NOTICE TO CONTRACTORS
The Board of Directors of the Fresno Metropolitan Flood Control District hereby invites
sealed proposals for Construction of Replacement of Roof & HVAC System Builidng 2,
Contract “OPC2-46”, Fresno County, California.
Sealed proposals will be received at the office of the Fresno Metropolitan Flood Control
District, 5469 E. Olive Avenue, Fresno, California, before 10:00 AM, April 1, 2026 at which
time they will be publicly opened, examined and declared by the District Engineer of the
Fresno Metropolitan Flood Control District, who shall report his findings to the Board of
Directors, at a meeting scheduled to be held within forty (40) days.
The Instructions to Bidders and other Contract Documents are available at the office of
the Fresno Metropolitan Flood Control District, for examination without charge, and
reference is made thereto for particulars.
Copies of Plans, Special Provisions and Contract Documents may be secured at 5471 E.
Olive Avenue, back building, upon payment of a fee of Twenty Dollars ($20.00). Copies of
the Standard Plans and Specifications may be purchased at a cost of Thirty Dollars
($30.00) per set. Portions of the Standard Plans and Specifications may be secured for a
nominal fee. Fees are refundable if documents are returned in usable condition. Digital
Plans will also be made available..
The Contractor and all subcontractors shall be solely responsible for complying with
Government Code Section 12940 where no discrimination shall be made in the
employment of persons upon public works because of race, religion, creed, color, national
origin, ancestry, physical disability, mental disability, medical condition, marital status, sex,
gender, gender identity, gender expression, age, sexual orientation or military and veteran
status of any person, subject to the exceptions set forth in Government Code Section
12940.
As provided for in Section 7-7 of the Standard Specifications, Contractor and all
subcontractors shall be solely responsible for complying with all statutes and regulations
governing the payment of prevailing wages, including, without limitation, Labor Code
Sections 1725.5, 1771, 1774 and 1775, as amended. Moreover, this contract is subject
to monitoring and enforcement by the California Department of Industrial Relations (DIR).
The Contractor and its subcontractors are required to register with DIR and submit certified
payroll reports to DIR and the District. Only Contractors and subcontractors registered with
DIR can bid on District work or work under District contract. The Contractor and its
subcontractors shall register with the DIR by following the registration instructions on the
DIR website at http://www.dir.ca.gov. The Contractor shall be solely responsible for
complying with prevailing wage law and regulation and the proper enrollment and
maintenance of records. The Contractor shall be required to post a copy of the prevailing
wages applicable to each trade used at each job site. The Contractor shall also post those
notices required by California Code of Regulations Title 8, Chapter 8, Subchapter 4.5
Section 16451(d), which are included in the Appendix of these Special Provisions. The

Contractor shall notify the District’s Engineering Technician, Adam Johnson, at (559) 456-
3292, with any questions related to prevailing wages and/or DIR requirements.
Moreover, the Contractor and all subcontractors shall inform themselves of, and shall
comply with laws and regulations governing the payment of travel and subsistence as
required by Section 7-6 of the Standard Specifications.
Bids are required for the entire work described in the Engineer’s Estimate of Quantities
following. The quantities are approximate only, being given as a basis for the comparison
of bids, and the Board of Directors does not expressly or by implication agree that the actual
amount of work will correspond therewith but reserves the right to increase, or decrease,
the amount of any class or portion of the work, or to omit portions of the work, as may be
deemed necessary or advisable by the Engineer.
No contract will be awarded to a Contractor who is not registered with DIR, has not been
licensed in accordance with the provisions of the Contractors State License Law, California
Business and Professions Code, Division 3, Chapter 9, as amended, and whose bid is not
on the proposal form included in the contract document. A valid California Contractor’s
license, Class A, (General Engineering) is required for this project.
The Board of Directors reserves the right to reject any or all bids, to award or reject any
combination of items as it sees fit, and to waive any informality in any bid received.
Cash, a cashier’s check, certified check or bidder’s bond, in the amount of not less than
ten percent (10%) of the amount of the bid, shall accompany each proposal, made
payable to the order of the Fresno Metropolitan Flood Control District, as a guarantee that
the bidder will, after being notified of the acceptance of his bid, make a contract with the
Fresno Metropolitan Flood Control District in accordance therewith, and will furnish the
required contractor’s bonds. The bonds required of the successful bidder are a faithful
performance bond in the amount of one hundred ten percent (110%) of said bid and a
payment bond in an amount equal to one hundred percent (100%) of the amount of said
bid, in accordance with the provisions of Sections 3247-3251 of the California Civil Code.
If the successful bidder fails to execute the contract for which the bid is accepted and fails
to furnish the required bonds within ten (10) days after the mailing of notice of the award
of the contract to the successful bidder, the Board of Directors shall have just cause for
annulment of the award and forfeiture of the proposal guarantee. In this case, the Board
of Directors reserves the right to award the contract to one of the other bidders or reject
all bids.
Proof of insurance (Certificate of Insurance) certifying coverage in the minimum amounts
required by these Special Provisions and Section 7-13 of the Standard Specifications
shall be submitted to the District before 5:00 p.m. on the second business day following
the opening of bids or as extended in writing by the District. The District encourages the
Contractor to submit the required proof of insurance at the time of the bid opening to allow
the District to check it for completeness so that the Contractor can make any necessary
revisions prior to such deadline.

Immediately following the actual execution of the contract and furnishing of the required
contractor’s bonds, the Board of Directors will return the bidders’ guarantees accompanying
the other proposals. All bids are to be made on the forms to be furnished by the Engineer
as designated in the foregoing paragraphs.
