and Development District, 101 Harvey Couch Boulevard, Magnolia, Arkansas 71753 and is available for public examination and copying upon request weekdays between the hours of 8 a.m. to 4 p.m. until November 18, 2024.
PUBLIC COMMENTS
Any interested agencies, groups or persons may submit written comments on the ERR to the Southwest Arkansas Planning and Development District, P.O. Box 767, Magnolia, Arkansas 71754. Such written comments must be received on or before December 15, 2024.
All such comments so received will be considered, and the Grantee will not request the release of ACEDP funds or take any administrative action on the project prior to the date specified in the preceding sentence. Comments should specify which Notice they are addressing.
RELEASE OF FUNDS
Columbia County will undertake the project described above with ACEDP funds from the Arkansas Economic Development Commission under Title I of the Housing and Community Development Act of 1974, as amended. Columbia County is certifying to the Arkansas Economic Development Commission that it and its chief executive officer or other certifying officer of applicant approved by the Commission, in his or her official capacity, consents to accept the jurisdiction of the Federal courts if an action is brought to enforce responsibilities in relation to the environmental review process, and that these responsibilities have been satisfied. The legal effect of the certification is that upon its approval of Columbia County may use ACEDP funds and the Arkansas Economic Development Commission will have satisfied its responsibilities under the National Environmental Policy Act of 1969.
OBJECTIONS TO RELEASE OF FUNDS
The Arkansas Economic Development Commission will accept objections to its release of funds and the responsible entity’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only on one of the following bases:
(a) that the certification was not in fact executed by the certifying officer;
(b) that applicant has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR 58;
(c) the grant recipient has committed funds or incurred costs not authorized by 24 CFR 58 before approval of a release of funds by the State; or
(d) another Federal agency acting pursuant to 40 CFR 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality.
Objections must be prepared and submitted in accordance with the required procedures (24 CFR 58.76) and shall be addressed to the Grants Management Division, Arkansas Economic Development Commission, One Commerce Way, Little Rock, AR 72202. Potential objectors should contact the Grants Management Division of the Arkansas Economic Development Commission to verify the actual last day of the objection period.
