Delivery of Bulk Fuels, Lubricants, and Diesel Exhaust Fluid
Notice is hereby given that bids will be received at the Merced County Regional Waste Management
Authority (MCRWMA), a California Joint Powers Authority, for performing all work necessary in
accordance with the Project Requirements specified herein. Please carefully read and follow the
instructions provided. Bidders are responsible for making certain that their bid is complete and is received
by MCRWMA on or before the closing deadline.
Bids shall be emailed to: Magdalena Gartonzavesky, HR and Procurement Specialist, at
procurements@mcagov.org. The email subject line shall read as follows: IFB20260611MCRWMA -

Bids received/email timestamped after the closing deadline will be rejected.
A pre-bid meeting and project site visits will be held on July 2, 2026, at 1:00 p.m. The pre-bid meeting and
project site visits will begin at 7040 N. Highway 59, Merced, CA 95348 and will conclude at 17173 S. Billy
Wright Rd., Los Banos, CA 93635. Bidders interested in attending must RSVP via email to
procurements@mcagov.org by 12:00 p.m. July 1, 2026.
Bids will be publicly opened and read via a conference call on July 20, 2026 at 11:00 a.m., PDT. Bids must
remain effective for 90 days from Bid opening to allow for adequate review time and award of a contract.
The Merced County Association of Governments Purchasing Policy and all of its provisions are
incorporated by this reference.
MCRWMA is not liable for any costs incurred by Bidders in responding to this Invitation for Bids (IFB).
Bidders are hereby notified that Bids become public record. Bidders are to clearly identify any information
that is confidential and/or proprietary and submit a redacted copy of their bid with the confidential and/or
proprietary information. In the event of a Public Records Act or Freedom of Information Act request,
MCRWMA will use the redacted copy submitted by the Bidder in response and the failure to provide a
redacted copy may result in the disclosure of a Bidder's entire response. MCRWMA is not responsible or
liable for the disclosure of any information that is not clearly labeled as confidential and/or proprietary
and provided in redacted form.

DEFINITIONS
Agreement - The Agreement constitutes the entire contract between MCRWMA and the selected Bidder.
Term may be used interchangeably with Contract.
Authorized Representative - Person who has the legal authority to enter into and sign contracts on behalf
of the organization.
Bidder/Respondent - A person, partnership, firm, or corporation submitting a Bid with the intention of
obtaining an MCRWMA contract.
Closing Deadline - The last day and time the Bid must be received via email to
procurements@mcagov.org. Term may be used interchangeably with Submission Deadline.
Contract - The Contract constitutes the entire agreement between MCRWMA and the awarded Bidder.
Term may be used interchangeably with Agreement.
Contractor - The Bidder awarded the Contract derived from this IFB.
Days - Unless otherwise specified, all references to any "day" or number of "days" shall mean consecutive
calendar days (including all holidays and weekends).
MCAG - Merced County Association of Governments, a joint powers authority, established under
California Government Code Section 6500 et seq.
MCRWMA - Merced County Regional Waste Management Authority, a Joint Powers Authority,
established under California Government Code Section 6500 et seq. May also be referenced as The
Owner or Owner's Authorized Representative (OAR) or Authority.
Subcontractor(s) - Any person, entity, or organization, to which Contractor, or MCRWMA, has delegated
any of its obligations hereunder.

