The U.S. Army Contracting Command – Aberdeen Proving Ground (ACC-APG), Natick Division, in support of the U.S. Army Combat Capabilities Development Command – Soldier Center (DEVCOM-SC), Soldier Protection Directorate (SPD), intends to award a Firm Fixed Price contract on a sole source basis to Thermo Electron North America LLC located at 1400 Northpoint Pkwy Suite 10 West Palm Beach, FL, USA 33407-1976 under the authority as prescribed in FAR 13.106(b)(1). The Natick Soldier Combat Capabilities Developmental Command - Soldier Center (DEVCOM-SC) requires maintenance services for the ICP-MS Spectrometer system. Thermo Electron North America LLC and its subsidiary Thermo Fisher Scientific is/are the sole providers of this equipment and the associated services. Changing the service provider would be unsuitable as Thermo Fisher Scientific is the sole provider of factory recommended replacement parts, proprietary software updates, proprietary factory-recommended upgrades, and factory authorized escalation services.
The North American Industry Classification System (NAICS) for this requirement is 811210 and the size standard is $34,000,000.00.

Any interested party must show clear and compelling evidence that competition is in the best interest of the government. Any questions regarding this notice must be in writing; no telephonic replies will be accepted. A determination not to compete this proposed action based on any responses to this notice is solely within the discretion of the Contracting Officer. The U.S. government will not pay for any information or administrative cost incurred in response to the Notice. All costs associated with responding to this notice will be solely at the expense of the interested party.
