Construction Scope of Work
VAWNYHS Demolition and Abatement IDIQ

General Information

1.1 Location
Work performed under this scope shall be for and conducted within the VA Western New York Healthcare System (VAWNYHS) at the Buffalo VA Medical Center, located at 3495 Bailey Avenue Buffalo, NY 14215, and Batavia VA Medical Center, located at 222 Richmond Avenue, Batavia, NY 14020.

1.2 Purpose
This Statement of Work is for an Indefinite Delivery/Indefinite Quantity (ID/IQ) Contract for demolition and abatement efforts supporting construction and repair services at VAWNYHS Medical Centers. These services shall be provided on an as needed basis, for a five-year term. VAWNYHS has various sized projects that require a Contractor to perform the demolition and abatement portion of this work necessary to accomplish this goal.

1.3 Scope

A description of all individual demolition and abatement tasks covered under this ID/IQ contract can be found in Line Items table of this contract. The contractor shall provide all labor, materials, equipment, tools, transportation, supervision, safety, quality control and management necessary to fulfill the requirements of task orders issued by the Government under this contract. For this contract, the minimum order over the five year life-span of this contract shall be $10,000.00, the total dollar value of this contract shall not exceed $1.5 million. All work completed under this contract shall follow applicable Infection Control and 12 NYCRR part 56 Abatement requirements. Additional administrative and management related requirements are described in Section 3: Requirements. Material testing and air monitoring services required while performing asbestos removal services shall be provided by the VAWNYHS at no cost to the contractor.

The Contractor shall have an active New York State Department of Labor Asbestos Handling License.

All technicians working under this contract on abatement activities shall have an active New York State Department of Labor Asbestos Certificate with one of the following endorsements:

Asbestos Handler (worker)
Supervisor


1.3.1 Site Conditions, As-Builts and Record Documents
Although the VA makes every effort to keep drawings current to existing conditions, changes and updates are sometimes not recorded. It is therefore the Contractor s responsibility to perform field investigation and verify of the accuracy of any drawings or directions with the actual conditions prior to starting any demolition or abatement planning. The contractor shall perform a site visit with the Contracting Officer s Representative (COR) to check existing conditions at the project site upon receiving a request for services, prior to providing a quote.

1.3.2 Quality Assurance/Quality Control Plan
The Contractor shall be responsible for reviewing work they complete as well as work done by any subcontractors that the Contractor has hired to assist with the completion of this SOW. The Contractor shall provide the Government with a Quality Assurance/Quality Control (QA/QC) Plan documenting the methods, processes, procedures that are going to be implemented by the Contractor to validate the work that they and their subcontractors perform.

1.3.3 Hazardous Materials
The VA does anticipate Hazardous Material Removal for this project. If additional material above and beyond what was estimated in the identified task is identified by the Contractor, the Contractor shall stop work and notify the COR.

1.3.4 Personal Protective Equipment (PPE)
The Contractor shall be responsible for obtaining/providing, inspecting, and maintaining any required Personal Protective Equipment (PPE) necessary to perform services identified under this contract.

Approach
Upon issuing a request for services under this contract, the COR shall provide an order package to include: scope of work, required documentation, signage and any other requirements needed to complete the necessary work. The contractor shall be required to submit all work plans to meet or exceed requirements in associated specifications for the work being performed. Though the base contract does not require the contractor to obtain performance or payment bonds, any individual project to be awarded under this ID/IQ contract exceeds $35,000.00 the contractor shall provide the Contracting Officer (CO) with either a payment bond or an irrevocable letter of credit as stated in FAR 28.102-1 (b) before a notice to proceed can be issued.

Phasing
Once the COR has determined the need for services under this contract, the COR shall notify the contractor of the requirement and provide the Contractor with a written description of the project. The Contractor shall have two weeks to make a site visit with COR to confirm project requirements and submit a quote for the required services based off the appropriate contract line items. The COR shall approve the contractor s quote and schedule work to be performed. All project work shall be completed within four weeks of quote acceptance. If it is rejected, the Contractor has two business days to resubmit their quote.

Although there is no formal phasing required for this project, work plans shall be submitted by the contractor and approved by the COR prior to starting any required demolition or abatement. The submitted work plans shall detail all Infection Control Risk Assessment and 12 NYCRR part 56 requirements as applicable, along with necessary phasing.

Off-Hours & Weekend Work
Regular business hours shall be defined as Monday through Friday from 8am to 4:30pm, excluding Federal holidays as listed in paragraph B below. All services shall be performed during normal business hours of coverage.

