Description



This is a notice of intent, not a request for a quotation. A solicitation document will not be issued, and quotations will not be requested.



The National Institutes of Health (NIH), Office of Purchasing and Contracts on behalf of the Clinical Center (CC), Center for Cellular Engineering (CCE) intends to award a fixed price contract on a sole source basis to Bio-Rad Laboratories, Inc., 2000 Alfred Nobel DR Hercules, California



94547-1801 for a twelve (12) month base year and four (4) option years for a service contract on two QX200 AutoDG ddPCR Systems (Serial Number: 771BR3558/773BR1880 & Serial Number: 773BR2063/771BR4088).



The Center for Cellular Engineering (CCE) currently owns two (2) Bio-Rad QX200 AutoDG ddPCR Systems. The instruments are used for accurately assessing gene modification efficiency in clinically engineered cell products. The assessment provides vital data that informs treatment decisions, ultimately enhancing the effectiveness of cellular therapy products administered to patients. Preventative Maintenance is necessary to ensure that the instruments are within the manufacturer standards and in compliance with the Food and Drug Administration (FDA) regulations (21 CFR 211.67). Bio-Rad is the sole manufacturer and service provider for both instruments. The service contract will provide proprietary parts, remote diagnostic, field service support, preventative maintenance, and software upgrades. Bio-Rad does not have third-party providers and only Bio-Rad service technicians are authorized to perform service on its equipment. If a third-party service provider performs any services on the equipment, it may violate the manufacturer’s warranty. The continuation of the service contract is imperative in ensuring that the equipment stays within its operational state.



This acquisition is being conducted using policies unique to the Federal Acquisition Regulation (FAR) Part 13 – Simplified Acquisition Procedures, Subpart 13.106-1(b)(1), For purchases not exceeding the simplified acquisition threshold (SAT), contracting officers may solicit from one source if the contracting officer determines that the circumstance of the contract action deem only one source reasonably available. Contracts awarded using FAR Part 13-Simplified Acquisition Procedures are exempt from the requirements of FAR Part 6-Competition Requirements.



Interested parties may identify their interest and capabilities in response to this posting. The determination by the Government not to compete the proposed requirement based upon responses to this notice is solely within the discretion of the Government.
