Sole Source Notice - CSU MEDRAD Injector Preventative Maintenance Service

SPECIAL NOTICE / INTENT TO SOLE SOURCE

The Billings Area Indian Health Service hereby submits a notice of intent to award a sole source, firm fixed price Base Plus Two Option Year Contract for a commercially available off the shelf (COTS) service & support agreement to Bay Healthcare LLC a large business; Period of Performance will be from October 01, 2025 through September 30, 2026 and each option year to start on the 1st of October of each year and run until September 30th of each year.

The Contract is to provide a firm fixed price service and support agreement MedRad Power Injector manufactured by Bay Healthcare LLC located at the Crow Service Unit (CSU), Crow Agency Montana; The total estimated value of the Contract is estimated to be around $18,000.00; This sole source contracting action is pursuing a waiver from competing this requirement based upon the application of FAR 13.106-1(b)(1) only one responsible source and no other supplies or services will satisfy agency requirements and is based upon market research; This is based upon intellectual property copyright holder of the MedRad Power Injector owned by the company.

Responses to this notice must demonstrate clear and convincing evidence that competition would be advantageous to the Government, would not be cost or time prohibitive, and would not hinder the mission objective of agency standardization, data center standardization, and network security; The determination not to compete this proposed contract action is solely within the discretion of the Government. Information received will normally be considered for the purposes of determining whether to conduct a competitive procurement. The Government will not be responsible for any costs incurred by responding to this notice.