SECTION I - GENERAL INFORMATION
1.1 PURPOSE
MCRWMA invites the submission of Bids from qualified contractors to deliver regular unleaded gasoline,
R99 or R100 renewable diesel, lubricants, and diesel exhaust fluid to the Highway 59 Landfill (7040 N.
Highway 59, Merced, CA 95348) and Billy Wright Landfill (17173 S. Billy Wright Rd., Los Banos, CA 93635),
for the operation of MCRWMA's fleet vehicles and equipment.
MCRWMA intends to use the results of this IFB to award one or two contract(s) to the responsive,
responsible, and lowest price Bidder(s).
1.2 AGENCY INFORMATION
MCRWMA, created in 1972, is a California JPA comprised of seven member agencies: City of Atwater, City
of Dos Palos, City of Gustine, City of Livingston, City of Los Banos, City of Merced, and the County of
Merced and governed by the MCRWMA Governing Board. Established for the purpose of coordinating
and managing two regional landfills in Merced County, the role of MCRWMA was expanded in the 1990's
to include activities mandated by the California Integrated Waste Management Act. The MCRWMA
Governing Board has been designated as the governing body for MCRWMA operations.
MCRWMA is responsible for managing the solid waste, green waste, organic materials, recyclable
materials, and household hazardous waste (HHW) programs for its member agencies, including
developing and implementing programs that assist its member agencies to meet related State mandates.
MCRWMA owns and operates 2 landfills: Highway 59 landfill and the Billy Wright (BW) landfill, located on
the east and west side of the county, respectively. Both offer waste disposal, HHW services, and the
transfer of recyclable and organic materials.
1.3 CONTRACT DURATION
The contract term is anticipated to commence August 28, 2026, and end August 27, 2029, and is
contingent upon agreed services, available funding, and successful performance. The contract term may
be extended by MCRWMA at its sole discretion, for up to 3 additional one-year terms and shall be based
on available funding and successful performance. The contract will be a fixed price contract for the full
term including the additional extension options and will include agreed upon economic price adjustments
related to the Oil Price Information Service or equivalent daily low rack price for Stockton, California.
1.4 IFB SCHEDULED ACTIVITIES
To the extent achievable, the following schedule shall be used for the procurement process. MCRWMA
reserves the right to modify the dates below as necessary.

1.5 PRE-BID MEETING AND PROJECT SITE VISIT
A pre-bid meeting and project site visits will be held on July 2, 2026, at 1:00 p.m. PDT. The pre-bid meeting
and project site visits will begin at 7040 N. Highway 59, Merced, CA 95348 and will conclude at 17173 S.
Billy Wright Rd., Los Banos, CA 93635. Pre-Bid meeting is not mandatory. An attendance sign-in sheet will
be available, and all potential bidders must sign-in to verify their attendance. Interested attendees are to
RSVP via email to procurements@mcagov.org by July 1, 2026, by 12:00 p.m.
1.6 QUESTIONS, CLARIFICATIONS AND/OR REVISIONS
Bidders are expected to raise any questions, noted errors, discrepancies, ambiguities, exceptions,
additions, or deficiencies they have concerning this IFB via email to procurements@mcagov.org no later
than 12:00 p.m. July 6, 2026.
If a Bidder fails to notify MCRWMA of any condition stated above that reasonably should have been known
to the Bidder, and if a contract is awarded to that Bidder, the Bidder shall not be entitled to additional
compensation or time by reason of the error or its correction.
Revisions to this IFB will only be made by official addendum issued by MCRWMA. Addenda will be posted
by July 13, 2026. Bidders are responsible for checking the website for addenda prior to submitting their
bid. Failure to acknowledge addenda may disqualify a Bidder. As such, Bidders are advised to review the
website prior to the close of this IFB at https://mcrwma.org/bids.aspx. Bidders are encouraged to sign up
for "Notify Me" on the website to receive emails, or a text, when items are posted relevant to IFB's.
1.7 BID OPENING
Bids will be read via a conference call on July 20, 2026 at 11:00 a.m. Anyone interested in joining the bid

1.8 WITHDRAWAL OF BIDS
Bid shall be irrevocable unless withdrawn prior to the closing deadline. Bidders may withdraw a Bid, in
writing, at any time up to the closing deadline. A written withdrawal notice must be received by email to
Magdalena Gartonzavesky at procurements@mcagov.org. The notice must be signed by an authorized
representative. If a previously submitted bid is withdrawn prior to the closing deadline, the Bidder may
submit another Bid at any time up to the closing deadline.
1.9 PROTEST PROCEDURES
Notice of intent to protest must be made in writing and conform to the requirements of MCRWMA Protest
Procedures, included herein on pages 17 - 19.

