This is an invitation to submit a bid to Lamar County for the 2026 LMIG-TSPLOST Project (Midway Road,
Freeman Road, Shadybrook Lane, Ponderosa Lane and South 6th Street Ext.) as indicated herein. Sealed
bids will be received at the office of the Chairman (in the Lamar County Administration Building at the above address)
up to 2:00 p.m., September 29, 2026, at which time they will be opened and publicly read.
This project will be funded with 2026 LMIG and TSPLOST funds. Construction includes work at 5 separate
locations, as outlined in the Scope of Work, which includes Asphalt Patching and Resurfacing on Midway Road
(1.12 mi), Freeman Road (1.58 mi), Ponderosa Lane (0.73 mi), Shadybrook Lane (0.35 mi) and South 6th Street
Ext. (0.66 mi) within Lamar County. All work shall conform to the Georgia Department of Transportation¿s (GDOT)
Standard Specifications Construction of Transportation Systems, Current Edition; GDOT¿s Supplemental
Specifications Construction of Transportation Systems, Current Edition; and all applicable GDOT Standards and
Details; and other contract requirements, specifications and general conditions.
Bid Documents may be obtained by downloading them from the Georgia Procurement Registry (GPR) at
https://ssl.doas.state.ga.us/PRSapp/. Interested Bidders/Proposers are solely responsible for obtaining the Bid
Documents, addenda, and all solicitation updates from the Georgia Procurement Registry. No hard copies of the
Bid Documents will be mailed. Submit all questions regarding the Project in writing by email only.

Questions must be received no later than 5:00 p.m. on Tuesday, September 22, 2026. Responses to questions
and any revisions to the Bid Documents will be issued by written Addendum and posted to the Georgia Procurement
Registry. Additional addenda may be issued during the bidding period. Bidders/Proposers are responsible for
regularly monitoring the Georgia Procurement Registry and obtaining all Addenda issued for this solicitation.
Instructions for preparation and submission of a bid-proposal are contained in this packet. Bids must be typed or
printed in ink. Bids submitted as a result of this invitation must include the "Bid Sheet" and bids on both options (if
applicable) to be considered along with all required documents and be returned in a sealed envelope or container
marked, "SEALED BID for 2026 LMIG-TSPLOST Project (Midway Road, Freeman Road, Ponderosa Lane,
Shadybrook Lane, and South 6th Street Ext.)" on the outside. Bids may not be considered unless so received.
Any questions and /or misunderstandings that may arise from this invitation shall be submitted in writing at least 10
days prior to the bid opening. The County will not respond to any questions received within 72 hours prior to the
bid opening. Answers to questions submitted that materially change the conditions and specifications of this
invitation for bid will be promulgated to all addressees as an addendum. Any discussions or documents will be
considered non-binding unless incorporated and promulgated in an addendum.

