MONTGOMERY COUNTY SCHOOLS LEGAL SERVICES
The Montgomery County Schools Board of Education (MCBOE) invites proposals from
qualified attorneys to serve as general counsel to MCBOE and the local school administrative
unit it governs, the Montgomery County Schools (MCS).
District Background Information
Montgomery County Schools consists of 11 schools: Candor Elementary, Green Ridge
Elementary, Mount Gilead Elementary, Page Street Elementary, Star Elementary, Troy
Elementary, East Middle, West Middle, Montgomery Learning Academy, Montgomery County
Early, Montgomery Central High School serves approximately 3500 students in grades
Preschool-12 and employs approximately 500 employees.
The Montgomery County Board of Education consists of seven elected Board of Education
members who serve four-year terms. The MCBOE is a non-partisan elected Board. The MCBOE
generally holds one meeting per month, typically the first month. The MCBOW also holds
special meetings from time to time.

Purpose of the RFP
The district is seeking an attorney or firm well versed in education law, particularly federal and
state statutory and case law governing public education, civil service, human resources and
general municipal matters in North Carolina. Additionally, the attorney or firm should be able to
provide a broad range of legal services and prepare legal documents required by the MCBOE
and the Superintendent to carry out the day-to-day operations of Montgomery County Schools.
The attorney or firm representing Montgomery County Schools will be expected to provide the
following services:
Attend all Board regular business meetings, including Closed Sessions;
Attend all Board work sessions and Special Called meetings;
Attend meetings with committees or third parties upon request of the MCBOE;
Provide advice and consultation to the Board of Education / Board Chairperson and the
Superintendent/Designee regarding legal matters;
Represent and negotiate on behalf of the Board in legal matters;
Review and/or draft potential MCBOE decisions and contractual agreements and make
recommendations to the Board;
Review and draft Board policies in a compliant and timely manner;
Be available on short notice to handle time-sensitive, pertinent matters;

Provide necessary training to the MCBOE/designated staff on procedural guidelines to
conduct Board business, and admonish and advise the Board when potential procedural
violations appear imminent;
Serve as an advocate for the Board of Education;
Fulfill other legal duties consistent with legal competence as are commonly accepted and
assigned to the role of the School Board Attorney.
Requirements
Law firms and attorneys wishing to submit proposals must be licensed to practice law in North
Carolina and must provide detailed documentation regarding their credential, experience, and
qualifications to serve as general counsel for the Montgomery County Board of Education and
Montgomery County Schools. Appropriate evidence of insurance coverage must be included in
the proposal. All proposals must be made in writing and must include a list of references,
including recent or current North Carolina public school district clients, if applicable.
Written proposals must in detail the proposed fee structure, including hourly rates for partners,
associates and paralegals; costs (other attorney fees) that may be billed in connection with the
provision of legal services, and any monthly retainers. If a retainer is proposed, proposal must
specify any legal services that would be covered by the retainer.
Eight (8) copies of the proposals must be submitted by U.S. mail, overnight delivery or in person
addressed to: Superintendent, Montgomery County Schools – 441 Page Street, Troy, NC 27371.
The Deadline for submission of proposals is: August 31, 2026. Late proposals may be rejected as
the sole discretion of the MCBOE.
Term and Renewal
The term of the contract shall be for a period of three (3) years renewed annually. The contract
will be evaluated renewed at the sole discretion of the Montgomery County Board of Education.
Either party may terminate the contract by a ninety (90) day written notice to the other.
