Painting – Interior
On behalf of the Timberlane Regional School District, SAU106 is issuing a Request for
Proposal (RFP) for interior painting services in classrooms and hallways across school
buildings in the District, which includes Plaistow, Atkinson, Danville, and Sandown, NH.
Proposals must be submitted in a sealed package by 11:00 am on Tuesday, May 12,
2026, via USPS or another delivery service. Faxed and emailed proposals will not be
accepted. The bid opening will take place on May 12, 2026 at 11:00 AM. All proposals
must remain valid for 90 calendar days.

The Timberlane Regional School District reserves the right, at its sole discretion, to reject
any or all proposals in whole or in part, and to accept that proposal for one or more items,
or any combination of items, which it deems to be in the best interest of the District, even
if the proposal is not the lowest price. The Board also reserves the right to waive any
formalities or irregularities in, or to reject, any or all proposals or any part of any proposal.
Any proposal may be withdrawn prior to the scheduled time for opening proposals. Any
proposal received after the specified time and date shall not be considered. The Board
further reserves the right to negotiate with a respondent when all proposals exceed the
budgeted appropriation.
The District shall not be responsible for any costs incurred in responding to this RFP.
Each proposal is a governmental record subject to disclosure under the Right-to-Know Law.
The District will not accept proposals marked confidential in whole or in part.
A mandatory site walk of all school buildings will take place on May 1, 2026 at 8:30AM.

Scope of Project:
Three schools within the Timberlane Regional School District will undergo painting in
various classrooms and hallways, including but not limited to walls, doors, door frames,
and trim. Some preparation work may include, but is not limited to, removing nails and
tacks, scraping, and patching. The scope and definition of areas to be prepared and painted
will be detailed in the mandatory walkthrough. Respondents should be ready to take notes
for each area. School maps will be provided. Also, a unique area of the high school will
need to be prepared for paint spraying (ceilings).

Painting Requirements:
1. Supplies: The Timberlane Regional School District will provide all necessary paint
for the painting project at each school listed. All other painting supplies will be the
sole responsibility of the winning bidder.
2. Certification of Insurance: The respondent awarded the bid must provide the
minimum insurance requirements listed below:
Workers' Compensation:
Part One: Worker’s Compensation

Statutory Part Two: Employers' Liability

Respondents shall name the Timberlane Regional School District as an additional
insured on all policies and furnish to the District before beginning work certificates
of insurance and policy endorsements for the required insurance.
The certificates shall contain a clause prohibiting cancellations or modifications of
the insurance earlier than ten (10) days after the Timberlane Regional School
District receives written notice.
3. Payment and Performance Bonds: Respondent awarded the bid will be required
to provide payment and performance bonds for projects of $125,000 or more.
4. References: Respondents must provide a reference list of at least four (4)
commercial customers in the area for projects performed and completed.
5. Indemnification: To the fullest extent permitted by law, respondent shall protect,
indemnify, safe, defend and hold harmless the Timberlane Regional School
District, including its officials, agents, volunteers and employees ("Indemnified
Parties"), from and against any and all liabilities, obligations, claims, damages,
penalties, causes of action, costs, interest and expenses, including but not limited to
reasonable attorney and paralegal fees, which Indemnified Parties may become

obligated or suffer by reason of any accident, bodily injury, personal injury, death
of person, economic injury or loss of or property damage, arising indirectly or
directly under, out of, in connection with, or as a result of the contract or the
activities of the respondent or its agents, employees, contractors or subcontractors,
and even if caused in part by any negligent act or omission of Indemnified Parties.
In addition, and regardless of respective fault, respondent shall defend, indemnify
and hold harmless the Indemnified Parties for any costs, expenses and liabilities
arising out of a claim, charge or determination that respondent’s officers,
employees, contractors, subcontractors or agents are employees of the Indemnified
Parties, including but not limited to claims or charges for benefits, wages, fees,
penalties, withholdings, damages or taxes brought in connection with laws
governing workers compensation, unemployment compensation, social security,
Medicare, state or federal taxation, and/or any other similar obligation associated
with an employment relationship.
Respondent’s obligations to defend, indemnify, and hold harmless the Indemnified
Parties hereunder shall survive the contract term.
The Timberlane Regional School District is not obligated to defend or indemnify
the respondent, any subcontractor, or any professional service provider.
6. Termination: The District shall have the right to terminate the contract at any time
with or without cause by giving thirty (30) days of written notice. Upon
termination, the respondent shall be entitled to receive payment from the District
limited to actual documented expenses as of the termination date as its sole remedy.
The District will not be responsible for lost profits, compensatory, or other
consequential damages.
Selection Criteria
Proposals will be evaluated based on the following criteria:
• Experience and qualifications of the contractor and team
• Demonstrated understanding of the project scope and objectives
• Cost-effectiveness and value
• References and past performance
If the District decides to make an award based on these evaluations, it will notify the
selected proposer(s). If the District cannot reach an agreement with the selected
proposer(s) during contract discussions, it may then begin discussions with the next
preferred proposer, continue down the list, or alternatively, the District may reject all
proposals, cancel this RFP, or initiate a new acquisition process with fresh proposals.
The District will use a scoring scale of 100 points, which will be distributed as set forth
in the table below.
