Description
These services are included on the Procurement List maintained by the Committee for Purchase from People Who Are Blind or Severely Disabled. FAR 6.001(b) states that full and open competition requirements do not apply to contracts awarded using procedures authorized by statute. FAR 8.002(a)(2) requires that services on the Procurement List be procured through the procedures described in FAR Subpart 8.7, Acquisition from Nonprofit Agencies Employing People Who Are Blind or Severely Disabled (which describes the “AbilityOne Program”). Specifically, FAR 8.704(a) requires the Government to purchase supplies or services on the Procurement List, at prices established by the Committee, from AbilityOne participating nonprofit agencies (NPAs) if they are available within the period required. FAR 8.704(a)(2)(i) establishes AbilityOne participating
NPAs as having first priority for service contracts. Thus, this requirement is excepted from the full and open competition requirements as the services contemplated by the requirement must be procured in accordance with the statutorily
prescribed procedures of the AbilityOne program.
