Outside Counsel for Energy Legal Services

The New York State (NYS) Office of General Services (OGS) intends to retain Outside Counsel with demonstrated experience in and knowledge of electricity and natural gas (energy) related issues. Outside Counsel will provide advice to OGS Energy Planning and Procurement staff on energy and utility issues and represent OGS in all required respects, under the direction of the Legal Services staff of OGS.
These services shall include, but are not limited to:

1. Providing advice and assistance to OGS staff in both wholesale and retail markets.
2. Representing OGS in discussions or negotiations.
3. Developing and negotiating both short-term and long-term Power Purchase and Sale Agreements with energy generators and energy service companies.
4. Negotiating long-term pipeline transmission agreements.
5. Representing OGS in proceedings before the Public Service Commission (PSC), New York Independent System Operator (NYISO), electric and natural gas utilities, and the Federal Energy Regulatory Commission (FERC).

Although litigation in NYS or federal court is not anticipated, representation of OGS or working with the NYS Attorney General on behalf of OGS may become necessary and will be performed upon such terms as Outside Counsel and OGS may agree.

The contract with Outside Counsel will be for a five-year term with a maximum cap (inclusive of all fees and disbursements) of $500,000.
