Description:

Scope of Work

The selected consultant (“Consultant”) will provide comprehensive advisory and technical support to SUNY Upstate Medical University (“Upstate”) in the preparation and submission of a Certificate of Need (“CON”) application to the New York State Department of Health (“NYSDOH”). This engagement will support the proposed new construction of the Upstate Hospital “Annex” (located at the Downtown Campus at 750 East Adams Street, Syracuse, New York 13210). The Annex will include a new adult Emergency Department supporting Upstate’s Level 1 Trauma Center, Intensive Care inpatient beds including a Burn Unit, several new operating rooms, and infrastructure required to support these services.

Key responsibilities shall include:

  • Assessing the regulatory requirements and strategic considerations necessary for CON submission.
  • Coordinating with Upstate’s stakeholders, architects, and planners to compile necessary documentation.
  • Drafting and finalizing the CON narrative and associated schedules, including justifications for need, financial feasibility, staffing, and service impact.
  • Providing project management guidance to ensure timely and compliant submission.
  • Representing the University in discussions with DOH staff and responding to requests for additional information.

The consultant must have demonstrated experience preparing and submitting successful CON applications for hospital construction projects in New York State.

Minimum Qualifications (Mandatory Requirements)

Respondents must meet all of the following criteria to be considered for award:

  1. Certificate of Need Experience: At least five (5) years of demonstrated experience preparing and submitting Certificate of Need (CON) applications in New York State for healthcare construction or renovation projects.
  2. Familiarity with NYSDOH Regulations: Proven expertise with New York State Department of Health (NYSDOH) regulatory requirements and CON review processes, including knowledge of applicable sections of Title 10 NYCRR.
  3. Hospital Construction Projects: Direct experience supporting at least two (2) CON applications for new construction or major renovations of acute care hospitals or emergency departments in the past seven (7) years.
  4. Healthcare Planning and Cost Analysis: Demonstrated ability to analyze service utilization, patient access needs, financial feasibility, and operational planning to support project justification and compliance with NYSDOH standards.
  5. Communication with Regulatory Authorities: Experience engaging directly with NYSDOH staff during the CON review process, including addressing Requests for Additional Information (RAIs) and participating in informal conferences or Project Review Committee meetings.

References: Ability to provide at least two (2) client references from prior CON projects within New York State involving similar scope and complexity.

Pricing: Please provide the hourly consultant rate for these four titles (or your firm's equivalent): (i) President/Sr. Partner; (ii) Senior Associate/Consultant; (iii) Associate/Consultant; and (iv) Assistant/Administrative Support.
