Purpose
The City of Bonner Springs, Kansas, seeks written bids from companies with demonstrated
experience in Aquatic Park painting.

Scope of Services
Companies shall bid to properly prepare pool shell for painting. Completely paint entire shell with
two (2) coats at 200 sqft/gal of Tnemec Series 161HS Tneme-Fascure white or equivalent with
specs provided. Paint the lane markings, targets and striping located at the deep end and stair
nosing in Tnemec Series 161 Tneme-Fascure black or equivalent with specs provided. Provide all
necessary equipment, proper protection for non-removable pool features and clean up for project.
Obtain all necessary permits to work in the City of Bonner Springs, KS.
Bid Requirements
Bidders should inspect the location before submission of a bid. Bids must be enclosed in a
sealed envelope marked “Aquatic Park Pool Shell Painting”. Bids received will remain subject to
acceptance for thirty (30) days after the bid date.
Each bid must be accompanied by a bid security made payable to the City of Bonner Springs in
an amount of five percent (5%) of bidder’s maximum bid price and the form of a certified or
bank check or a bid bond issued by a Surety.
• The cost of all required insurance, bonds and license must be included in the bid
submission
• The City reserves the right to select the work items in the bid based on available
budget authority.
• The City further reserves the right to increase or decrease quantities by twenty-
five (25) percent based on unit prices bid.
• This is a tax-exempt project and the City Clerk’s Office will secure a project exemption
certificate for the successful bidder.
The successful bidder, and all subs, must obtain an occupational license from the City Clerk’s office
before a Notice to Proceed will be issued. Information for this license can be obtained from the
City’s web site, www.bonnersprings.org, under the City Clerk department tab.
Insurance and Bond Requirements
The successful bidder shall provide to the Bonner Springs City Clerk’s office:
• A certificate of insurance that names the City of Bonner Springs as an additional insured.
• General Liability and Workmen’s Compensation limits shall be $500,000 for each
occurrence and $1,000,000 for the general aggregate. An affidavit of exemption may be
requested.
• A performance bond
• A maintenance/warranty bond and provide a two (2)-year warranty.

• A statutory bond in the total amount of the work to be completed if the awarded bid is
greater than $100,000. The statutory bond shall be filed with the Clerk of the District
Court, Wyandotte County, and the original filed statutory bond and receipt provided to the
Bonner Springs City Clerk. In addition, the insurer shall agree to give a minimum of thirty
(30) days' notice prior to their decision to cancel coverage.
Submission Deadline
Interested contractors shall submit one (1) sealed copy of their Bid Form and (1) separately
sealed Bid Bond to: City Clerk, City of Bonner Springs, P.O. Box 38, 200 East Third Street, Bonner
Springs, KS 66012. All bids must be marked on the outside of the envelope: “Aquatic Park Pool
Shell Painting”. Bids must be received no later than 3:00 p.m., on Tuesday, February 17th,
2026.
Timely Delivery
It is the responsibility of contractor to ensure that their bid arrives at the City Clerk’s office on time.
Late or non-delivery due to mail or express delivery company failure are insufficient reasons to
consider late bids. Bids received after 3:00 p.m. on Tuesday, February 17th, 2026 will not be
considered.
Uniformity
For ease, uniformity and fairness in the evaluation of bids, it is required that each bid conforms in
all respects outlined in this document.
Award Criteria
All bids received in accordance with this request will be evaluated based on criteria
established by the City which may include but not be limited to bid price, quality, experience of the
bidder, responsiveness of the bidder, adaptability of the particular materials and equipment for the
specific intended use and conformity to bid specifications. The City reserves the right to reject any
and/or all bids for any reason, whether or not the bid is lowest and to waive any irregularities or
technicalities in any bid. The contract, if awarded, will be awarded to the bidder whose bid is
determined to be in the best interest of the City. Once delivered, all bids are irrevocable for a period
of 30 days from the deadline stated in Section VI.
Waiver
By the submission of a bid in response to this request, the bidder hereby expressly waives the
right to bring, file or enforce any and all claims or causes of action, legal or equitable, against the
City, its officers, agents or employees that pertain or relate to the City’s bid process, to include but
not limited to the notice, letting, review and award stages, processes and procedures. This waiver
shall be effective as of the bidder’s submission of its bid form and shall be irrevocable by bidder,
its successors and assigns. If bidder takes any action in contradiction of this waiver, then the City
shall be awarded all costs associated with its defense of such actions including but not limited to
reasonable attorney fees, filing fees and other legal costs, and the bidder shall forfeit its bid bond
to City.
Contract Time
Substantial completion shall be completed within 30 Working Days. All work shall be
completed within 45 Working Days.

Liquidated Damages
Liquidated damages will not be charged to the contractor on this project.
Rights Reserved by City
The City of Bonner Springs reserves the right to: 1) conduct in-person interviews of bidders and to
negotiate the final costs with any qualified bidders, 2) reject any and all bids submitted, 3) request
additional information from all bidders, 4) select the bid that best suits the City’s needs whether
the price is the lowest or not, 5) reject all bids and 6) waive informalities.
Preconstruction Meeting
Upon bid award, a preconstruction meeting shall be held at the Bonner Springs Aquatic Park upon
request.
Project Completion/Final Payment
Final payment (of not less than 10% of total project) shall not be made until a signed Project
Exemption Certificate completion form has been submitted to the City.
