MBE Set-Aside Bidding Opportunity
This Invitation to Bid (ITB) is reserved exclusively for bidders certified by the State of Ohio as a
Minority Business Enterprise (MBE). Only MBE’s certified by the State of Ohio Equal Opportunity
Coordinator in accordance with Section 123.151 (B)(2) of the Ohio Revised Code will be considered
for award
Multiple Award
ODOT will accept all responsive bids submitted on or before the specified bid opening date and
make an award to all responsive bidders pursuant to O.R.C. 5513.02.
Vendors must submit their Bid Responses electronically in OhioBuys before the published deadline
date & time, Columbus, Ohio local time on the Proposal due date. Vendors will not be able to submit
Bid Responses, or unsolicited Proposal amendments after the deadline. Vendors must allow
adequate time for uploading a Bid Response prior to the due date and time. ODOT recommends that
vendors submit Bid Responses as early as possible.
Note: If a second round is issued for any reason, vendors must resubmit their bid if they had
already submitted in a previous round, as the previously submitted Bid Responses do NOT carry
over to the new round. New rounds may be the result of an addendum, extensions, etc.
Note: The Signature process takes place after the award now. The email will come from
documents@esign.ohio.gov and will go to the signatory that was identified in the bid submission.
The subject line will be the bid # Signature Request, (example: 101G-25 Signature Request). No
contract can be issued to your company until we receive your signature to complete the process.
And you must have an OAKS Payor ID before a contract can be issued. To obtain that, you will need
to go into https://ohiopays.ohio.gov
Contract Duration
The effective duration of this agreement shall be from:
Date of Execution through June 30, 2026.

All pricing submitted shall be valid for the entire duration of this agreement.
Delivery Provisions
Delivery of placed orders shall be made within the specified calendar days after receipt of written or
verbal notification against a valid State of Ohio purchase order or State payment card.
Delivery shall be made within five (5) calendar days for general repair components (e.g. bolts,
nuts, brackets, plates, end shoes, diaphragms, screws, posts, washers, pins, etc.)
Delivery of all remaining Guardrail, Cable Rail, and Attenuator parts shall be made within thirty
(30) calendar days.
Delivery Hours
All deliveries shall be made between the hours of 8:00 a.m. and 3:30 p.m., Monday through Friday,
excluding State holidays, unless special permission is granted by the Department to temporarily
waive or adjust this requirement.
Delivered Materials
All palletized treated wooden posts and blockouts must be shrink-wrapped in plastic to prevent the
material from getting wet during delivery. The Department shall reserve the right to reject all material
deliveries that are not properly covered from inclement weather.
Freight Charges for Materials.
Delivery transport vehicle may vary based on the type, size, weight, and need of the material orders
placed. On the excel pricing page, a separate tab will establish the various delivery options a vendor
may have. A vendor shall provide the various transport types they have for orders placed. This can
range from a small pickup truck (or similar size) to a semi-truck. Based on the order placed, a vendor
shall estimate the most efficient vehicle to meet the order requirement.
When a vendor chooses to combine orders to be more efficient and effective, this may result in a
different transport type for an individual order. See Notes on pricing page for combining orders.
Delivery Location
A single delivery location has been established for each District. Costs for additional locations (drop
fee) and additional mileage are established on the pricing page for delivery costs.
Orders
District and Counties will place orders for parts listed on this contract. Billing of orders shall be at
the unit prices listed
Vendor shall identify cost of third-party delivery versus vendor delivery to determine most economical
option.
See Delivery Options in Section 4.3. Delivery costs for the orders placed will be addressed at the
time of order. This may vary based on the type, size, weight, and time the order is placed or to be
delivered.
Orders may be shipped through a third-party mailing service, prepaid with freight/shipping charges
added to the invoice. Copies of freight/shipping charges are to be included with the invoice. The
Department shall only pay for actual freight/shipping costs. There shall be no vendor-added markup
to the freight/shipping costs.

No minimum will apply to an order picked up by the Department of Transportation at the vendor
location, at the unit price provided.
Vendor shall be required to be able to accept credit card as a form of payment. The Department will
not pay any transaction fees associated with the charge.

Products provided through this contract shall conform to manufacturer’s specifications as well as the
ODOT-approved Shop Drawings (website below) for each specified product (Item 1-8) listed below:

BRIFEN
The required component parts for Brifen’s “TL-3 (4 rope) System Assembly” or approved
equals are described in drawing numbers WRSF-05-201a, WRSF-05-202a, and WRSF-
05-204a 209a, WRSF-02-211a, WRSF-05-001.
All component parts must meet or exceed the component standards for the Brifen System.
GIBRALTAR
The required component parts for Gibraltar “TL 3, TL 4, and TL 4-4 Cable System
Assembly” or approved equals are described in drawings: TL-3 Dated 10/13/08, TL-4
Dated 10/13/08, TL-4-4 Dated 10/13/08.
All component parts must meet or exceed the component standards for the Gibraltar
System.
NUCOR
The required component parts for Nucor High Tension Cable Barrier or approved equals
are described in drawing NU-CABLE, NU-CABLE-ANCHOR, and NU-CABLE-
ELEVATIONS.
All component parts must meet or exceed the component standards for the Nucor system.
TRINITY
The required component parts for Trinity’s CASS-S3 4-Cable Guardrail Safety System or
approved equals are described in drawing SS-742 pages 1 through 5.
All component parts must meet or exceed the component standards for the Trinity System.
SAFENCE

The required component parts for Safence 4 RC Wire Rope Safety Fence or approved
equals are described in drawing SRB-001 through SRB-009, SRB-011, SRB-016, and
SRB-017.
All component parts must meet or exceed the component standards for the Safence
system.
TENSIONING EQUIPMENT
Bid items are not specific to Brifen, Gibraltar, Nucor, Trinity, and Safence. Refer to pricing
page for a description of tensioning equipment.

Alternative to Approved Products
PLEASE NOTE FOR ITEMS ABOVE: If approved equals are being submitted by a bidder, it’s the
bidder’s responsibility to prove, without doubt, the components and parts are completely compatible
and equal to the respective system noted above. Bidder’s must explicitly submit their intentions, via
a letter submitted in their bid package on company letterhead, to submit an approval equal in their
bid package and must also submit detailed literature (e.g. drawings, product specifications, other
product info, etc.) for the Department’s evaluation.
Descriptive Literature
Descriptive literature, product specifications, MSDS, etc., should be submitted with a bid response
to this invitation. This literature will be used in the bid evaluation process. Any references that may
appear in the descriptive literature, that may alter the terms and conditions and specifications of the
bid (i.e. Delivery, Shipping Point or Prices Subject to Change), will not be considered part of the
contract and will be disregarded by the Department. Failure of the bidder to furnish descriptive
literature either as part of their bid, or within the specified timeframe provided by ODOT, may result
in a non-responsive bid determination.
Construction and Materials Specifications Handbook
Specifications as shown herein are incorporated into the ITB and made a part thereof are found in
the Ohio Department of Transportation Construction and Materials Specifications (C&MS) current
edition, and provisions of the current version of supplemental specification 800 which is in force at
the time of the award.
