Bid 24-46, Construction – Niokaska Stream Restoration (Magnolia Drive) Rebid
The City of The City of Fayetteville is accepting sealed bids from properly licensed firms for the restoration of an approximately 300-foot section of Niokaska Creek near Magnolia Drive in Fayetteville, Arkansas, to help reduce streambank erosion and improve aquatic and terrestrial habitat. A non-mandatory Pre-Bid meeting will be held Thursday, October 17, 2024 at 10:00 AM, in person on-site at N. Azalea Terrace, where it intersects with the Niokaska Creek Trail. Information regarding the pre-bid meeting is available on the project page on the City’s electronic bidding platform. All interested parties are encouraged to attend.
Bidding documents, plans, plan holders, and addenda shall be obtained at the City of Fayetteville Purchasing Division’s electronic bidding platform at
www.fayetteville-ar.gov/bids
. All bids shall be received by Thursday, October 31, 2024 before 2:00 PM, local time utilizing the electronic bidding software or by submitting a sealed bid to the City of Fayetteville Purchasing Division. All bids shall be received prior to the bid deadline. Late or misdirected bids shall not be accepted. Submitting a bid electronically is strongly encouraged. A public bid opening will be conducted shortly after the deadline at City Hall and livestreamed at

. The City of Fayetteville shall not be responsible for lost or misdirected bids, or failure of bidder’s technical equipment.
Each bid exceeding $50,000 shall be accompanied by a cashier’s check from a bank doing business in the State of Arkansas or a corporate bid bond for five (5) percent of the amount bid. In the event a bidder opts to submit a cashier’s check for a bid bond, the actual physical cashier’s check shall be delivered to the City prior to the deadline. A one hundred percent (100%) performance bond and separate payment bond is required with the contract awarded. Both a State of Arkansas Contractor’s License and registration with the Arkansas Secretary of State are NOT required at the time of bid deadline. However; both will need to have been applied for at bid deadline and be active and valid at time of Contract award. Registration and good standing in the System for Award Management (SAM) will also be required prior to contract execution.
The City of Fayetteville reserves the right to waive irregularities, reject bids, and postpone the award of any Contract for a period which shall not exceed beyond ninety (90) days from the bid opening date.
Pursuant to Arkansas Code Annotated §22-9-203 The City of Fayetteville encourages all qualified small, minority and women business enterprises to bid on and receive contracts for goods, services, and construction. Also, City of Fayetteville encourages all general contractors to subcontract portions of their contract to qualified small, minority and women business enterprises.
The contractor shall not discriminate on the basis of race, color, national origin or sex in the performance of this contract. The contractor shall carry out applicable requirements of 40 CFR part 33 in the award and administration of contracts awarded under EPA financial assistance agreements. Failure by the contractor to carry out these requirements is a material breach of this contract which may result in the termination of this contract or other legally available remedies.
The City of Fayetteville hereby notifies all bidders that this contract is subject to applicable labor laws, non-discrimination provisions, wage rate laws and other federal laws including the Fair Labor Standards Acts of 1938, The Work Hours Act of 1962, Title VI of the Civil Rights Act of 1964, and The Clean Water Act also apply.
Build America, Buy America provisions apply to this project.
This project is a Federal-Aid contract. This project requires wage rates to be paid according to Davis-Bacon Federal Wage Rates. The percentage goal for Disadvantaged Business Enterprise (DBE) Participation in the project is 11.0%.
