Notice of Intent – PTAG 6.1.1 Sole Source
The United States Patent and Trademark Office (USPTO), Office of the Under Secretary (OUS), intends to negotiate and award a sole‑source contract for the design, fabrication, rental (Alexandria, VA), installation, maintenance, and optional purchase of an exhibit for the Freedom 250. The primary exhibit will occupy approximately 2,400 square feet within the USPTO Alexandria, Virginia building.
This requirement will be procured using the Alternative Competition Method in accordance with the Patent and Trademark Office Acquisition Guidelines (PTAG) and under the Patent and Trademark Office Efficiency Act, 35 U.S.C. 2(b)(4)(A). The USPTO is exempt from the Competition in Contracting Act (CICA) for this procurement. The USPTO intends to award a sole‑source order to LCOR Alexandria LLC because LCOR is the landlord and building owner-manager for the USPTO facility in which the exhibit will be constructed and installed. LCOR has unique control and authority over landlord-controlled building structure, common areas, loading and delivery access, staging locations, construction scheduling, alteration approvals, and coordination with base‑building systems and building management (including electrical, Heating Ventilation and Cooling (HVAC), fire/life safety, and security-related systems). Because the work will occur within an occupied leased building and will affect or interface with landlord-controlled property, only LCOR can reasonably approve, coordinate, and manage all aspects of this requirement as prime contractor. Requiring LCOR to serve as prime contractor will ensure a single point of responsibility for subcontractor oversight, work sequencing, access control, inspections, protection of existing conditions, and restoration of landlord-owned property. No other source can accomplish these landlord‑controlled approvals and coordinated responsibilities absent direct landlord involvement.