1.10 FALSE OR MISLEADING STATEMENTS
Bids which contain false or misleading statements, or which provide references which do not support an
attribute or condition claimed by the Bidder, shall be rejected.
1.11 RIGHT TO REJECT OR ACCEPT BIDS AND RIGHT TO CANCEL
MCRWMA reserves the right to reject any or all bids or any part thereof, or to waive any informalities or
minor irregularities in the Bids. MCRWMA also reserves the right to cancel this IFB in part or in its entirety.
1.12 DISPUTE RESOLUTION, ATTORNEY FEES, JURISDICTION, AND VENUE
In any action, suit, or proceeding arising out of or in any way connected with the performance of the
Agreement contemplated herein, the prevailing party shall be entitled to recover reasonable attorney's
fees and costs. Notwithstanding any other provision of the Agreement contemplated herein, any disputes
concerning any question of fact or law relating to the Agreement contemplated herein, or any litigation
or arbitration arising out of the Agreement contemplated herein, shall be interpreted pursuant to
California law, subject to the jurisdiction of the Superior Court of California, and venued in the County of
Merced. CONTRACTOR expressly waives federal jurisdiction.
1.13 BID RESULTS

SECTION II - REQUIREMENTS - SCOPE OF WORK
2.1 GENERAL
CONTRACTOR shall deliver regular unleaded gasoline, R99 or R100 renewable diesel, lubricants, and diesel
exhaust fluid for the operation of MCRWMA's fleet vehicles and equipment. Fuels shall comply with all
applicable rules and regulations. MCRWMA shall place orders on an as needed basis and pre-determined
basis, throughout the year. MCRWMA requires motor fuel deliveries of varying quantities at two locations
within Merced County, requiring CONTRACTOR to furnish full-load and short-load deliveries. Delivery
charges shall be included in the unit costs, with no additional charge for short loads permitted. All diesel
fuel provided shall meet specifications.
2.2 DELIVERIES, SCHEDULE, AND ADDRESS
CONTRACTOR shall maintain sufficient inventory of unleaded gasoline and R99 or R100 renewable diesel
and shall be capable of delivering 25% of the total storage capacity identified in the table below for both
landfill sites.

CONTRACTOR shall be required to use common carriers, own or lease a delivery truck fleet sufficient to
service any resultant contract and dedicated specifically to motor fuel delivery. To prevent potential fuel
contamination, all deliveries are required to be made in clean trucks used solely for delivery of the product
ordered.

CONTRACTOR shall deliver fuels to MCRWMA, F.O.B. Merced and Los Banos, within the delivery schedules
specified below.
Deliveries are to be made periodically, as called for by MCRWMA. Pre-determined scheduled deliveries
shall be made Monday through Friday between the hours of 7:00 a.m. to 3:00 p.m., excluding all major
holidays. For emergency deliveries, CONTRACTOR shall supply fuel within twenty-hour (24) hours of an
order placed by MCRWMA, seven (7) days per week.

2.3 PRODUCT SPECIFICATIONS AND STANDARDS
Bulk Fuels
Gasoline sold to MCRWMA shall be regular, unleaded, minimum 87 octane, exclusive of additives and
shall meet or exceed all current rules and requirements of ASTM D439, as last revised, SCAQMD, State
and/or Federal regulations.
R99 or R100 renewable diesel sold to MCRWMA shall not exceed 0.05 percent, by weight, sulfur content
and shall comply with ASTM D975, as last revised, and with all current rules and requirements of the
SJVAPCD, State and/or Federal regulations. R99 or R100 renewable diesel with red dye shall comply with
standards and specifications established by the California Air Resources Board. Sulfur content shall not
exceed 15 ppm.
All fuel provided to MCRWMA shall meet applicable engine/vehicle manufacturer's specifications.
CONTRACTOR shall provide R99 or R100 renewable diesel to MCRWMA and comply with all applicable
