Project Description: Sealed Bids for the construction of Spruce Street Water Main Replacement improvements on Spruce Street in Denver Borough will be received online via the PennBid Program by Denver Borough until 11:00 A.M prevailing time, on December 15, 2025, at which time the Bids will be made available online.
The Project consists of, but will not necessarily be limited to, providing all equipment, materials, labor, supervision, and testing services for the Spruce Street Water Main Replacement project as further described in the Contract Documents.
A pre-bid conference will be held at 9:00 A.M. at the Denver Borough office, located at 501 Main Street, Denver, PA 17517 on December 3, 2025. All prospective bidders are encouraged to attend. Final questions are due no later than 12:00 P.M. on December 5, 2025. A final addendum, if necessary, will be issued by 3:00 P.M. on December 8, 2025.

Bids will be received for a single prime Contract. Bids shall be on a lump sum and unit price basis.
Bid Security in the amount of 10% of the Bid amount, the Workmen’s Compensation Affidavit, Public Works Employment Verification Form, and a Non-Collusion Affidavit must accompany the Bid in accordance with the Instructions to Bidders.
Bids shall remain open for a period of 60 days from the date of Bid opening. Bids may not be withdrawn during this period. The successful Bidder shall be required to furnish performance and payment bonds in the amount of 100% of the Contract Price in accordance with the Instructions to Bidders.
This Project is subject to the Federal Occupational Safety & Health Act of 1970 (OSHA) conditions.
This Project is subject to Pennsylvania Act 287 of 1974, as amended by Act 172 of 1986, as amended by Act 38 of 1991, as amended by Act 187 of 1996.
This project is subject to the Trade Practices Act of July 23, 1968, P.L. 686 (81 P.S. 773.101 et seq.)
This Project is subject to the Public Works Employment Verification Act.
This Contract is subject to Pennsylvania Human Relations Act 222 conditions.
This Contract is subject to the non-discrimination in Employment/Contract Compliance Regulations Conditions.
FEDERAL REQUIREMENTS
Notice is hereby given to bidders that construction of this project is being funded, in part, by a federal grant provided to Lancaster County from the U.S. Dept of Housing and Urban Development and is subject to the Davis Bacon Act of March 3, 1931, as amended. Wages must be paid by contractors according to the U.S. Department’s Wage Decision included in the specifications. All bidders must also comply with the requirements of Section 3 of the Housing and Urban Development Act of 1968; the Executive Order of 11246 or any other order which prohibits discrimination in employment. All bidders are advised that an executed Attachment B from the Section 3 Action Plan included in the specifications must be submitted or the bid will be rejected as non-responsive.
Qualified Minority and Women Owned Businesses (MBE/WBE) are encouraged to respond to the Invitation to Bid.
All Bidders must comply with the requirements for Equal Employment Opportunity as prescribed in the “Notice of Requirement for Affirmative Action to Ensure Equal Employment Opportunity” included in the Specifications.
All Bidders must comply with the Federal Labor Standard Provisions (“Supplementary Conditions of the Contract for Construction”, HUD-92554M) from the U.S. Department of Housing and Urban Development included in the Specifications.
All Bidders must be registered in the Federal System for Award Management – SAM.gov (https://sam.gov/content/entity-registration)
Denver Borough reserves the right at its option to waive any informalities, irregularities, defects, errors or omissions in any or all of Bids and to accept or reject any or all parts of the Bids which in its judgment is in the best interest of the Borough.