Any other day specifically declared by the President of the United States to be a National holiday.
The contractor shall provide a percentage rate increase for all services provided in this contract that need to be done outside of regular business hours.

Emergency Call-ins

One of the primary purposes of this contract is to have all the associated services to be utilized in the event of an emergency. If the COR or any other designated VHA employee determines the need for services covered under this contract due to an emergency, the contractor shall respond to that call within thirty (30) minutes and be onsite within two (2) hours ready to mobilize.

1.8 Site Information

1.8.1 Safety
All Contractor personnel working onsite at the Medical Center shall be required to attend a Buffalo VAMC site specific safety training class. This class shall be held on site and shall be taught by a member of the Buffalo VAMC safety office. Attendance to this class and proof of the 10-hour OSHA requirement will allow Contractor personnel to obtain a photo ID badge from the Buffalo VAMC Police. All Contractor personnel shall always wear this badge above the waist while on the Buffalo VAMC campus. Participation in this class is mandatory and must be done prior to the commencement of work on-site.

If this training has been completed previously (as evidenced by a valid Buffalo VAMC Contractor Photo ID) then no repeat training will be required until the printed expiration date. Personnel must attend the safety training class to renew an existing badge.

1.8.2 Access
Although the VAWNYHS campuses are public facilities, access to facility maintenance areas, electrical areas, mechanical areas, roof access, and certain other portions of the medical facility are restricted from the public. Accessing these areas may require advance notice, pre- approval, and scheduling to gain entry. All visits and access requests to the VAWNYHS under this scope of work shall be coordinated through the COR or Technical Contact.

1.8.3 Photography
It is VHA policy to respect the privacy of all persons (e.g., Veterans, patients, residents, members of the VHA workforce, and visitors) consistent with the needs of operating a national health care system. Privacy protections on VHA premises vary according to the needs and purposes of different types of areas, the persons included, and the purpose of the production and use of photographs, digital images, and video or audio recordings (excerpt from VHA Directive 1078).
Photography of as built and final site conditions are required actions under this SOW when photography activities are coordinated with the COR.
The Contractor shall ensure that any photographs taken do NOT include any VHA patients, members of the VHA workforce, or visitors to the VAMC facility.

2. Applicable Documents
The following documents are applicable to this Scope of Work (SOW) to the extent specified herein. While every effort has been made to ensure the completeness of this list, document users are cautioned that they must meet all specified requirements of documents cited in Section 3 of this SOW, whether they are listed here.

2.3 Non-Government Publications
All work shall be accomplished in strict accordance with the latest codes and standards. The Contractor shall follow any/all applicable standards and codes, including, but not limited to applicable NFPA standards, NEC, JCAHO, OSHA, ANSI, ASHRAE, and any other codes.

2.4 Order of Precedence
In the event of a conflict between the text of this document and the references cited herein, the text of this document takes precedence. Nothing in this document, however, supersedes applicable laws and regulations unless a specific exemption has been obtained.

3. Requirements
The Contractor shall provide personnel, material, services, and facilities to perform, accomplish, and deliver the required services detailed in this scope of work.

3.1 General
This section contains general information that is applicable for the duration of the contract (i.e., applies to all Parts of this effort).

3.2 Submittals
The contractor shall provide submittals and shop drawings for review prior to starting work. All submittals are required to be approved prior to the start of work.

Provide a transmittal with each submittal containing project title, location, project number, date, subcontractor name if applicable, associated section of specification, product identification, and revision number if submittal is not initially approved.

The VA review period for submittals is 10 business days. The VA will return submittals to the
contractor notated as Approved , Approved as Noted , Revise and Resubmit or Not Reviewed .

A generic submittal log has been generated for this effort and represents a list of the minimum required submittals based upon the current construction documents. Although every attempt has been made to ensure that this list is complete, additional submittals not listed may be required. If requested, the government can provide the contractor with a submittal log tracker that can be used to track status of open submittals. If the contractor plans to use an internal document to track submittals, a copy shall be sent to the COR for edits/approval as necessary.

3.3 Construction Inspections
Periodic formal and informal construction inspections will be performed by VA staff throughout the construction process to assess the quality and compliance of the project in comparison to the Contract Documents. Typical inspection examples include review of safety, dust and infection control systems and configurations, review of waste management and disposal procedures and adherence to required abatement procedures when applicable.
Any findings identified during an inspection as having a negative impact on the project will be photographed, documented in writing, and delivered to the contractor.
The Contractor shall respond in writing and provide evidential proof of compliance/rectification/resolution to each finding identified. Some findings may require resolution prior to moving to the next construction process.

