The CFPB intends to contract with National Consumer Law Center on a sole source basis, under authority 6.302-1, for a subscriptionto NCLC Digital Library Subscription. National Consumer Law Center has been identified as the only source capable of providing the required content in an arrangement that suits the needs of the CFPB.



The proposed contractor’s unique qualifications and the nature of the acquisition requires use of the authority cited as follows:



The National Consumer Law Center is the sole producer of this unique content (see list below) and they do not license or authorize any other provider to sell and support access and use of the content on their platform. This scholarly material is specific and unique and is not published elsewhere. It is highly referenced and cited by professionals in the field of consumer law.



No equivalent content can replace the specific research produced and available in this collection of treatises by the National Consumer Law Center. The content on the National Consumer Law Center’s platform is updated continuously and includes information critical to the ongoing regulatory mission of CFPB. Immediate, unmediated access allows researchers to consult the literature without waiting for assistance from a librarian to procure articles as needed. By purchasing both print and online access to this content directly from the producer, the CFPB provides all staff and on-site contractors with copyright permissions to share the content within the Bureau. Without this coverage, CFPB could find itself liable for violating the copyrights of the publisher by sharing information produced by the National Consumer Law Center.



This content produced is used for the research and regulatory activities within CFPB and the currency of the information is critical for the successful function. The National Consumer Law Center provides IP-authenticated access to their platform and to all current content published during the License term and retrospective content as well as tables of content, full text and illustrations and any additional electronic content not included in the print versions.
