I. Introduction
This project includes the furnishing and placement of bituminous concrete shim and overlays on
selected streets and parking lots which have been prepared previously by the City of Bangor Public

application of bituminous concrete binder and surface courses to previously compacted and graded
gravel base courses. In addition, bids are requested for application of bituminous tack coat, for in-
place pavement reclamation and for cold planing.
II. General Information
Available on the City’s website at the following web address: www.bangormaine.gov/proposals. By
submitting a response to this solicitation, the Proposer accepts the responsibility for downloading,
reading, and bidding by the terms and conditions set forth in the City’s “General Information for
Vendors”.
In your proposal, please specify whether you currently have or are in the process of developing a
domestic violence policy. If you do not have such a policy, let us know if you would like to receive a
copy of the City of Bangor's policy as a reference.
III. Submission
For consideration, the Proposer must submit the completed Bid Form pages in an envelope marked
"Proposal No. P26-48: CY 2027 Paving Program" by 2:00 P.M. on Wednesday, April 22, 2026.

All submissions should reference “Proposal No. P26-48: CY 2027 Paving Program”. Proposals will
be publicly opened at the time stated above in the Paul Bunyan Room (first floor near the side
elevator) 73Harlow Street, Bangor, Maine.
A tabulation of all received proposals will be posted on the City's website as soon as possible after
the opening date. Visit www.bangormaine.gov/bidtabs for results.
IV. Questions
Any questions must be directed in writing to bids@bangormaine.gov no later than 4:30 P.M., Friday,
April 3, 2026.
The City will provide a response by 4:30 P.M. on Friday, April 10, 2026. This response will be in the
form of an addendum, accessible on the City's website. No interpretation of the meaning of the
plans, specifications, or other contract documents will be made to any Proposer, orally.
Notifications will be sent to the Registered Vendor List when new addenda are released. To receive
these updates, the City strongly encourages all proposers to sign up for updates at
https://www.bangormaine.gov/list.aspx?Mode=Subscribe#bids. Failure to receive any addenda or
interpretation thus posted will not relieve the Proposer of their obligation under the bid submitted.
All addenda issued will become part of the contract documents.
V. Late Proposals
It is the responsibility of the Proposer(s) to see that their proposals have sufficient time to be
received by the Purchasing Department before the submittal deadline. Any proposal, portion of a
proposal, or requested proposal revision received at the City Purchasing Department after the time
and date specified, will be returned to the Proposer unopened.
VI. Withdrawal of Proposals
No Proposer may withdraw their proposal for a period of ninety (90) days from the date of opening.
All proposals shall be subject to acceptance by the City during this period.
To withdraw a proposal prior to the opening, the Proposer shall request the withdrawal in writing.
All costs associated with the withdrawal (i.e. mailing fees) will be borne by the Proposer.
VII. Rejection
The City reserves the right to reject any proposals, waive any informalities or defects in proposals, or
accept a higher cost proposal if it is deemed to be in the best interest of the City. The City also
reserves the right to clarify with the successful Proposer.

VIII. Information for Proposers
A. Tax Exclusion: All Federal and State taxes must be excluded from the proposal price. Upon
request, a tax exemption certificate for the City of Bangor shall be furnished to the successful
Proposer.
B. Bid Form and Requirements: The Bid Form, included with this request, must be completed and
returned for a proposal to be considered.
C. Required Insurance: Proposers are required to maintain the following insurance policies
throughout the life of the project and name the City of Bangor as an additional insured where
applicable and may be required to provide proof:
1. Worker’s Compensation Insurance Statutory
2. Employer’s Liability Insurance
$500,000 each accident
$500,000 disease – policy unit
$500,000 disease – each employee
3. Comprehensive Automobile Liability $1,000,000 combined, single limit per
accident
4. Commercial & General Liability

IX. Scope of Services
The work contemplated under the terms of this proposal consists of the furnishing and placement of
bituminous concrete pavement on various streets, including 1 to 2-inch overlays in existing paved
areas which have been previously cleaned and prepared. In some instances, the application of 3 to 4
inches of bituminous concrete, in two lifts, will be required on a base course of areas which have
previously been constructed or reconstructed. Paving is contemplated on approximately 40 different
sections of streets with a total estimated quantity of approximately 12,750 tons of Hot Mis Asphalt
(HMA).
Cold planing and reclamation may also be required on some streets. Minimum daily quantities will be
approximately 500 square yards for planing. Work will also include the application of tack coat. All
preparatory work will be done by the City, including sweeping, cleaning, patching, crack sealing, etc.
Proposers are advised that the above-mentioned tonnage quantity includes an allowance of
approximately 15% for shimming, prior to the placement of overlays, including streets that are cold
planed.
Under this proposal the successful Proposer shall be responsible for paving apron/approaches of
streets, intersecting streets to be paved, and around such catch basin and manhole structures as may
exist in the paved traveled way, to the extent necessary to provide a smooth transition as determined
by the Public Works Director or their appointed designee.

