Comments:
In accordance with Miami-Dade County Implementing Order 3-9, Accounts Receivable
Adjustments, if money is owed by the Contractor to the County, whether under this Contract or for
any other purpose, the County reserves the right to retain such amount from payment due by
County to the Contractor under this Contract. Such retained amount shall be applied to the
amount owed by the Contractor to the County. The Contractor shall have no further claim to such
retained amounts which shall be deemed full accord and satisfaction of the amount due by the
County to the Contractor for the applicable payment due herein.
This project is subject to the criteria and conditions of federal funded projects.
NOTICE TO BIDDERS
The County invites qualified contractors to submit sealed bids for a transportation improvement
project funded by federal and local sources. This project is listed in the Capital Improvement Plan
with allocated funding; however, this information is for reference only and shall not influence bid
preparation or evaluation. All work must comply with applicable federal, state, and local
requirements. Detailed specifications and bid documents are available. Sealed bids must be
submitted by 5/20/2026 to the County. Late submissions will not be accepted. For additional
information, contact Miami-Dade County Procurement.
1. BID SUBMITTAL AND BID OPENING
Sealed Bids for the Project will be received for and on behalf of Miami-Dade-County Department
of Transportation and Public Works (DTPW) Capital Improvement Division at the Clerk of the
Board Office at 111 N.W. 1st Street, Suite 1710, Miami, Florida 33128 until 2:00 P.M. EST on May
20, 2026 or as modified by addendum, at which time all Bids will be taken to the 18th Floor to be
publicly opened and read aloud. Bids received after the time and date specified will not be
considered. The County reserves the right to postpone or cancel the Bid opening at any time prior
to the scheduled opening of Bids. Bidders are invited to be present. The responsibility for
submitting bids on or before the stated time and date specified is solely the responsibility of the
bidder. The County will in no way be responsible for delays caused by technical difficulty or
caused by any other occurrence. All expenses involved with the preparation and submission of
bids to the County, or any work performed in connection therewith, shall be borne by the
bidder(s).
A bidder may submit a modified bid to replace all or any portion of a previously submitted bid up
until the proposal due date and time. The County will only consider the latest version of the bid.
Each submitted bid shall stand on its own, without reference to or incorporation of materials or
documents contained in previously submitted bids.
All Bids must be submitted as set forth in the Bid Documents. The County reserves the right to
reject any or all Bids, to waive informalities and irregularities, or to re-advertise the project. The
County, by choosing to exercise its right of rejection, does so without the imposition of any liability
against the County by any and all Bidders. This project is subject to the criteria and conditions of
federal funded projects.
2.SCOPE DESCRIPTION
Work includes, but is not limited to, providing all supervision, labor, required materials, equipment,
tools, operations, and documentation necessary for the construction of a traffic circle, including
site preparation, grading, pavement construction, curb and gutter installation, sidewalks, ADA-
compliant pedestrian ramps, drainage structures, pavement markings, and signage, all in
accordance with the contract documents.
3. LOCATION OF WORK
Intersection of N Miami Ave and NW 195th St – Approx. 150 ft from intersection at Sta 30+75.31 /
End Project 33+31.12, along Miami Ave.
4. LICENSE REQUIREMENTS:
At the time of bid submission, and pursuant to Section 10-3 of the Code of Miami-Dade County,
Florida, and these Solicitation and Contract Documents, the Prime Contractor (Bidder) must hold
valid, current, and active Florida Department of Transportation (FDOT) Certificate(s) of
Qualification.
The required FDOT prequalification(s) must be held by the Prime Contractor and must authorize
performance of the Work specified in the Contract Documents. Acceptable prequalification
classes include, but are not limited to, the Flexible Paving and Drainage Work Classes.
