PUBLIC NOTICE IS HEREBY GIVEN that the City of Alhambra invites sealed bids for the above stated project and will receive such bids in the office of the City Clerk, 111 South First Street, Alhambra, California 91801, up to the hour of 10:30 a.m. on Tuesday, October 28, 2025, and 10:30 a.m. on Thursday, October 30, 2025. Refer to the schedule below for your Bid Categories’ specific bid due date. They will be publicly opened at 11:00 a.m. in the City Council Chambers. Project has a non-mandatory walkthrough of the site on Wednesday, September 24, 2025, or Wednesday, October 1, 2025, both at 10:00 a.m. at 1200 S. 7th Street, Alhambra, CA 91803.

Any contract entered into pursuant to this notice will incorporate the provisions of the State Labor Code. Compliance with the prevailing rates of wages and apprenticeships employment standards established by the State Director of Industrial Relations and the Federal government will be required.

The development of the Alhambra Community Center may be partially funded with Federal funds. If Federal funds are applied to the project, all applicable Federal requirements shall apply, including but not limited to labor standards, reporting, and procurement regulations. Prospective bidders will be notified by addendum if Federal funding is confirmed.

The City hereby notifies all qualified bidders that it will affirmatively ensure that minority business enterprises will be afforded full opportunity to submit bids in response to this invitation and will not be discriminated against on the basis of race, color, national origin, ancestry, sex, religion or handicap in any consideration for an award. Attention is directed to the provisions of Section 1777.5 (Chapter 1411, Statutes of 1968) and 1777.5 of the Labor Code concerning the employment of apprentices by the contractor shall not allow discrimination in employment practices on the basis of race, color, national origin, ancestry, sex, religion or handicap.

The City will deduct a 5 percent retention from all progress payments.

In entering into a public works contract, or a subcontract, to supply goods, services, or materials pursuant to a public works contract, the Contractor, or subcontractors, offers and agrees to assign to the awarding body all rights, title and interest in, and to, all causes of action it may have under Section 4 of the Clayton Act (15 U.S.C. Section 15) or under the Cartwright Act (Chapter 2 [commencing with Section 16700] of Part 2 of Division 7 of the Business and Professions Code), arising from purchases of goods, services, or materials pursuant to the public work’s contract or subcontract. This assignment shall be made and become effective at the time the awarding body tenders final payment to the Contractor, without further acknowledgment by the parties.

COMPLIANCE WITH SB 854 DEPARTMENT OF INDUSTRIAL RELATIONS REGISTRATION

No prime contractor or subcontractor may be listed on a bid proposal for a public works project unless registered with the Department of Industrial Relations pursuant to Labor Code section 1725.5.

No prime contractor or subcontractor may be awarded a contract for public work on a public works project (awarded on or after April 1, 2015) unless registered with the Department of Industrial Relations pursuant to Labor Code section 1725.5.

This project is subject to compliance monitoring and enforcement by the Department of Industrial Relations.

The bid proposal must include a print out from the DIR registration website showing that the prime contractor and each subcontractor is currently registered.

No bid proposals will be excepted nor any contract entered into with a prime contractor without proof of registration as required above.

The prime contractor will be required to post job site notices regarding Labor Code compliance as described in 8 California Code of Regulation section 16451(d).

Bids must be prepared on the approved Proposal forms in conformance with the Instructions to Bidders and submitted in a sealed envelope plainly marked on the outside. Bids must be accompanied by a bid bond, made payable to the City of Alhambra for an amount no less than 10 percent of the amount bid.

No bid will be accepted from a Contractor who has not been licensed in accordance with the

provisions of the Business and Professions Code. The successful Contractor and his subcontractors will be required to possess business licenses from the City. The City reserves the right to reject any or all bids, to waive any irregularity, and to take all bids under advisement for a period of sixty days.

Any contract entered into pursuant to this notice shall become effective or enforceable against the City of Alhambra only when the formal written contract has been duly executed by the appropriate officers of the City.

The contractor shall complete the work within 463 calendar days of the effective date of the City’s notice to proceed.

Miscellaneous Information

Each bid must strictly conform with and be responsive to the Contract Documents as defined in the General Conditions.

Each bidder shall submit with its bid — on the form furnished with the Contract Documents — a list of the designated subcontractors on this Project as required by the Subletting and Subcontracting Fair Practices Act, California Public Contract Code section 4100 et seq.

In accordance with California Public Contract Code section 22300, the City will permit the substitution of securities for any moneys withheld by the City to ensure performance under the Contract. At the request and expense of the Contractor, securities equivalent to the amount withheld shall be deposited with the City, or with a state or federally chartered bank as the escrow agent, who shall then pay such moneys to the Contractor. Upon satisfactory completion of the Contract, the securities shall be returned to the Contractor.

The Contractor and all subcontractors shall comply with the requirements set forth in Division 2, Part 7, Chapter 1 of the Labor Code. The City has obtained from the Director of the Department of Industrial Relations the general prevailing rate of per diem wages and the general prevailing rate for holiday and overtime work in the locality in which this work is to be performed for each craft, classification or type of worker needed to execute the Contract. These per diem rates, including holiday and overtime work, as well as employer payments for health and welfare, pension, vacation, and similar purposes, are on file at the City, and are also available from the Director of the Department of Industrial Relations. Pursuant to California Labor Code section 1720 et seq., it shall be mandatory upon the Contractor to whom the Contract is awarded, and upon any subcontractor under such Contractor, to pay not less than the said specified rates to all workers employed by them in the execution of the Contract.

The Contractor and all subcontractors shall furnish certified payroll records as required pursuant Labor Code section 1776 directly to the Labor Commissioner in accordance with Labor Code section 1771.4 on at least on a monthly basis (or more frequently if required by the City or the Labor Commissioner) and in a format prescribed by the Labor Commissioner. Monitoring and enforcement of the prevailing wage laws and related requirements will be performed by the Labor Commissioner/ Department of Labor Standards Enforcement (DLSE).

Community Workforce Agreement

This Project is subject to the requirements set forth in the Community Workforce Agreement for Construction and Major Rehabilitation by and Between the City and the Los Angeles/Orange Counties Building and Construction Trades Council and the Signatory Craft Unions approved by the City Manager on June 10, 2021 and any amendments thereto (collectively, the “CWA”). All bidders and their respective Subcontractors (as defined in the CWA) must review carefully the CWA and all of its requirements before submitting a bid for the Project. The Contractor and all Subcontractors (of any tier and as defined in the CWA), must agree to be bound by the terms and conditions of the CWA directly or through the Letter of Assent in the CWA prior to commencing any work on the Project. The

Contractor and all Subcontractors of every tier and as defined in the CWA must cooperate and coordinate its work on the Project with the designated Community Workforce Coordinator as required in the CWA.

Separate payment and performance bonds, each in an amount equal to 100% of the total Contract amount, are required, and shall be provided to the City prior to execution of the Contract and shall be in the form set forth in the Contract Documents.

All bonds (Bid, Performance, and Payment) must be issued by a California admitted surety as defined in California Code of Civil Procedure section 995.120.

Any request for substitutions pursuant to Public Contract Code section 3400 must be submitted no less than (10) ten calendar days before the bid date, on the Substitution Request Form set forth in the Contract Documents. Any rejection or approval will be communicated in an addendum, dually issued.

It is each bidder’s sole responsibility to ensure its bid is timely delivered and received at the location designated as specified above. Any bid received at the designated location after the scheduled closing time for receipt of bids shall be returned to the bidder unopened.
