I. STATEMENT OF PURPOSE:

1. Overview and Goals

The goal of this solicitation is to secure a source to purchase Traffic Signal Loop Detection for use

by the Public Works Department of the City of Tulsa.

2. Term of Contract

The City intends to award a one-year annual contract. The City may offer the Seller the opportunity

for additional one-year terms. The City also reserves the right to make multiple or partial awards. To

do business with the City, You must agree to the terms and conditions of the City’s standard

Purchase Agreement, indicated by Your Authorized Agent’s signature on the Purchase Agreement.

Capitalized terms used in this IFB and not defined in the Purchase Agreement shall have the

meanings as ascribed to them in Title 6, Chapter 4 of the Tulsa Revised Ordinances.

The entire Invitation for Bid (IFB), including any additional information submitted by Bidder and

Accepted by City will be included as part of the Agreement between Seller and City. All sheets of

this IFB (including Sections I-VI) must be submitted.

Authorized Agent

Several parts of the Bid (Affidavits, Purchase Agreement) must be signed by an “Authorized

Agent.” An Authorized Agent means an agent who is legally authorized to bind the Seller under the

law of the state in which the Seller is legally organized. For instance, under Oklahoma law, the

Authorized Agent for each of the following types of entities is as stated below:

o Corporations – the president, board chair or board vice chair (or the vice president if the corporation

was formed in Oklahoma) can sign; others can sign if they have and provide the City with (i) a corporate

resolution giving them authority to bind the Seller, and (ii) a recent certificate of secretary indicating

the authority is still valid and was in full force and effect on the date of the signature. (See IFB Section

VI for sample of a Certificate of Secretary)

o General Partnerships – any partner can sign to bind all partners.

o Limited Partnerships – the general partner must sign.

o Individuals – no additional authorization is required, but signatures must be witnessed and notarized.

o Sole Proprietorship – the owner can sign. Any other person can sign if s/he provides a recent Power

of Attorney, signed by the owner, authorizing him/her to bind the sole proprietorship.

o Limited Liability Company (LLC) – any manager of the LLC elected by the members of the LLC, or

any member signing as manager of the LLC. All other signers will need a Consent of Members signed

by all the Members of the LLC authorizing their signature on or up to 30 days before the date of their

signature. (See Section VI for sample of a Consent of Members)

Entities organized in states other than Oklahoma must follow the law of the state in which they are

organized.

II. SCOPE OF SERVICES AND SPECIFICATIONS

1. Scope of Services

The City is requesting Bids for Traffic Signal Loop Detection for use by the Public Works Department.

Delivery Requirements

All prices quoted shall be based on delivery F.O.B. Tulsa, Oklahoma or to any other points as may

be designated in the Specifications, with all charges prepaid by Seller to the actual point of delivery.

Bids must state the number of Days required for delivery under normal conditions.

Absolutely no items over 500lbs. may be directly shipped to the City, requiring the City personnel to

unload from the shipping truck or trailer. The City carries no responsibility for any damages incurred

during an unloading occurrence. All unloading shall be the responsibility of the Seller and/or shipping

entity.

2. Specifications

The Bid must meet or exceed the following Specifications.

The City of Tulsa’s Public Works Dept - Traffic Operations Division (TOD) is seeking services for the

installation of various sized solid-state inductive vehicle loop(s), lead-in wire(s), detector(s), conduit

and pull box(s) for vehicle detection in Tulsa, Oklahoma. This is a citywide Agreement with work to

be performed on an as-needed basis at various locations within the Tulsa metropolitan area. The

work shall consist of furnishing all equipment, material, labor, tools necessary to perform the work

and making all necessary terminations in the pull box(s) and traffic signal cabinet to have fully

operational loop(s) at the location(s) indicated by the Traffic Engineer, Traffic Operations Manager,

or Designee.

All work shall be completed in accordance with these specifications and City of Tulsa drawings, and

standards, the Oklahoma Department of Transportation (ODOT) 2019 Standard Specifications for

Highway Construction and the latest edition of the Manual of Uniform Traffic Control Devices

(MUTCD) manual.

For this Bid, Bidders shall bid on every line item. Lines have been included in the Pricing Worksheet

in Exhibit A – Pricing and Services for loop detectors. Additional lines may be added for additional

products for consideration if they are within the scope of this Specification for loop detectors, but the

City does not guarantee that those items will be added to the Agreement. Please attach additional

sheet(s) with the additional line items to Your Bid and note them on the Pricing Worksheet.

The City, at its sole discretion, may choose to enter into additional Agreement(s) with or purchase

material or services from other Seller(s).

Materials that are provided shall meet the requirements of SWMP Pollution Ordinance (Title 11A,

Chapter 5) & MS4 Permit Requirements. Seller shall observe and comply with the City's Municipal

Separate Storm Sewer System (MS4) permit, Stormwater Management Program (SWMP), Pollution

Ordinance (Title 11A, Chapter 5), and all applicable Federal, State, and local laws, ordinances, and

regulations. Submission of a Bid on this work shall be considered a representation that Seller is

familiar with all such laws and regulations, and no pleas of misunderstanding will be considered on

account of ignorance thereof. All work shall be conducted in a manner that prevents the discharge

of pollutants into the City's MS4 or Waters of the State. Failure by Seller, its employees, agents, or

subcontractors to comply with these requirements shall be deemed a material breach of contract and

may result in enforcement action, suspension of work, withholding of payment, or other remedies as

determined necessary by the City.