5. EXPERIENCE REQUIREMENT:
1. The Bidder must demonstrate that it has full-time personnel with the necessary experience to
perform the Project’s Scope of Work. This experience shall include work in successfully
completed projects performed by the identified personnel whose bulk of work performed in the
Public Right-of-Way is similar in detail to the Project’s Scope of Work described in these
Solicitation Documents. Demonstrate the experience requirement by:
a. Providing a detailed description of at least three (3) projects similar in detail to the Project’s
Scope of Work described in these Solicitation Documents and in which the Bidder’s identified
personnel is currently engaged or has completed within the past five years. List and describe the
aforementioned projects and state whether the work was performed for the County, other
government clients, or private entities. The description must identify for each project:
1) The identified personnel and their assigned role and responsibilities for the listed project
2) The client name and address including a contact person and phone number for reference
3) Description of work
4) Total dollar value of the contract
5) Contract duration
6) Statement or notation of whether Bidder’s referenced personnel is/was employed by the prime
contractor or subcontractor, and
7) For completed projects, provide letters of certification of final acceptance or similar project
closure documentation issued by the client and available Contractor’s performance evaluations;
or
b. Pursuant to Section 255.20, F.S., the County may consider a bid from a Bidder in good
standing, meeting the license requirements above, that has been prequalified and considered
eligible by the Florida Department of Transportation (FDOT) under Section 337.14, F.S. and
Chapter 14-2, Florida Administrative Code, to perform the work described in the Contract
Documents. Contractors seeking consideration under this Paragraph shall submit along with the
Bid Documents for review and consideration, current copy(ies) of their FDOT Certificate(s) of
Qualification and Status of Contract(s) On Hand.
2.The County reserves the right to request additional information and/or contact listed persons
pertaining to bidder’s experience.
6. PRE-BID CONFERENCE (Non-Mandatory, Highly Recommended)
DTPW will hold a Pre-Bid Conference, on 4/28/2026, at 10:00 am on Microsoft Teams, for all
interested parties. It is the policy of Miami-Dade County to comply with all the requirements of the

7. ADDENDA - CHANGES WHILE BIDDING AND QUESTION/REQUEST FOR INFORMATION
DEADLINE
It is the Bidder's obligation to notify the County’s Engineer, Katherine Fernandez
(Katherine.Fernandez@miamidade.gov ) prior to the opening of Bids of any conflicts, ambiguities
or discrepancies it finds in the Contract Documents, in order to allow County to issue appropriate
addenda.
a. The County reserves the right to make changes to the Contract Documents, as it finds
necessary or in its best interest, at any time prior to the opening of Bids.
b. All questions and requests for information shall be in writing and shall be directed to the
Engineer, Katherine Fernandez (Katherine.Fernandez@miamidade.gov ) and must be received
by 5/8/2026, to be given consideration. Bidders must file a copy of the questions (as well as any
other communications) with the Clerk of the Board (email: clerkbcc@miamidade.gov; fax 305-
375-2484).
c. Each submittal of a question or questions shall also contain the following information: Project
name and number, name of company as well as the name of the company representative
submitting the question(s), and the email address where responses to the question(s) can be
delivered. All interpretations and supplemental instructions will be issued as a written Addendum
to the Contract Documents which, if issued, will be sent by email to all prospective Bidders (at the
respective email addresses furnished for such purposes) prior to the opening of Bids. If any
Bidder fails to acknowledge the receipt of any Addendum in the space provided in the Bid Form,
its Bid will be construed as though receipt of the Addendum had been acknowledged.
d. Only the interpretations or corrections of the Bid Documents given by addenda shall be
binding, and prospective Bidders are warned that no other source is authorized to give
information concerning, explaining or interpreting the Bid Documents. Bidders shall not rely on
any oral interpretation, nor correction of any apparent ambiguity, inconsistency or error offered by
any person.
8.INDEMNIFICATION AND INSURANCE
A. To the extent provided by law, Contractor shall indemnify, defend, and hold harmless the
County and the State of Florida, Department of Transportation, including the Department’s
officers, agents, and employees, against any actions, claims, or damages arising out of, relating
to, or resulting from negligent or wrongful act(s) of the Contractor, or any of its officers, agents, or
employees, acting within the scope of their office or employment, in connection with the rights
granted to or exercised by the Contractor hereunder, to the extent and within the limitations of
Section 768.28, Florida Statutes.
B. The foregoing indemnification shall not constitute a waiver of sovereign immunity beyond the
limits set forth in Florida Statutes, Section 768.28. Nor shall the same be construed to constitute
agreement by Contractor to indemnify County for the negligent acts or omissions of County, its
officers, agents, or employees, or third parties. Nor shall the same be construed to constitute
agreement by the Contractor to indemnify the Department for the negligent acts or omissions of
the Department, its officers, agents, or employees, or third parties. This indemnification shall
survive the termination of this Agreement.
C. This indemnification shall survive the termination of this Agreement. Nothing contained in this
paragraph is intended to nor shall it constitute a waiver of the State of Florida and the County’s
sovereign immunity.