2026 LMIG-TSPLOST PROJECT
INSTRUCTIONS TO BIDDERS
1. Intent: It is intended that the Instructions to Bidders, General Conditions, and Detailed
Specifications shall define and describe the complete work to which they relate.
2. Work to Be Done: The Project Areas are:
* Midway Road from SR 36 to Upson County Line
(Patching, OGI and Resurfacing)
* Freeman Road from SR 36 to Country Kitchen Road
(Patching, OGI and Resurfacing)
* Ponderosa Lane from Midway Road to Dead End
(Patching and Resurfacing)
* Shadybrook Lane from Midway Road to Dead End
(Patching and Resurfacing)
* South 6th Street Ext. from Camp Road to Spalding County Line
(Patching, OGI and Resurfacing)
The work to be performed under this contract consists of asphalt patching, OGI & resurfacing
on Midway Road (1.12 mi), asphalt patching, OGI & resurfacing on Freeman Road (1.58 mi),
asphalt patching and resurfacing on Ponderosa Lane (0.73 mi), asphalt patching and
resurfacing on Shadybrook Lane (0.35 mi) and asphalt patching, OGI and resurfacing on South
6th St. Ext (0.66 mi). The project includes general requirements such as traffic control, shoulder
clipping, sweeping, bituminous tack coat and striping. All work and material shall be in
accordance with the Technical Specifications and the construction drawings.
3. Site Examination: The Bidder is advised to examine the location of the work and to
inform themself fully as to its conditions; the conformation of the ground; the character, quality
and quantity of the products needed preliminary to and during the prosecution of the work; the
general and local conditions and all other matters which can in any way affect the work to be
done under the Contract. Failure to examine the site will not relieve the successful bidder of
their obligation to furnish all products and labor necessary to carry out the provisions of this
contract.
The Bidder shall notify the Owner of the date and time he/she proposes to examine the location
of the work. The Bidder shall confine their examination to the specific areas designated for the
proposed construction, including easements and public rights of way. The Bidder is solely
responsible for any damages caused by his/her examination of the site.
4. Bid and Contract Security: Each Proposal must be accompanied by a bid bond for an
amount equal to at least five percent (5%) of the bid amount. If for any reason whatsoever the
Bidder withdraws from the competition after opening the bids, or if he/she refuses to execute
the Contract, the Owner will proceed on the Bid Bond. The Surety of the Bid Bond, Performance
Bond, and Payment Bond shall be a surety company authorized to do business in the State of
Georgia, shall be listed in the Department of the Treasury Circular 570, and shall have an
underwriting limitation in excess of 100% of the bid amount. The Bonds and Surety shall be

subject to approval by the Attorney for the Owner. Attorneys-in-fact who sign bid bonds or
contract bonds must file with each bond a certified and effectively dated copy of their power of
attorney.
5. Determination of Successful Bidder: The Contract will be awarded to the lowest
responsive, responsible bidder, if awarded.
(a) Responsibility: The determination of the bidder's responsibility will be made by the
Owner based on whether the bidder:
1. Maintains a permanent place of business,
2. Has the appropriate technical experience,
3. Has adequate plant and equipment to do the work properly and expeditiously
4. Has suitable financial means to meet obligations incidental to the work.
The Bidder shall furnish to the Owner all such information and data for this purpose as the Owner
may request. The Owner reserves the right to reject any bid if the evidence submitted by, or
investigation of, the bidder fails to satisfy the Owner that he/she is properly qualified to carry out
the obligation of the Contract.
(b) Responsiveness: The determination of responsiveness will be made by the Owner
based on a consideration of whether the Bidder has submitted complete Proposal forms without
irregularities, excisions, special conditions, or alternative bids for any item unless specifically
requested in the Proposal forms.
6. Contract Time: Contract time shall consist of One Hundred Eighty (180) consecutive
calendar days for the completion of work, to be computed from the date of the Notice to Proceed.
Liquidated damages shall be assessed at $300 per day.
7. Submission of Bids: Bids shall be submitted at the time and place indicated in the
Invitation. Lamar County will not accept late bids. On the outside of the envelope containing the
bid shall be noted the following:

8. Georgia Open Records Act: Bidders are reminded that documents and information in
the possession of Lamar County will be treated as confidential/proprietary information only to
the extent permitted by the Georgia Open Records Act and will be exempt from disclosure to a
third party only to the extent permitted by the Georgia Open Records Act. Any trade secrets in
your bid must be placed in a separate envelope, clearly identified and marked as such. Marked
at a minimum by a cover letter explaining exactly where such information is, and otherwise
marked, highlighted, etc. so as to be plainly visible.
9. Proposal Forms: Bids shall be submitted on the Proposal Forms included. Bids shall be
based upon unit prices for estimated quantities except where bid items require lump sum
proposals as indicated by the Proposal Forms. Where errors or omissions result in
discrepancies in bid totals, prices per unit as submitted will be binding.

Final payment will be based upon actual in-place measured quantities, except where lump sums
are requested for bid items.
10. Gratuities: Lamar County acknowledges that, particularly during the holiday season, it
may be customary to provide gifts to employees or departments. However, the Lamar County
Personnel Policy prevents the acceptance of such gifts. Your cooperation in respecting the
policy is appreciated.

