Vern Essi Marsh” Embankment Stabilization at Pickerel Creek Wildlife Area, Fremont, Ohio

Project Specifications:
Contractor shall include the supply of all labor, materials, and equipment required to complete the
specified wetland embankment stabilization located at Pickerel Creek Wildlife Area. All services must
comply with specifications listed below to include but not limited to the following items and comply
with federal, state, and local governmental laws, regulations, codes, and ordinances. All work will be
completed in a manner consistent with customary industrial practices. Contractor shall ensure that the
job site is cleaned up, dispose of any debris, and leave no open hazards at the end of every workday. All
itemized scope items listed below are by contractor, unless noted otherwise.

Scope of Services:
This project is for the maintenance and refreshment of armoring stone on existing wetland embankment
slopes at Pickerel Creek Wildlife Area (see Figures 1-5). The Contractor shall:
- Mow or grub all vegetation (up to 5” DBH), leaving no more than 3” above ground level
- Repair and/or regrade embankment sides to a minimum 3:1 consistent slope
- Place geotextile fabric that meets or exceeds ODOT Type D specifications
- Provide and place all crushed aggregate (Type “D” size course aggregate), as follows:
o Armor stone must be placed, fit, and compacted to prevent downslope migration
o Bottom elevation of band of armor: Toe of the embankment
o Minimum thickness of band of armor Twelve (12) inches
o Minimum width of band of armor Twelve (12) feet
o Total length of embankment to be armored 3,600 linear feet (see Figure 1)
- Repair any/all ruts on embankments resulting from riprap placement, re-crowning as needed
- Seed affected areas with the following mix: Orchard Grass (Dactylis glomeriaia) 25 pounds
per acre, Perennial Rye Grass (Lolium perenne) 25 pounds per acre, and Crimson Clover
(Trifolium incarnatum) 5 pounds per acre. Seeded areas shall be scarified, tilled, and/or
power-raked to prepare the soil prior to seeding
- Cover the seeded areas with a minimum 2-inch-thick layer of straw (Hydro-seeding the
approved seed mix in lieu of placing straw is also acceptable.)
REQUEST FOR QUOTE
The Contractor is encouraged to utilize tracked-machines and/or low-ground-pressure equipment to
minimize rutting on existing travel ways and embankments.
The overall project site and one (1) proposed staging area for material stockpiling is shown in Figure 1.
Additional staging areas may be available to the contractor if approved by the Area Representative.
Contract Term:
Construction may commence on receipt of the approved project Purchase Order and shall be completed
no later than June 30, 2026.
Site Visit & Point of Contact:
A pre-bid meeting is scheduled for Tuesday, March 13, 2026, at 10:00 AM EST, at the Pickerel Creek
office (4300 Dew Drop Road, Vickery, OH 43464). Attendance of the pre-bid meeting by a
representative of the bidder is a requirement of this bidding process. Failure to attend will result in a
disqualified bid. Additional site visits may follow this meeting, if desired. To RSVP for the pre-bid

Once a contract is awarded, failure of the bidder to have requested a site visit to become familiar with
the facility and requirements of the bid will be insufficient reason to support any request to be released
from the contract.
Evaluation:
The contract will be awarded to the lowest responsive and responsible bidder as determined by the
State.
Preference:
The State will apply all preferences pursuant to Ohio Administrative Code 123:5-1-06.
Following the initial evaluation and scoring, all proposals will be considered for preference. Preference
will be calculated at a rate of five percent (5%) for the first preference and two percent (2%) each for the
second and third preferences. The preferences shall be combined and applied as a total percentage of
the original proposal to determine the score for evaluation purposes.
Preference will only be applied if there is at least one Contractor that does not qualify for that particular
preference. For purposes of qualifying for a preference, a Contractor failing to complete the
certification for each preference will be deemed as not qualifying for that preference.
(A) For the Buy American preference, if any Offeror offers a product that is not a domestic
source end product, the State will add the applicable percentage of the total available points
to the total score of each Offeror offering a domestic source end product.
(B) For the Buy Ohio preference, if any Offeror is a Buy Ohio Offeror claiming the preference,
the State will add the applicable percentage of the total available points to each Buy Ohio
Offeror’s total score.