X. Definitions
The following terms shall have the following meanings within the text of this proposal:
A. City: The City of Bangor, Maine acting through its duly authorized representatives.
B. Director: The City of Bangor Public Works Director or their duly authorized representative.
C. Contractor: The individual, firm, or corporation to whom the contract has been awarded
whether acting on their own or through Subcontractors or employees.
XI. Contract
The contract shall be deemed to include the Notice to Contractor, Information for Proposers, the Bid
Form, the Contract Agreement, the Performance and Payment Bond(s), the Specifications, any issued
Addenda, and all other provisions which may be required to be included in this proposal, whether
actually included or not.
XII. Bid Security
Each Proposer must submit with their bid, a certified check or bid bond, in the amount of 5% of their
total bid price, as a guarantee that the Proposer will enter into a contract if awarded. Said check or
bid bond will be returned to all except the two (2) lowest Proposers immediately following the
opening of bids. The remaining sureties will be returned after the City and Proposer have executed
the contract. If the contract has not been awarded within thirty (30) days of the bid opening, the
surety will be returned at the request of any Proposer, as long as they have not been notified of the
acceptance of their bid.
XIII. Qualified Proposer:
The City may make such investigation as deemed necessary; to determine the ability of any
Proposer(s) to perform the work and the Proposer(s) shall furnish to the City all such information and
data pertinent to this investigation as the City may request. The City reserves the right to reject any
bid after evidence submitted or investigation of the Proposer fails to satisfy the City, that such
Proposer is properly qualified to carry out the obligation of the contract and to complete the work
contemplated therein. Conditional bids will not be accepted.
XIV. Basis of Award
The contract will be awarded to the Proposer submitting the lowest bid. In the event the Proposer
submitting the low bid, is found to not be properly qualified to carry out the work, the contract will
be awarded to the next lowest qualified Proposer.

XV. Proposer’s Obligation
At the time of the opening of the bids, it will be presumed that each Proposer will have inspected the
site(s) and thoroughly familiarized themselves with the contract documents, including the
specifications and any addenda which may have been issued. Failure of the Proposer to receive and
examine any form, instrument, or document or to visit and examine the site itself, will not in any way
relieve the successful Proposer from any obligation in respect to their bid or to the terms of the
contract.
XVI. Bid Security Forfeited
Should the Proposer to whom the Contract is awarded, fail for any reason to execute the contract and
to furnish a satisfactory bond within the time specified, the City may determine that the Proposer has
abandoned the contract, that their bid shall be considered null and void and that the surety
accompanying the bid shall be forfeited to and be retained by the City as liquidated damages, and the
contract may be awarded to another Proposer. After the execution of the contract and acceptance of
the bond by the City, the surety accompanying the successful Proposer’s bid shall be returned.
XVII. Performance Bond, Labor, and Materials Bond
Simultaneously with their delivery of the contract to the City, the successful Proposer shall deliver to
the City an executed Performance Bond and an executed Labor and Materials Bond (each in the
amount of 100% of the total bid price) as security for the faithful performance of the contract and for
payment of all persons performing labor or furnishing materials in connection therewith. These bonds
shall be on the prescribed forms and shall be furnished by a surety company or companies listed on
the current Circular 570 of the U.S. Treasury Department which company or companies shall also have
a record of services satisfactory to the City, shall be authorized to do business in the State of Maine
and shall be independent of the Proposer.
XVIII. Work Under the City Public Works Department
This project will be administered by the City of Bangor Public Works Department. The Public Works
Department will inspect all items that are delivered to the project site under the contract to assure
the City that all items are of first quality materials and workmanship. Any items found to be visibly
defective will be rejected and the Proposer will be required to remove and replace such defective
items.
Neither the fact of such inspection, nor the omission thereof, will imply acceptance by the City of any
nor all of the work performed under the contract or relieve the Proposer of any responsibility for the
successful completion of all the terms of the contract subject to final inspection and review by the
City.
