The purpose of this amendment is to provide the Government’s responses to questions received regarding the Small Business Manufacturer / Nonmanufacturer Rule Clarification.

All other terms and conditions remain unchanged.

Question 1:

Does the SBA Nonmanufacturer Rule apply to this acquisition, including FAR 52.219-33 or another applicable NMR provision?

Answer 1:

The solicitation identifies this acquisition as a Commercial Supply / Direct Purchase, Supply-Only, No Installation, and includes FAR 52.219-6, Notice of Total Small Business Set-Aside. However, FAR 52.219-33, Nonmanufacturer Rule was not included to the solicitation.

Question 2:

Is an SBA class or individual waiver applicable to the required end items?

Answer 2:

The solicitation does not identify any SBA class waiver or individual waiver applicable to the required end items, and FAR 52.219-33, Nonmanufacturer Rule, was not included in the solicitation. Due to the limited time remaining in FY 2026, requesting or processing an individual SBA waiver at this stage would likely delay award and may adversely impact the mission requirement. Therefore, absent identification of an existing applicable SBA class waiver, the acquisition should proceed in accordance with the solicitation’s current terms and conditions and applicable small business set-aside requirements. Any offeror seeking to rely on a waiver should provide the specific waiver citation or documentation immediately for Contracting Officer review.

Question 3:

If no waiver applies, must the actual end-item manufacturer qualify as a small business under the assigned manufacturing NAICS code?

Answer 3:

Generally, yes. If the Nonmanufacturer Rule applies and no SBA waiver or other exception applies, the small business prime/dealer must provide the end item of a small business manufacturer or processor. The manufactured end item must also be made in the United States, consistent with the NMR requirements and the solicitation’s domestic sourcing clauses.

Question 4:

May a small-business prime/dealer furnish an otherwise fully compliant commercial product manufactured by a large business?

Answer 4:

Generally, no, if the Nonmanufacturer Rule applies and no SBA waiver or exception is available. Under the NMR, a small business prime/dealer normally may not furnish the product of a large business manufacturer for a small business set-aside supply acquisition unless an SBA waiver or other applicable exception permits it.

The solicitation also includes FAR 52.225-1, Buy American-Supplies, and FAR 52.225-18, Place of Manufacture, so country of origin and place of manufacture must also be addressed in the quote.

Question 5:

Please confirm the complete six-digit NAICS code and size standard controlling this procurement if different from the abbreviated NAICS shown in the public notice.

Confirmed. The requirement is for a factory-installed lockset. The lockset shall be a LockOne LKM10K Lock Series.

• All-Inclusive Firm-Fixed-Price: Quoted pricing for CLIN 0001 is all-inclusive. All crating, in-transit insurance, freight transportation (FOB Destination), delivery, and hardware components must be included in the lump-sum price.


• Tax Exemption: The United States Federal Government is tax-exempt. No state, local, or sales taxes shall be applied.

3.0 Description of Requirement & Salient Characteristics (FAR 12.202(b)(1)(iii))

3.1 Scope of Requirement

This acquisition is strictly for the factory manufacture, hardware integration/preparation, protective crating, and delivery (FOB Destination) of one (1) factory-engineered, high-performance sound-attenuated wood door and split-frame assembly package. The door assembly must achieve an independently certified laboratory sound rating of Sound Transmission Class (STC) 50 or higher to satisfy federal standards for classified and secure discussion spaces (Secure Compartmented Information Facility [SCIF] / Secure Working Area [SWA] standards).

Note: This contract is for supply-only delivery. Field installation, on-site wall integration, and perimeter drywall work are excluded.

3.2 Salient Physical, Functional, and Performance Characteristics

To be deemed technically acceptable, the quoted door and frame package must meet or exceed all of the following minimum criteria:

   • Door Closer: Heavy-duty, surface-mounted commercial door closer conforming to LCN 4040XP in aluminum powder coat finish (or approved equal), featuring adjustable spring sizes 1–6, hydraulic backcheck, and delayed action to overcome acoustic seal resistance.

• Inspection & Acceptance: Destination inspection and final acceptance will be conducted by FLETC Physical Security and Receiving personnel upon verification of certified laboratory STC 50 test reports, rough opening compatibility, and complete hardware bill of materials.

The Government reserves the right to award to a higher-priced offeror if superior technical merit or faster delivery warrants a price premium.


• Price Evaluation (FAR 12.209): The Government will determine price reasonableness based on adequate price competition, or secondary price analysis techniques under FAR 15.404-1 if needed.