Material Specifications.

1. Seller shall ensure that at least one employee engaged in the work and at the work location(s)

holds an International Municipal Signal Association (IMSA) Traffic Signals Level I and Level II

certification.

2. Traffic control shall be incidental to all items of work. Seller shall furnish, erect, and maintain

barricades, warning signs, and flagging persons in accordance with the Manual on Uniform Traffic

Control Devices (MUTCD) latest revision and a project specific Temporary Traffic Control Plan

(TTCP), if required. Seller may be asked to submit a TTCP prior to commencing inductive loop

installation. The Traffic Engineer, Traffic Operations Manager, or Designee reserves the right to first

review the TTCP and approve the proposed signing, locations of signs, and the location and type of

channelized devices to be utilized, and all lane closures prior to the beginning of operations. The

Seller shall maintain construction traffic control in place and provide sufficient personnel resources

to assist with the proper curing of inductive loop sealant in accordance with the manufacturer’s

recommendations.

3. Seller shall not work during peak flow periods on primary and secondary arterial streets and

special traffic ways (as classified in the Tulsa City-County Major Street and Highway Plan), and on

highway off ramp locations. The Traffic Engineer, Traffic Operations Manager, or Designee shall

have the authority to stop work and specify a working time if the inductive loop installation is causing

an unsafe condition(s). Seller shall notify the Traffic Engineer, Traffic Operations Manager, or

Designee a minimum of three (3) days in advance if work is planned during hours different from

Monday through Friday 8:00 a.m. to 5:00 p.m.

4. Upon receiving a location(s) where work will be performed, Seller shall have five (5) workdays to

commence work. Once work begins at a signalized intersection location(s), Seller shall work

continuously and install inductive loop(s) consecutively until such time all work is completed as

specified by the Traffic Engineer, Traffic Operations Manager, or Designee.

5. Seller shall notify the Traffic Engineer, Traffic Operations Manager, or Designee 24 hours in

advance of work being completed. The Traffic Engineer, Traffic Operations Manager, or Designee

will dispatch a City of Tulsa Technician to the location(s) for inspection of work completed and

terminations made in the pull box(s) and traffic signal cabinet, during inspection the City of Tulsa

technician will verify that the loop(s) are fully operational and meet our specifications. Once the City

of Tulsa Technician is satisfied with the work and operation of the loop(s), the City of Tulsa

Technician will then make all necessary timing changes in the traffic signal controller. Failure to meet

these time constraints could result in the cancellation of the Agreement.

6. The City of Tulsa will not require Seller to acquire an electrical permit on any work performed on

this Agreement.

Standards:

Unless otherwise noted in this Specification, all material and labor provided shall meet the applicable

requirements of the latest City of Tulsa Standards and Specifications, including but not limited to:

COT Part 601 Pull Boxes, Part 602 Electrical Conduit (PVC), Part 604 – Loop Detectors, and Part

611 Electrical Conductors Traffic Signal.

Where City Specifications and Standards are silent, Oklahoma Department of Transportation

(ODOT) Standards and Specifications shall apply, except as noted in this Specification. If all

Standards are silent, then work shall be at the direction of the Traffic Engineer, Traffic Operations

Manager, or Designee; provided, however, that this clause shall not be construed to allow inclusion

of any equipment model or product that is not with the original scope or intent of the Technical

Specifications or Agreement.

All parts of the loop detector, including but not limited to equipment, material and labor, must comply

with all federal, state, county, municipal and local laws.

General Information:

Condition of Materials and Parts

All materials and items used shall be new, undamaged, unused, in first-class condition, of current

manufacturer, and be of the type generally accepted for the proposed use. All replacement parts and

materials shall meet manufacturer’s requirements and shall be equivalent or better than the part of

materials being replaced.

Requirement for All Inductance Loop Detectors

All loop detectors shall be capable of detecting vehicles and motorcycles on the roadway.

Material Requirements per Section on Exhibit A - Pricing & Delivery

Loop Detection System - All loop detectors shall meet the requirements of Part 604 for Loop

Detectors.

Approved Products

All material provided shall be supplied per the Approved Products List (APL), listed on the City of

Tulsa Traffic Operations Approved Products List (APL) or as an Approved Equivalent. Any specific

product or part listed on the APL shall be considered automatically approved and no additional

documentation is required. Other products or parts by the same manufacturer that are not listed

specifically on the APL shall be submitted for approval as an Approved Equivalent.

Any product(s), equipment, or material(s) that are not specifically listed on the APL shall require cut

sheet(s) to be submitted with the Bid package for consideration as an Approved Equivalent.

Approved Equivalent material(s) must be approved by the City Traffic Engineer, Traffic Operations

Manager, or Designee to be considered for this Agreement.

Being designated as an Approved Equivalent for this Agreement does not automatically make the

product part of the APL. Items may be added to the APL as directed in City of Tulsa Specifications,

Part 627 for Pre-Qualification for Traffic Operations Materials. The current Approved Products List

Materials or Equipment Not Listed

For any material(s) and scope of services that are not listed specifically in this Agreement, Bidders

are asked to provide a discount on all traffic signal material(s) and supplies listed in their catalogs to

allow them to also be purchased using this Agreement. Bidders shall indicate the percentage

discount on the manufacturer’s published price list on Exhibit A.