01 - Definitions
Where used in the project manual, the following words and terms shall have the meanings indicated. The
meanings shall be applicable to the singular, plural, masculine and feminine of the words and terms.
Acceptance. Formal action of the Owner in determining that the Contractor's work has been completed
in accordance with the contract and in notifying the Contractor in writing of the acceptability of the work.
Act of God. A cataclysmic phenomenon of nature, such as a hurricane, earthquake, or abnormal flood.
Rain, wind, high water, or other natural phenomenon which might reasonably have been anticipated from
historical records of the general locality of the work shall not be construed as acts of God.
Addenda. Supplemental written specifications or drawings issued prior to execution of the contract
which modify or interpret the project manual by addition, deletion, clarification, or corrections.
Bid. Offer of a bidder submitted on the prescribed form setting forth the price or prices of the work to be
performed.
Bidder. Individual, partnership, corporation, or a combination thereof, including joint ventures, offering
a bid to perform the work.
Contract. The writings and drawings embodying the legally binding obligations between the Owner and
the Contractor for completion of the work; Contract Documents attached to the Contract and made a part
thereof as provided herein.
Contract Documents. The Contract, Addenda (which pertain to the Contract Documents), Contractor's
Bid (including documentation accompanying the Bid and any post Bid documentation submitted prior to
the Notice of Award), the Notice to Proceed, the Bonds, these General Conditions, the Special

Conditions, the Specifications and Drawings, together with all Written Amendments, Change Orders,
Work Change directives, Field Orders, and Drawing submittals. LAMAR COUNTY WILL NOT
ENTERTAIN OR ACCEPT ANY CHANGES TO THE CONTRACT FORMAT PROVIDED.
Contract Drawings. The drawings which show the scope, extent, and character of the work to be
furnished and performed by the Contractor and which have been prepared and reviewed by the Engineer
and are referred to in the Contract Documents.
Contract Price. Amount payable to the Contractor under the terms and conditions of the contract.
Based on the price given on the bidding schedule, with adjustments made in accordance with the
contract. The base amount given in the bidding schedule shall be either a lump sum bid or the summation
of the unit price bids multiplied by the estimated quantities set forth in the bid form.
Contract Time. Number of calendar days stated in the contract for the completion of the work or portions
thereof.
Contractor. The individual, partnership, corporation, or combination thereof, including joint ventures
that enter into the contract with the Owner for the performance of the work. The term covers
subcontractors, equipment and material suppliers, and their employees.
Contractor's Plant and Equipment. Equipment, material, supplies, and all other items, except labor,
brought onto the site by the Contractor to carry out the work, but not to be incorporated in the work.
Contract Technical Representative. The day-to-day County Representative designated by the Owner.
County. Owner.
Day. Calendar day.
Defective. An adjective which when modifying the word "work" refers to work, including but not limited
to the furnishing of materials, that is unsatisfactory, faulty, deficient, or performed in an unworkmanlike
manner, in that it does not conform to or meet the requirements of the Contract, any inspection, reference
standard, test or approval referred to in the Contract, or has been damaged prior to a recommendation
of final payment.
Direct. Action of the Owner by which the Contractor is ordered to perform or refrain from performing
work under the contract.
Directive. Written documentation of the actions of the Engineer or the Owner in directing the Contractor.
Engineer. Whenever the word "Engineer" is used in the contract, it shall be understood as referring to
the Engineer of the Owner, or such other Engineer, supervisor, or inspector as may be authorized by the
Owner to act in any particular area of the Contract.
Equipment. Mechanical, electrical, instrumentation, or other devices with one or more moving parts, or
devices requiring an electrical, pneumatic, electronic, or hydraulic connection.
Furnish. To deliver to the job site or other specified location any item, equipment, or material.
Herein. Refers to information presented in the project manual.
Holidays. Legal holidays designated by the Owner.