(C) If claiming the preferences in (a) and (b) based on the product(s) offered, an Offeror is only
eligible to receive the preference if the cost of the product(s) offered exceeds 50% of the
total offered cost for products and services. A Buy Ohio Offeror is also eligible to receive the
Buy Ohio preference based on its significant economic presence in Ohio or a border state.
(D) For the Veteran-Friendly Business preference, the State will add the applicable percentage
of the total available points to any certified veteran-friendly business Offeror’s total score.
Prevailing Wage:
Prevailing Wage rates and requirements are applicable to this project.
Contractor’s Statutory Obligations:
A. PREVAILING WAGES. Contractor shall comply with the prevailing wage requirements described under
R.C. Chapter 4115 that include, without limitation, the requirements described under this section. If the
Work is subject to payment of prevailing wage rates, the Contractor shall:
1. Pay to laborers and mechanics performing the Work the prevailing wage rates of the Project locality,
as determined by the Ohio Department of Commerce, Wage and Hour Bureau;
2. Post in a prominent place readily accessible by all workers on the site, a legible listing of the current
classifications of laborers, workers, and mechanics employed under this Agreement;
3. Ensure that the rates posted are current and remain posted in legible condition during the period of
this Agreement; and not be entitled to an increase in compensation on account of an increase in
prevailing wage rates, except as otherwise provided by applicable law.
The Contractor may access the Ohio Department of Commerce, Wage & Hour Bureau at its website,

B. COMPLIANCE WITH LAWS. Contractor, in the execution of its duties and obligations under this
Agreement, agrees to comply with all applicable federal, state, and local laws, rules, regulations, and
ordinances.
C. DRUG-FREE WORKPLACE. Contractor agrees to comply with all applicable federal, state, and local laws
regarding smoke-free and drug-free workplaces and shall make a good faith effort to ensure that none
of its employees or permitted subcontractors purchase, transfer, use, or possess illegal drugs or alcohol,
or abuse prescription drugs in any way while engaged in the Work provided for in this Agreement.
D. NONDISCRIMINATION OF EMPLOYMENT. Pursuant to R.C. § 125.111, Contractor agrees that
Contractor, any subcontractor, and any person acting on behalf of Contractor or a subcontractor, shall
not discriminate, by reason of race, color, religion, sex, sexual orientation, age, disability, military status
as defined in R.C. § 4112.01, national origin, or ancestry against any citizen of this state in the
employment of any person qualified and available to perform the Work. Contractor further agrees that
Contractor, any subcontractor, and any person acting on behalf of Contractor or a subcontractor shall
not, in any manner, discriminate against, intimidate, or retaliate against any employee hired for the
performance of the Work on account of race, color, religion, sex, sexual orientation, age, disability,
military status, national origin, or ancestry. If required by R.C. § 125.111(B) and Ohio Administrative
Code § 123:2-3-02, Contractor shall have a valid Certificate of Compliance (COC) from the Ohio
Department of Development demonstrating compliance with affirmative action program requirements.

E. USE OF MBE AND EDGE VENDORS. R.C. § 125.081 requires state agencies to set aside purchases for
Minority Business Enterprises (“MBE”) and R.C. § 122.92 requires the Department of Development,
through the adoption of rules, to establish agency goals for contracting with Encouraging Diversity,
Growth and Equity (“EDGE”) businesses which will be applied at the contract level. ODNR encourages
Contractor to purchase goods and services from Ohio-certified MBE and EDGE vendors.
F. CONFLICTS OF INTEREST. No personnel of Contractor who exercise any functions or responsibilities in
connection with the review or approval of this Agreement or carrying out of any of the Work shall, prior
to the completion of the Work, voluntarily acquire any personal interest, direct or indirect, that is
incompatible or in conflict with the discharge and fulfillment of their functions and responsibilities with
respect to the carrying out of the Work. Any such person who acquires, whether voluntarily or
involuntarily, an incompatible or conflicting personal interest on or after the effective date of this
Agreement shall immediately disclose their interest to ODNR in writing. Thereafter, they shall not
participate in any action affecting the Work, unless ODNR shall determine in its sole discretion that,
considering the personal interest disclosed, their participation in any such action would not be contrary
to the public interest.
Contract Award:
The contract will be awarded to the lowest responsive and responsible bidder. Bidders must submit
pricing to complete the entire project as specified in the Scope of Services (total lump-sum). Failure to
do so may result in the bid being deemed non-responsive.
The awarded contractor will be required to sign an Addendum to Bid Quote or Personal Services
Agreement. Example attached.
All bidders must sign and attach the Standard Affirmation & Disclosure Form to their bid in OhioBuys.
This may be signed electronically through Adobe or through a wet signature. If this is not attached, the
winning bidder will be asked to sign before a contract can be routed for review.