4. Verification
Final inspection of the completed demolition or abatement work shall be conducted jointly before final acceptance of the project requirements. The groups that will participate in the verification process include:
Prime Contractor
Subcontractor (as applicable)
VA Engineering
These inspections will be based upon cleanliness and thorough completion of required work activities and will be checked against VA regulatory requirements and submittals as applicable.
Any work that does not pass inspection will be provided to the Contractor in the form of an outstanding item checklist which will be required to be completed for the Government to recognize successful completion of the required project tasks.

5. Records Management
Contractor shall not create or maintain any records that are not specifically tied to or authorized by the contract using Government IT equipment and/or Government records.
Contractor shall not retain, use, sell, or disseminate copies of any deliverable that contains information covered by the Privacy Act of 1974 or that which is generally protected by the Freedom of Information Act.
Contractor shall not create or maintain any records containing any Government Agency records that are not specifically tied to or authorized by the contract.
The Government Agency owns the rights to all data/records produced as part of this contract.
The Government Agency owns the rights to all electronic information (electronic data, electronic information systems, electronic databases, etc.) and all supporting documentation created as part of this contract. Contractor must deliver sufficient technical documentation with all data deliverables to permit the agency to use the data.
Contractor agrees to comply with Federal and Agency records management policies, including those policies associated with the safeguarding of records covered by the Privacy Act of 1974. These policies include the preservation of all records created or received regardless of format (paper, electronic, etc.) or mode of transmission (email, fax, etc.) or state of completion (draft, final, etc.).
No disposition of documents will be allowed without the prior written consent of the Contracting Officer. The Agency and its contractors are responsible for preventing the alienation or unauthorized destruction of records, including all forms of mutilation. Willful and unlawful destruction, damage or alienation of Federal records is subject to the fines and penalties imposed by 18 U.S.C. 2701. Records may not be removed from the legal custody of the Agency or destroyed without regard to the provisions of the agency records schedules.
Contractor is required to obtain the Contracting Officer s approval prior to engaging in any contractual relationship (sub-contractor) in support of this contract requiring the disclosure of information, documentary material and/or records generated under, or relating to, this contract. The Contractor (and any sub-contractor) is required to abide by Government and Agency guidance for protecting sensitive and proprietary information.

6. Autodesk build construction management platform:
The Contractor shall utilize VISN 2 Autodesk Build Construction management platform, also called Autodesk Construction Cloud (ACC).
Access to the platform and training portal will be provided by VISN 2 through project Contracting Officer Representative (COR) at no cost for the duration of the project. Autodesk Build is the management and collaborative environment that VISN 2 uses for all its Non-Recurring Maintenance (NRM), Minor Program projects, Feasibility Studies, Commissioning and Retro-Commissioning contracts. There is no user, license, or subscription fee to the contractor for using this cloud-based platform.
The Contractor shall accomplish and complete the following tasks upon award of contract:
Request access to ACC platform and ProductivityNOW eLearning Site to project VA COR within 14 days of contract award. Only staff that shall utilize the platform to be granted access. Examples: Project manager, sub-contractors POC, Site manager, Safety officer, etc.
The access request shall be in writing and include a list of staff. The list shall include the following information:

Company Name
Email Address
Role/Position on the project (i.e., Project manager, site supervisor)
Contractor staff granted access to the ACC platform shall complete ACC training through ProductivityNOW eLearning platform and provide certificates of completion to COR within 12 Calendar days of access being granted. Initial access to ProductivityNOW eLearning platform shall expire after 12 Calendar days after online access is granted.
Additional Staff and Subcontractors can be added at any time with a request submission to the project COR.
The contractor shall only use the ACC platform for contract required submissions, official project correspondence to be acknowledged, reviewed, and actioned by the responsible party. No additional time shall be added to the contract, nor an increase in contract amount be provided for the contractor s failure to utilize the ACC platform as the project s official communication and collaboration system. Any correspondence out of platform shall not be the governing authority contradicting direction and will be at the contractor s expense. Official project correspondence and collaboration includes but not limited to: RFIs, submittals, schedules, shutdown requests, actionable tasks, reports, testing, safety inspections, photos, and site surveys.
Contractor shall inform the COR of any staff changes within 2 business days from the change. Staff changes pertains to staff granted access to the ACC platform. Contractor shall request termination of access, replacement of personnel and/or any other action that might impact the contractor ability to maintain required utilization of the platform.
Contractor submission requirements cannot be accepted for work to begin without meeting all ACC Platform requirements outlined herein, including completing required ACC platform training.
