PART II: INSTRUCTIONS TO BIDDERS
2026 Fleet Services Building Roof Overlay
Summary
The City of Oconomowoc (Owner) is soliciting bids from qualified service providers for a
roof overlay at our Fleet Services Building, 801 S Worthington St, Oconomowoc, WI 53066.
Listed within each of the tasks defined below are key items to be completed. The proposed
project includes the following:
Prebid Site Review
Prospective bidders are required to visit the site to inspect the roof by making an
appointment with Justin Wild at 262-569-3193 or jwild@oconomowoc-wi.gov.
Appointments are available July 13-24, 2026, Monday-Friday between 7am and 2pm.
Background
Building constructed in late 1980's has a steel framed roof which currently drains to grade
via exterior downspouts. HVAC system including air handling units, exhaust fans and misc.
system components are located on the roof. In 2015 "Eterna-Seal" spray on rubber roof
system was applied to entire surface, seams, fasteners, flashing and ridge caps.
Scope of Work
Primary Project - Roof Overlay
All work shall be in conformance with manufacturer specifications. Work performed will
require full inspection of existing roof, fasteners and venting during Prebid Site Review
appointment. All components shall be Carlisle, Syntel or equivalent. Membrane shall be
60 mil. EPDN in largest sheet possible with 3" or 6" factory applied tape. Membrane shall
conform to minimal physical properties of ASTM D4637.
Optional Add on - Roof Access
Add a ladder and "Bilco" type access door from interior shop mezzanine.

Preparation of Bid
Bids shall be submitted using provided Bid Form. Include in your bid total everything
required to perform, furnish, provide labor, materials, necessary tools, equipment and all
transportation to complete all work in this bid request. The City shall not be liable for any
costs incurred to prepare or submit a bid for this project.

All bids will be opened and publicly read aloud at a meeting immediately following the
1:00PM submission deadline on August 6, 2026, at the Utilities Building small conference
room, 808 S Worthington St, Oconomowoc, WI 53066. Proposals received after the deadline
will not be accepted. It is neither the City's responsibility nor practice acknowledging receipt
of any bid. It is the responder's responsibility to ensure that a bid is received in a timely
manner.
Withdrawal of Bids
Bidders may withdraw their bid at any time prior to the scheduled time for bid receipt. No
bids shall be withdrawn for a period of 60 days after the scheduled opening of the bids
without Owner consent.
Evaluation of Bids and Award of Project
Owner expressly reserves the right to reject any or all bids that are nonconforming, non-
responsive or conditional. Owner reserves the right to reject the bid of any bidder whom it

finds, after reasonable inquiry and evaluation, to not be responsible. Owner may reject
the Bid of any Bidder if Owner believes that it would not be in the best interest of the
project to make an award to that Bidder. Owner also reserves the right to waive any
informal or technical irregularities and to waive all informalities not involving price,
time, or changes in the Work and to negotiate contract terms with the successful
Bidder.
In evaluating Bids, Owner will consider whether the Bids comply with the prescribed
requirements and such alternates, unit prices and other data as may be requested in
the Form of Bid Proposal or prior to the Notice of Award.
In evaluating Bidders, Owner will consider their qualifications through written evidence
and the data from the Qualification Questionnaire. The Owner may conduct other
investigations as they deem necessary.
If the Contract is to be awarded, Owner will award the Contract to the Bidder based on
Wisconsin Statues and Qualification Questionnaire, including the Safety Performance
section. The City reserves the right to reject any or all proposals, waive any informality
and accept the proposal which serves the best interest of the City of Oconomowoc.
Bid and Contract Security
The Bidder will execute and file the Performance Bond, Payment Bond, and Insurance
Certificate(s) as required by this Request for Bid, within fifteen days after receipt of the
Notice of Award.
The Bidder to whom a project is awarded will be required to furnish a Performance and
Payment Bond to the Owner, in an amount equal to one hundred percent (100%) of the
Bid Price. The Bonds shall be executed on the form included in the Contract
Documents by a Surety company authorized to do business in the State of Wisconsin
and acceptable as Surety to the Owner. Accompanying the Bonds shall be a "Power of
Attorney" authorizing the attorney-in-fact to bind the Surety company and certify to
include the date of the Bond.
If the Bidder fails to file the Performance and Payment Bonds and Insurance
Certificate(s) as required by the REQUEST Documents, the contractor will not be
allowed to start any part of the project.
Bid Forms
Only Bids submitted on the Bid Form attached hereto will be considered. No Bid will be
accepted, which does not contain an adequate or reasonable price for every item
named in the Bid schedule.