D. The Contractor shall furnish the Department of Transportation and Public Works, 111 NW 1st
Street, Miami Florida 33128, Certificate(s) of Insurance which indicate that insurance coverage
has been obtained which meets the requirements as outlined below:
1. Worker’s Compensation Insurance for all employees of the Contractor as required by Florida
Statute 440.
2. Commercial General Liability in an amount not less than $1,000,000 per occurrence, and
$2,000,000 in the aggregate not to exclude Products & Completed Operations. Miami-Dade
County and State of Florida, Department of Transportation must be shown as an additional
insured with respect to this coverage.
3. Automobile Liability Insurance covering all owned, non-owned and hired vehicles, in an amount
not less than $1,000,000 combined single limit per occurrence for bodily injury and property
damage.
4. Professional Liability Insurance in an amount not less than $1,000,000 per claim.
All insurance policies required above shall be issued by companies authorized to do business
under the laws of the State of Florida, with the following qualifications:
The company must be rated no less than “A-” as to management, and no less than “Class VII” as
to financial strength, by Best’s Insurance Guide, published by A.M. Best Company, Oldwick, New
Jersey, or its equivalent, subject to the approval of the County Risk Management Division.

The company must hold a valid Florida Certificate of Authority as shown in the latest “List of All
Insurance Companies Authorized or Approved to Do Business in Florida” issued by the State of
Florida Department of Financial Services.
Miami-Dade County reserves the right, upon reasonable notice, to request and examine the
policies of insurance (including but not limited to policies, binders, amendments, exclusions or
riders, etc.).

9.DISADVANTAGE BUSINESS ENTERPRISE (DBE)
Effective 10/03/2025, the U.S. Department of Transportation (USDOT) issued an Interim Final
Rule (IFR), suspending all DBE and ACDBE goals in solicitations until further notice.
10.VERIFICATION OF EMPLOYMENT ELIGIBILITY (E-VERIFY)
By entering the Contract, the Awarded Bidder becomes obligated to comply with the provisions of
Section 448.095, Florida Statute, titled "Verification of Employment Eligibility." This includes but is
not limited to utilization of the U.S. Department of Homeland Security’s E-Verify System to verify
the employment eligibility of all newly hired employees by the Awarded Bidder effective, January
1, 2021, and requiring all Subcontractors to provide an affidavit attesting that the Subcontractor
does not employ, contract with, or subcontract with, an unauthorized alien. Failure to comply may
lead to termination of this Awarded Bidder, or if a Subcontractor knowingly violates the statute, the
subcontract must be terminated immediately. Any challenge to termination under this provision
must be filed in the Circuit Court no later than twenty (20) calendar days after the date of
termination. If this Contract is terminated for a violation of the statute by the Awarded Bidder, the
Awarded Bidder may not be awarded a public contract for a period of one year after the date of
termination, and the Awarded Bidder may be liable for any additional costs incurred by the County
resulting from the termination of the Contract. Public and private employers must enroll in the E-
Verify System (http://www.uscis.gov/e-verify) and retain the I-9 Forms for inspection.
11.CONE OF SILENCE
Pursuant to Miami-Dade County Code Section 2-11.1(t), a “Cone of Silence” is imposed upon
RFPs, RFQs or bids after advertisement and terminates at the time the County Mayor issues a
written recommendation to the Board of County Commissioners or a Notice of Contract Award
Recommendation, whichever comes first. The Cone of Silence prohibits communications
regarding RFPs, RFQs or bids between potential vendors, service providers, bidders, lobbyists, or
consultants and the County’s professional staff, including but not limited to the County Mayor and
the County Mayor’s staff. A Cone of Silence is also imposed between the Mayor, County
Commissioners or their respective staffs and any member of the County’s professional staff.
12.AWARD
The award of the Contract, shall be to the lowest responsive and responsible bidder whose bid
complies with all of the material terms of this solicitation and is determined to be in the best
interest of the County. The fully executed Notice to Proceed (NTP) constitutes the Contract and
effectuates the terms and conditions set forth in the solicitation and incorporated Contract
Documents. All federal, state, and local requirements identified in this RPQ are material
conditions of award and shall be binding upon execution of the NTP.
13.APPLICABLE LEGISLATION
Contractors and subcontractors are required to abide by all applicable federal, state, and local
laws and ordinances, as they may be amended from time to time.
