Notice is hereby given that the City of La Marque will receive sealed bids for the Maintenance
Services for the Wastewater Treatment Plant, Lift Stations, and Water Facilities.

Bids should be submitted in THREE Copies and a flash drive on the proposal forms and
enclosed in a sealed envelope and plainly marked on the outside of the envelope, which clearly
identifies it as being “LM #26-05 Maintenance Services”.
THE CITY OF LA MARQUE DOES NOT ACCEPT FAXED OR EMAILED BIDS.

TERMS AND CONDITIONS
1. Specifications and bidding documents may be secured from the City of La Marque website
at: www.bids.cityoflamarque.gov.
2. The City reserves the right to reject any or all bids and to waive informalities in bidding. In
case of ambiguity or lack of clearness in stating the prices in any bid, the owner reserves
the right to consider the most advantageous thereof, or to reject the bid. The award will be
given to the responsible bidder submitting the lowest acceptable bid.
3. It shall be a breach of ethics to offer, give or agree to give any employee or former
employee of the City of La Marque, or for any employee or former employee of the City of
La Marque to solicit, demand, accept or agree to accept from another person, a gratuity or
an offer of employment in connection with any decision, approval, disapproval,
recommendation, preparation of any part of a program requirement or purchase request,
influencing the content of any specification or procurement standard, rendering of advice,
investigation, auditing, or in any other advisory capacity.
4. It shall be a breach of ethics for any payment, gratuity or offer of employment to be made
by or on behalf of a subcontractor under a contract with the prime contractor or higher tier
subcontractor for any contract for the City of La Marque.
5. Before submitting a bid, each bidder must:
Examine the contract documents thoroughly
Visit the site
Familiarize themselves with applicable regulations
Study and correlate bidder observations
6. The submission of a bid constitutes understanding of all requirements.
7. Bids will be rejected if:
Received after deadline
Not submitted on bid form
Not signed properly
8. This contract is issued by an organization that qualifies for exemption under Article
20.04(f) of the Texas Limited Sales, Excise, and Use Tax Act. The contractor may
purchase, rent, or lease materials, supplies, and equipment used in the performance of this
contract by issuing an exemption certificate to their supplier in accordance with State
Comptroller’s Ruling No. 95-0.07. All exemptions shall be subject to State Comptroller’s
Ruling No. 95-0.09, as amended and effective October 2, 1968.
9. The City reserves the right to revise or amend these specifications prior to the bid opening
date. Any changes will be issued by addendum and distributed to all prospective bidders.
10. Unit prices shall include all charges, including bid unit price, specified quantities, and total
cost. In the event of a discrepancy between unit price and extended total, the unit price
shall govern.

11. No payment will be made to the contractor until all work is completed and accepted by the
City. Payment will be made within thirty (30) days of receipt of a properly submitted invoice.
12. Bids may not be altered or amended after the bid opening time. Any changes made prior to
the bid opening must be initiated by the bidder or their authorized representative. No bid
may be withdrawn after opening without written approval from the City and submission of
an acceptable written explanation.
13. This contract shall be for a period of one (1) year beginning October 1, 2026. The City
must obtain pricing in advance to prepare for the upcoming fiscal year budget. After the
initial twelve (12) month term, the agreement may be renewed on a monthly basis and
may be negotiated for an additional one-year term with the mutual consent of both parties,
provided such negotiation occurs at least thirty (30) days prior to the expiration of the initial
agreement. The Contractor shall provide the City with all documentation supporting any
proposed price changes for City Council approval. Either party may terminate this
agreement with thirty (30) day written notice to the other party.
14. The vendor hereby assigns to the purchaser any and all claims for overcharges associated
with this contract that arise under the Antitrust Laws of the United States, 15 U.S.C.A. §1
et seq. (1973).
15. The city of La Marque reserves the right to award all sections to a single bidder or a
separate bidder.
16. Bid received after the closing time will be returned unopened.
PRICE REVISION CLAUSE:
Whenever possible, the City prefers firm pricing for the full contract period. However, it is
recognized that bidders may be unwilling to guarantee unit prices for the entire contract term
due to potential changes from their source of supply.
In such instances, an asterisk (*) must be placed next to any item for which the bidder is
unwilling to guarantee pricing for the full contract period. The duration of the guaranteed pricing
period must be noted on a separate sheet. These items will be subject to price adjustments due
to increases or decreases in the bidder’s source of supply during the term of the contract.
INCREASES:
Permissible price revisions shall not exceed the actual unit cost or percentage cost increase
from the bidder’s source of supply. The City will generally accept price increases noted in the
bid proposal when such increases are reasonable and within the limits described above.
However, the City reserves the right to obtain items from an alternate source if price increases
are deemed excessive.
DECREASES:
If a vendor utilizes this price revision clause, any decrease in cost from the bidder’s source of
supply during the contract term shall be passed on to the City.

NOTICE REQUIREMENT:
The City must receive thirty (30) days written notice prior to any price increase or decrease. Bids
submitted without pricing information will not be considered. Additionally, bids based on prices
in effect at the time of shipment will not be accepted.
Item No. 1 — General
The City of La Marque is requesting bids from qualified contractors to provide maintenance,
repair, and support services for City water and wastewater facilities.
Facilities included under this contract include, but are not limited to:
Wastewater Treatment Plant
Lift Stations
Water Facilities
Water Wells
Booster Stations
Ground Storage Tanks
Elevated Storage Tanks
Associated piping, valves, and equipment
Services shall be provided on an as-needed basis. The City does not guarantee any minimum
amount of work under this contract.
It is the intent of the City of La Marque to establish a contract with one or more qualified
contractors to provide maintenance services, for a twelve (12) month period.
After the initial twelve (12) month term, the agreement may be negotiated for an additional one-
year term, for up to four (4) consecutive years, with the mutual consent of both parties. Such
negotiations must occur at least thirty (30) days prior to the expiration of the initial agreement.
The Contractor shall provide the City with all documentation supporting any proposed price
changes for City Council approval. Failure of the City and the successful Contractor to reach
agreement on negotiated pricing shall require the City to rebid the contract.
Either party may terminate the agreement with thirty (30) days written notice to the other party.

Item No. 2 — Scope of Services
Services may include, but are not limited to:
Pump repair and replacement
Motor repair and replacement
Valve repair and replacement
Piping repair and replacement
Electrical troubleshooting and repair
Instrumentation troubleshooting and repair
Mechanical maintenance and repair
Equipment installation
Preventative maintenance
Emergency repairs
Structural repairs
General facility maintenance
Lift station maintenance and repairs
Well maintenance and repairs
Item No. 3 — Contractor Requirements
The Contractor shall:
Provide qualified personnel
Provide necessary tools and equipment
Provide supervision
Coordinate work with City staff
Maintain clean work areas
Comply with all applicable regulations
Provide emergency response capability
Provide necessary licenses and certifications
Item No. 4 — Safety Requirements
The Contractor shall comply with all applicable federal, state, and local safety regulations.
Contractor shall:
Follow OSHA safety requirements
Provide proper personal protective equipment (PPE)
Follow confined space entry requirements
Follow lockout/tagout procedures
Provide trained personnel
Maintain safe work areas
Report unsafe conditions