Bidders Responsibility to Examine Work & Site
Bidders are required to examine all specifications and must satisfy themselves by
personal examination of the proposed work site or by such other means as they may
prefer, to determine the scope of the Work. Upon request, all available information in
the possession of the Owner will be shown to Bidders, but the correctness of any such
information is not guaranteed.
Bidders shall not at any time after the submission of their proposal dispute or claim to
the Owner a plea of ignorance of conditions that exist or of conditions or difficulties that
may be encountered in the execution of the Work under this contract. Failure to make
the necessary examination and investigation will not be accepted as an excuse for any
failure or omission on the part of the Contractor to fulfill all the requirements of said
contract and specifications, nor will it be accepted as a basis for any claims for extra
compensation.
Non-Discrimination Statement
The City of Oconomowoc does not discriminate based on race, color, religion, age,
marital or veterans' status, sex, national origin, disability, or any other legally protected
status in the admission or access to, or treatment or employment in, its services,
programs or activities.
Contractor's Insurance
The Contractor shall not commence work under this contract until he has obtained all
insurance required under this paragraph and such insurance has been approved by the
Owner, nor shall the Contractor allow any subcontractor to commence work on his
subcontract until all similar insurance required of the Subcontractor has been so
obtained and approved.
Compensation Insurance. The Contractor shall take out and maintain during the life of
this contract, Workman's Compensation Insurance for all of his employees employed
at the site of the project and, in case any work is sublet, the Contractor shall require the
Subcontractor similarly to provide Workman's Compensation Insurance for all of the
latter's employees unless such employees are covered by the protection afforded by
the Contractor.
Public Liability and Property Damage Insurance. The Contractor shall take out and
maintain during the life of the contract such public Liability and Property Damage
Insurance as shall protect him from any damages for personal injury, including
accidental death, as well as from claims for property damages, which may arise from

operations under this contract, whether such operation be by himself or by any Sub-
contractor or by anyone directly or indirectly employed by either of them and the
amounts of such insurance shall be as follows.
Public Liability Insurance in an amount not less than $1,000,000.00 for injuries or
accidental death to any one person on account of one accident, and Property Damage
Insurance in a like amount Insurance Covering Special Hazards. The following special
hazards shall be covered by rider or riders to the Public Liability and/or Property Damage
Insurance Policy or Policies herein required to be furnished by contractor or by
separate policies of insurance, in amounts as follows:
Public Liability $100,000 - $300,000.00
Automobile Property Damage
$35,000.00
Liability Insurance may be arranged by Comprehensive General Liability and
Comprehensive Automobile Liability policies for the full limits required; or by a
combination of underlying Comprehensive Liability policies for lesser limits with the
remaining limits provided by an Excess Umbrella Liability policy in the amount of
$2,000,000.00.

PART IV: CONTRACT
2026 Fleet Services Building Roof Overlay
THIS CONTRACT made this ______________ day of ________________________, 2026, by and between
________________________________________________________, hereinafter call the Contractor and the
City of Oconomowoc, Wisconsin, hereinafter called the Owner.
WITNESSETH, that the Contractor and the Owner for the consideration herein agree as follows:
ARTICLE I, SCOPE OF WORK: The Contractor shall perform everything required to be performed and
shall furnish and provide all the labor, materials, necessary tools, equipment, utility and
transportation services required to perform and complete in a workmanlike manner all work required
to provide a roof overlay in accordance and in compliance with manufacturer specifications.
ARTICLE II, THE CONTRACT PRICE: The Owner shall pay the Contractor for the performance of this
Contract, subject to any additions or reductions provided herein, upon Contractors presentation of
lien waivers for all subcontractors, laborers and material men, in current funds, the contract price
computed as follows:

ARTICLE III - SPECIFICATIONS & PLANS. The Contractor shall keep at the project at all times, a
copy of the plans and specifications, and shall at all times give the Owner or his representative's
access thereto. Anything mentioned in the specifications and not shown on the plans or shown on
the plans and not mentioned in the specifications shall be of like effect as if shown or mentioned in
both. In case of difference between the plans and specifications, the specifications shall govern.
In any case of discrepancy in the figures or drawings, the matter shall be immediately submitted to
the Owner without whose decision said discrepancy will not be adjusted by the Contractor, save
only at his own risk and expense. The Owner shall furnish such detail drawings and other
information as he may consider necessary, unless otherwise provided. Upon completion of the
contract, the work shall be delivered complete and undamaged.

Counterparts of each have been delivered to OWNER and CONTRACTOR. All portions of the
Contract Documents have been signed or identified by OWNER and CONTRACTOR or on their
