1. Welcome and Introductions (Nick)
• Roll call and sign-in (mandatory for bid eligibility)
• Overview of meeting purpose and agenda
2. Project Overview (Elias)
• Type of Work: ID/IQ Equipment and Hauling at various locations in Henderson, Polk, and
Transylvania counties
• Contract Duration: March 9, 2026 – March 8, 2027 (with possible extensions up to three
years, $5M/year cap)
• Non-exclusive Contract: Multiple awards possible; not a guarantee of minimum work
volume
• Work Order Assignment: Based on lowest cost per work order; must respond within 3
working days
3. Bidder Requirements (Elias)
• Mandatory Prebid Conference: Attendance and registration required for bid eligibility
• Licensing: Must comply with NC General Statutes Chapter 87 for contractor licensing
• Bid Submission:
o Paper bids only; download and return the entire proposal
o Submit all required forms, certifications, and itemized proposal sheets
o Sealed envelope with required labeling and information
o Delivery deadline: 2:00 PM, February 10, 2026, at Division 14 Office
• Questions: Submit by email to d14contracts@ncdot.gov at least 7 days before bid opening
4. Contract Administration (Elias)
• Bonding: Not required for these contracts unless a work order exceeds $500,000 (statutory)
or $450,000 (NCDOT policy)
• Mobilization: No direct pay; included in bid items except for emergency mobilization
• Liquidated Damages: Assessed per work order value (see contract table for rates)
• Emergency Mobilization: Must respond within 48 hours; paid per occurrence
5. Key Provisions and Special Requirements (Nick)
• Contract Time: Work must be continuous once started; adhere to specified completion
dates
• Moratoriums:
o No in-water or buffer zone work: Oct 15–Apr 15 (DN12194928) or Oct 15–Jan 1
(DN1219427)
o No tree cutting: Apr 1–Oct 15
• Traffic Control:
o Lane closure restrictions: No closures Mon–Fri, 7–8 AM & 5–6 PM, or during
holidays/special events
o Use of AFADs or PTS units allowed per contract provisions
o Backfill and signage requirements for pavement drop-offs and milling operations
• Equipment and Labor:
o List of required equipment and operator qualifications
o All equipment must meet safety and communication standards
o Laborers and flaggers must be certified and equipped per contract
• Measurement and Payment:
o Paid by actual hours worked (rounded to nearest ¼ hour)
o No separate payment for mobilization or operator training
6. Compliance and Reporting (Nick)
All contractors must adhere to applicable federal and state requirements, including but not limited
to:
• MBE/WBE/DBE Participation: While no specific goals apply to these contracts, any
participation must be reported using NCDOT forms and online systems for tracking
payments and participation.
• Build America, Buy America (BABA): All construction materials and manufactured products
must comply with federal requirements. Contractors are required to submit notarized
acknowledgments and certifications for each shipment.
• Minimum Wages: The federal and state minimum wage is $7.25 per hour; Davis-Bacon wage
rates apply as outlined in the contract tables.
• Nondiscrimination and EEO: Strict compliance with Title VI and all related federal and state
nondiscrimination and equal employment opportunity requirements is mandatory, including
affirmative action and reporting obligations.
7. Dispute Resolution (Nick)
• Notify Engineer or Division Engineer within 48 hours of any contract or work order dispute
• Follow escalation procedures as outlined in the contract
8. Questions and Open Discussion
• Address any clarifications needed by bidders
• Make sure sign in sheet is filled out
Johnny Phillips asked is certified payroll required. Amy Campen responded that it was.
Blythe Co asked if the submittals had to be paper. Elias Hord stated that they did.
Luke Whitmire asked if FORE agreements are being replaced. Nick Dorato said that we aren’t totally
sure at this point.but that it seems this may be a route the department could go.
