NOTICE OF INTENT TO AWARD SOLE SOURCE



The Defense Nuclear facilities Safety Board (DNFSB), intends to award a contract to S&P Global Inc to access its unique publications. The information developed and compiled by S&P Global Inc is considered proprietary, as their material is protected by copyrights and exclusive distribution rights. The services provided by S&P Global Inc. are in support of the Defense Nuclear facilities Safety Board and its staff.



The authority permitting this sole source acquisition without full and open competition is prescribed by FAR FAR 13.106-1(b)(1), only one source reasonably available, urgency, exclusive licensing agreements, brand name, or industrial mobilization. An approved Justification and Approval (J&A) authorizing this procurement will be posted in accordance with FAR 13.105(c).



DNFSB uses the Energy Daily subscription to gain information on energy and power policy and news to perform the agency’s statutory oversight mission: “to provide independent analysis, advice, and recommendations to the Secretary of Energy to inform the Secretary, in the role of the Secretary as operator and regulator of the defense nuclear facilities of the Department of Energy, in providing adequate protection of public health and safety at such defense nuclear facilities, including with respect to the health and safety of employees and contractors at such facilities.” DNFSB requires Subscription services that provides both historical and current information relevant to the nuclear energy marketplace. Energy Daily is uniquely qualified because it is the only energy subscription services that can provide DNFSB staff access to breaking industry news and industry developments on energy regulation, legislation, business, and policy analysis. Energy Daily also provides the DNFSB with access to archives of Energy Daily articles dated back to 1998. If the DNFSB does not subscribe to Energy Daily, the agency will no longer have access to these archives. DNFSB requires 100 licenses with online instant access providing both historical and current information relevant to the nuclear energy marketplace. The Performance is for a Base and four option years.



A solicitation package will not be posted publicly and requests for copies of the solicitation in response to this notice will not be honored or acknowledged. A determination by the Government not to compete this proposed action based upon responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether conducting a competitive procurement in the future would be in the best interest of the Government. All responses received by 9:30 AM (Eastern Time) on February 24, 2025, will be considered. All information (capability statement, proposal or quotation) submitted should support the firm’s abilities to provide the required services and shall be furnished at no cost or obligation to the Government. Responses shall be submitted via e-mail to Adriana Underdue, contracting Officer, adrianau@dnfsb.gov. Telephone requests or inquires will not be accepted.
